CC MINS 19870630 JNTMINU..TES RANCHO PALOS VE RDES CITY COUNCIL REGULAR MEETING /JOINT MEETING WITH FACT COMMITTEE JUNE 301 1987 The meeting was called to order at 7:30 P.M. at Hesse Park by Mayor Melvin W. Hughes at 29301 Hawthorne Blvd. After the Pledge of Allegiance to the flag, roll was as follows: PRESENT: RYAN, BACHARACH, McTAGGART , HINCHLIFFE , & MAYOR HUGHES Also present were the following members of the FACT Committee, Beaumont, Bolton, Downing, Forman, McNulty (late arrival at 8:29 p.m.) Szu, Weiss and Chairman Gleghorn. Absent: Bonetto, Pescetti and Roth. Also present were City Manager Dennis McDuffie, Finance Director Kevin Smith, City Clerk Jo Purcell, and Director of Public Works George Wentz, The City Clerk announced that four items had been added to the agenda : 1. Upgrading , the Nuisance Ord inanc e ( McTaggar t) , letter to the Fair Political Practices Commission regarding Dr. Harvey Brown. (Ryan), Marine - land Ad Hoc Committee (Ryan) , and leaf blowers (Ryan) . The agenda has amended was approved on motion of Councilwoman -= Bacharach, seconded by Councilman McTaggart, and carried. PARCEL TAX DISCUSSION: City Manager McDuffie gave an over- view of the intended focus of the meeting to discuss the feasibility of a parcel tax to replace the uti- lity user tax as a funding source for the City, structure of the tax, revenue estimates , collection and assessments, timeline for implemen- tation, public reaction and election strategy. Discussion and comment between the Committee and the Council then ensued and centered on the amount of revenue to be raised, the fact that the Capital Improvement Program had now been extended to a ten -year program instead of the initial three, the Gann restrictions the timeframe to adjust a parcel tax, what would happen in case the Gann limitation was exceeded, the mechanism used to reduce the parcel tax, and the increase in costs that are taking place due to the delay of the Capital Improvement Projects. Additional discussion took place on the staffing level that would be necessary in order to perform the CIP Program at the three year level, and the reasons why some delays have occurred in these projects. The Committee and Council then discussed some of the pros and cons of the utility tax 708CP /MIN21 -1- June 30, 1987 versus a parcel tax, the prospects of passage of a utility tax versus a parcel tax, and the election date for putting such a measure on the ballot. The discussion concluded with the consensus that at their next meeting the FACT Committee should consider the rate of the tax, the appropriate date for such an election, the type of tax, and generally, the best method for publicizing such an election. Responding to the Mayor's call for public testimony was Elza Cortes who requested clarification of the Council's intent for the July 7th meeting. At 10:26 the Mayor declared a recess and the FACT Committee adjourned. At 10:40 the meeting resumed. RENOVATION OF GREEN BUILDING City Manager McDuffie presented the (1201) June 30th, staff memorandum and recommended that staff be authorized to renovate the green building at a cost of $110,000. Council discussion then centered on the asbestos removal from the building, whether the building was seismically sound, and the length of time it would take to prepare the building for occupancy. Councilman Ryan moved, seconded by Councilman McTaggart carried, to authorize staff to get a seismic study of the building at a cost not to exceed $5000. The motion carried on a following roll call vote: AYES: RYAN, BACHARACH, McTAGGART, HINCHLIFFE , & MAYOR HUGHES Councilwoman Bacharach moved, seconded by Councilman McTaggart and carried to offer to the Cable TV Access Foundation the use of the Leisure Services building for use as a studio should the renovation of the Green Building appear possible. Councilman McTaggart moved, seconded by Ryan to adopt in concept the plan presented by the staff for the renovation of the green building. The motion carried unanimously. CLOSURE OF CREST ROAD (1502) NUISANCE ABATEMENT Councilwoman Bacharach moved, seconded by Councilman McTaggart and carried to approve the closure of Crest Road to traffic from Ganado from July 3rd at 4 p.m. I to July 5th at 10 a.m. (Residents excepted). Referring to the fact that the City's Nuisance Ordinance is based on health and safety factors, Councilman McTaggart recommended that aesthetic considerations be incorporated into the ordinance. Staff commented that such consideration was now under study and would be presented at a later council meeting. 708CP /MIN21 -2- June 30 1 1987 LETTER TO FPPC Councilman Ryan presented a draft of (1202) a letter to the Fair Political Practices Commission requesting that they allow Dr. Harvey Brown to perform community services in lieu of the $4000 fine. Discussion then followed on how the letter would be worded to address the Commission's concern about a direct link between the volunteer service and the reason for the fine. It was the consensus that a paragraph be added to the proposed letter, addressing an identifiable link with the community. Councilman Hinchliffe moved, seconded by Councilman Ryan to add this item to the agenda for consideration at this meeting because of the urgency of the matter. The motion carried unanimously. It was the consensus that a copy of this letter should go to Senator Beverly. MARINELAND AD HOC COMMITTEE LEAF BLOWERS (1801) RECESS TO CLOSE SESSION ATTEST: Referring to the letter from Sedwa.y- Cook regarding their request for a meeting to discuss Marine land , Councilman Ryan inquired whether the original committee which was set up to deal with HBJ would also be dealing with the development of Marineland. It was the consensus that this would be an item for discussion at the City Manager's Retreat. Referring to the information sent to the Council regarding leaf blowers, Councilman Ryan inquired when this item would be put on a City Council agenda. It was the consensus that the item would be set for a future agenda. At 11:31 the meeting adjourned on motion of Councilman McTaggart and carried. Mayor 708 '1- 21 -3- June 30 1987
