Hughes at the Hesse Park Community Center, 29301 Hawthorne Boulevard. After the Pledge of Allegiance to the Flag, roll call was answered as follows: PRESENT: BACHAR.ACH, HINCHLIFFE , McTAGGART & MAYOR HUGHES LATE ARRIVAL: RYAN AT 7:31 P.M. Also present were City Manager Dennis W. McDuffie, Finance Director Kevin N. Smith, City Attorney Steve Dorsey, Director of Environmental Services Robert Benard, Director of Public Works George Wentz and City Clerk Jo Purcell, WAIVER OF FULL READING OF Councilman Hinchli f f e moved, ORDINANCES & RESOLUTIONS seconded by Councilman Ryan and carried to waive reading in full of all ordinances and resolutions adopted at this meeting with consent to the waiver of reading deemed to be given by all councilmembers after reading of the title, unless specific request was made at that time for the reading of such ordinance or resolution. APPROVAL OF AGENDA The City Clerk announced that an item regarding sidewalk policy was added to the agenda by Councilman McTaggart. The agenda as amended was approved on motion of Councilman Hinchliffe, seconded by Councilwoman Bacharach and carried. 708CP /MIN18.1 -1- June 2, 1987 CONSENT CALENDAR Councilwoman Bacharach moved, sec- onded by Councilman Hinchlif f e to approve the Consent Calendar as follows: MINUTES Approved the Minutes of May 12th and May 19th, STREET PATCHING CONTRACT - (1) Accepted the Fiscal 86 -87 Street FISCAL 1986 -1987 (1405) Patching Project as complete for the total cost of $83,,500.00; (2) Directed the City Clerk to notify the surety and to exonerate contract bonds and release the retention thirty (30) days after the Notice of Completion is recorded if no claims are filed agains t the contractor during that period. PALOS VERDES DRIVE SOUTH Awarded the Design Contract to Civic RECONSTRUCTION - AWARD OF DESIGN Engineering Corporation in an amount CONTRACT (1404) not to exceed $71,400.00, plus $7,000.00 contingency, for a total of $78,400.00. LEGISLATION ( 306 ) Supported AB1125 (Tanner ) and authorized the staff to notify the City's representatives of this sup- port. 708CP /MIN18.1 -2- .Tune 2. 1987 RESURFACING PROJECT - HAWTHORNE BOULEVARD (1404) STREET SWEEPING CONTRACT (1405) TRAFFIC SIGNAL MAINTENANCE CONTRACT (1405) PUBLIC WORKS MAINTENANCE CREW (1405) ORDINANCE NO. 217 - CONVENIENCE STORES (1801) Awarded the Contract to Vernon Paving Company in the amount of $460,399.25 and authorized a contin- gency in the amount of $40,000.00, Approved the re- negotiated contract with South Bay Sweeping for $4,500.00 per month. Approved the re- negotiated contract with Superior Signal Service for $455.60 per month for a- total of $5,467.20 per year. Approved the renegotiated contract with J.T. Garza Construction, Inc. for an estimated cost $144,000,00 , plus $15,000 contingency for a total of $159,000. ADOPTED ORDINANCE NO. 217 OF THE CITY OF RANCHO PALOS VERDES AMENDING CHAPTER 16.04 , ADDING CHAPTER 17.25, AND MAKING SEVERAL MISCELLANEOUS REVISIONS TO THE DEVELOPMENT CODE AS CODE AMENDMENT NO. 23. 708CP /MIN18.1 -3- June 2 , 1987 TENTATIVE TRACT MAP NO. 44514 - AMENDMENT REQUEST (1411) RESOLUTION NO. 87 -30 - REGISTER OF DEMANDS Directed the Environmental Services Department to prepare an initial Study and recommendation imple- menting a proposed amendment to Ten- tative Tract Map 44514, ADOPTED RESOLUTION 87 -30 APPROVING CERTAIN CLAIMS AND DEMANDS AS SPECIFYING FUNDS FROM WHICH THE CLAIMS CAN BE PAID. The motion to approve the Consent Calendar carried on the following roll call vote: AYES: BACHARACH, HINCHLIFFE , McTAGGART, RYAN AND MAYOR HUGHES, NOES: NONE PUBLIC HEARING RESOLUTION N0, 87 -31 Mayor Hughes opened a public hearing RESOLUTION N0. 87 -32 - on this Landscape and Open Space LANDSCAPE MAINTENANCE Maintenance District. City Manager DISTRICT N0. 1 McDuffie presented the staff recom- (901) mendation to adopt the ro osed P P resolutions. The City Clerk reported that notice had been duly published. There being no response to the Mayor's call for public testimony, he declared the public hearing closed. 708CP /MIN18.1 -4- June 2, 1987 Resolution No. 87 -31 confirming the diagram and assessment in connection with Landscaping and Open Space Maintenance District No. 1 was presented by title and adopted on motion of Councilwoman Bacharach, seconded by Councilman Hinchliffe and carried. Resolution No. 87 -32 approving the engineer's report (Landscape and Open Space Maintenance District No.l) was presented by title and adopted on motion by Councilman Hinchliffe, seconded by Councilwoman Bacharach and carried. CEREMONIAL MATTER - CLIFTON McBRIDE ( 304) RESOLUTION NO, 87 -33 RESOLUTION NO. 87 -34 - LANDSCAPE MAINTENANCE DISTRICT N0. 2 (901) Mayor Hughes presented to Mr. Clifton McBride a proclamation in appreciation for his work in tending to the landscaping needs on a volunteer basis for this Maintenance District, Mayor Hughes declared the public hearing open. The City Clerk reported that notice had been duly published. City Manager McDuffie presented the staff recommendation to adopt the proposed resolutions. There being no response to the Mayor's call for public testimony he declared the hearing closed. Resolution No. 87 -33 confirming the diagram and assessment in connection with Landscaping and Open Space Maintenance District No. 2 was presented by 708CP /MIN18.1 -5- June 2 1987 title and adopted on motion of Councilman Hinchliffe, seconded by Councilman McTaggart and carried. Resolution No. 87 -34 approving the the engineer's report (Landscape and Open Space Maintenance District No. 2) was presented by title and adopted on motion of Councilman Ryan, seconded by Councilwoman Bacharach and carried. POSTING OF STOP SIGNS AT City Manager McDuffie presented the TEE INTERSECTIONS staff recommendation that the (1502) Traffic Committee be allowed to recommend the posting of an optional stop sign at Tee intersections. He went on to explain that the Traffic Committee often receives requests to install stop signs on the leg approach to a Tee intersection. These requests are normally denied because the Vehicle Code establishes right -of -way at a Tee intersection and thus a stop sign is optional. Director Wentz explained that in the past it has been the City Council's policy not to install unnecessary or optional signs. The installation of stop signs at this type of intersection is not necessary but it is often justifiable based on field conditions. The Traffic Committee would like the ability to review these requests on a case -by -case basis and to recommend installation where they consider them justified. Council then queried staff on the possibility of additional liability because of placing signs where the warrants don't necessitate such a stop sign, if the resolution for such additional signs would still come to the City Council for adoption, and the anticipated location of such signs. Council commented that perhaps there should be a history on the traffic situation at the intersections being considered for optional signs, the 708CP /MIN18.1 -6- ,Tune 2 1987 fact that stop signs can sometime create a false sense of security, and that this policy would give the Traffic Committee the opportunity to con- sider these requests before coming to the City Council. Councilman Hinchliffe moved, seconded by Councilman Ryan to adopt the staff recommen- dation. The motion carried on a 4 -1 vote with Councilman McTaggert voting in opposition. CITY COUNCIL REPORTS: Agreement Between the City and the Post Office Regarding Zip Code (601) - Mayor Hughes referred to a letter prepared by the Post Office to go out over his signature and the Postmaster from Lomita. This letter would explain to residents in the Eastview area that zip codes 90732 and 90717 are now considered the official zip codes of Rancho Palos Verdes. Apparently the Post Office has changed their computer tapes and mail with those zip codes should no longer experience a delay in delivery. Since the Council members had not seen this letter, it was concluded that the letter should be put in the City Council's mail for weekend delivery. Councilwoman Bacharach moved, seconded by Councilman McTaggert and carried to approve in concept this letter to the residents in the Eastview area. SB151- Consolidation of SCAQMD (306) - Councilman McTaggert explained some of the amendments to this bill, in particular, the changes to represen- tation by local officials and the emission fees to be charged. He requested that this matter be placed on the next agenda when the new bill will be available for Council review. It was the consensus that Councilman McTaggert will work with the staff and see if this should be brought back to Council. 708CP /MIN18.1 -7- June 2, 1987 Tax Election (1501) - Councilman Ryan presented his proposal for a parcel tax election. This proposal contained the tax to be charged single - family residential parcels, buildable acres of property zoned for single- family residential units, land zoned or developed as commercial and parcel with multi- family units. He proposed that this become effective December 1988 and allow the utility tax to expire on July 1, 1988. The parcel tax would be reduced on a pro -rata dollar- for - dollar basis as transient occupany tax growth occurred or if a change in the distribution of sales tax for general fund purposes occurred. He proposed alternate election date as the June primary 1986 and the November presidential election 1988. Rather than be dependent upon development for financing, he recommended that the Council consider such a parcel tax. Discussion then centered on the role that the Fact Committee should play in instituting this parcel tax and assessing the existing needs of the city. Councilwoman Bacharach moved, seconded by Councilman Hinchliffe and carried to refer this item to the Fact Committee and that staff be directed to prepare the legal, public works and fiscal information on a parcel tax for a meeting to be held on June 30. The discussion then centered on the Fact Committee providing the reasons for or against such a tax, and determine whether or not the tax could go up or down based upon the pro -rata occupancy tax. Sidewalk Policy (1405) - Councilman McTaggert commented on the Sidewalk Repair Program that had taken place in his neighborhood and cited the case of a handicapped resident who was facilitated by city staff in getting the necessary access during the sidewalk repair. He requested that staff con- sider adding to the letter sent to residents a sentence which would inquire about any handicap requirements. 708CP /MIN18.1 -8- June 2, 1987 Aid in Construction (306X901) - With a four -fifth approval of the Council, Councilman Ryan requested that the agenda be re- opened for consideration of aid in construction legislation. He reported that he has been requested by the League to attend a meeting to discuss the gross up on tax on undergrounding. This meeting is to be held in San Francisco on June 11. He requested Council's approval to state the City's position and to meet with the staff to gather more data stating that position. It was the con- sensus of Council to grant this approval.
