CC MINS 19880216M I N U T E S RANCHO PALOS VERDES CITY COUNCIL REGULAR MEETING FEBRUARY 16, 1988 The meeting was called to order at 7 :30 P.M. by Mayor Robert E. Ryan at Hesse Park Community Center, 29301 Hawthorne Boulevard. After the pledge of Allegiance to the flag, roll call was answered as follows: PRESENT: BACHARACH, McTAGGART, HUGHES, AND MAYOR RYAN LATE ARRIVAL:HINCHLIFFE (@ 7 :35 P.M.) Also present were City Manager Dennis McDuffie, City Attorney Steve Dorsey, Director of Environmental Services Robert Benard, City Clerk Jo Purcell, Public Works Director George Wentz and Finance Director Kevin Smith. WAIVER OF FULL READINGS OF Councilman Hughes moved, ORDINANCES & RESOLUTIONS seconded by Councilwoman Bacharach and carried to waive reading in full of all ordinances and resolutions adopted at the meeting with consent to the waiver of reading deemed to be given by all councilmembers after reading of the title, unless specific request was made at that time for the reading of such ordinance or resolution. APPROVAL OF AGENDA The agenda was approved can motion of Councilman Hi nchl i f f e , seconded by Councilman Hughes and carried. CONSENT CALENDAR The City Clerk announced that the award of the construction contract for Crest Road & Crenshaw Blvd. resurfacing project had been removed and would be discussed at the end of the meeting. Councilwoman Bacharach moved, seconded by Councilman McTaggart to approve the Consent Calendar as follows: MINUTES Approved the minutes of January 28 and February 2, 1988, TRACT MAP NO. 45667 Continued consideration of this Contract for EIR (1411) contract to March 1, 1988. SIDEWALK REPAIR PROGRAM FOR Awarded the contract to Raymor FISCAL YEAR 1987-88 Electric at a cost not to ex- (1404) ceed $77,000 (cost plus 10% contingency), RESOLUTION No. 88-7 REGISTER OF DEMANDS FROM WHICH THE SAME ARE TO BE PUBLIC HEARING GENERAL PLAN AMENDMENT NO. 16 (HAWTHORNE BOULEVARD AT GRANVIA ALTAMIRA) (701) ADOPTED RESOLUTION NO.88-7 - ALLOWING CERTAIN CLAIMS AND DEMANDS AND SPECIFYING FUNDS PAID. The City Manager presented the staff recommendation that this matter be continued until March lf 1988. Councilwoman Bacharach so moved seconded by Councilman Hughes and carried. CONDITIONAL USE PERMIT NO. The City Manager presented the 119 - PACTEL ANTENNA staff memorandum on this con- (1804) tinued Public Hearing. The major concern expressed during Council discussion was whether the proposed lease agreement protected the City's right to install its own communication equipment and if it was necessary to guarantee Pactel that such equipment would be non-interfering with their antenna. The City Attorney recommended that a clause be included to allow the City to install emergency equipment since it was feared that if Pactel could prove interference, the emergency equipment would have to be removed or adjusted. Considering the state of the technology of antenna equipment it was felt that the likelihood of such interference was minimal. Continued concern was expressed about the preemption of City rights in light of Public Utility Commission authority. Representing Los Angeles Cellular was Jerome Buckmelter, 7531 Lubao Ave., Canoga Park, who stated his support for the Pactel Antenna but was also concerned about his company's inability to locate an antenna on this site. He was concerned that if the Pactel Antenna is reduced to 80 feet his company will not be able to co-locate on it. He requested permission to bring equipment onto the City Hall site to test a 54 foot antenna. If the testing proved to be successful, it was his company's intention to request co-location on the Pactel Antenna. -2- FEB. 16, 1988 A brief council discussion ensued regarding the time constraints for approving this conditional use permit and the fact that L.A. Cellular had only two weeks to determine if their antenna would work on the proposed Pactel antenna. Councilman Hinchliffe moved seconded by Councilwoman Bacharach and carried to continue this matter until the March 1st meeting. I I TREES AND VIEW OBSTRUCTION The City Manager presented the February 16 staff memorandum and the supporting data on previous actions taken by the ,City with regard to trees. Speaking in support of removing the City trees were the following residents.- Warren Sweetnam, 7 Top Rail; Eugene Carver, 30032 Avenida Esplendidao Dr. Anthony George, 4104 Exultant Dr.; Walter Watson, 3938 Exultant Dr.; and Lyle Quatrochi, 4002 Exultant Dr. These residents expressed their continuing concern about the loss of views caused either by street trees and.or privately owned trees. Expressing concern about the removal of trees were Stuart Shaffer, 4105 Admirable Dr.; and Vincent Yen, 3931 Palos Verdes Drive South. These speakers questioned the wisdom in removing trees. Unrelated to the issue of view obstruction in the Seaview area, Roy Fulwider, 28219 Hazelridge inquired about a replacement for trees that had been removed in his neighbor- hood.. Citing the fact that these trees had been on City property-he requested a replacement tree. The consensus was that the Director of Public Works would meet with Mr. Fulwider to resolve this matter. RECESS At 90-44 P.M. the Mayor declared a recess. At 10 P.M. the meeting reconvened. AUDIENCE QUESTIONS* Responding to the Mayor's call for audience questions for items not on the agenda was Roy Fulwider, 28219 Hazelridge, who inquired about the City's adoption of an ordinance re- quiring dog owners to clear up after their dogs defecate on sidewalks. A brief discussion ensued regarding the enforceability of such an ordinance; it was the consensus that the City Attorney should look into the matter and give a copy of such an ordinance to the�City Council. MW3- Feb. 16, 1988 Also responding to audience questions was Sunshine, 6 Limetree, who inquired about the maintenance of Altamira Canyon and the damage to the trail as a result of development in that area. She inquired about plans for repairing the trail and the possibility of having the Horsemen's Association contribute to the maintenance of this Canyon trail. It was the consensus that the Director of Public Works would meet with her,to discuss the 'issue of maintenance. TREES AND VIEW OBSTRUCTION At this time discussion of trees and view obstruction re- sumed. It was the consensus that the issue of sidewalk and street maintenance would be separate from the issue of view blockage by private and City-owned trees. Concern was again expressed about the City's 'involvement in this neighborhood issue of trees. The suggestion was made that the tree sub- committee (Mayor Ryan and Councilman McTaggart) consider a street tree overlay district and devise guidelines for an arbitration panel to mediate the issue of view blockage by trees. It was the consensus that the sub-committee should come back with these guidelines for council consideration. Additionally, it was requested that the Planning Commission review the process and view determination procedure so this could be incorporated into the guidelines. CITY COUNCIL REPORTS: Report from the Landslide Sub-Committee - Closure Of (1404 x 1503) Palos Verdes Drive South. Councilman Hughes explained that the Landslide Sub - Committee (Hughes & McTaggart) had visited the site of the reconstruction of Palos Verdes Drive South. Staff recommended that the street be closed for a period of five days during that construction. of the major concern was the hazard presented by the grading that would be taking place which, in some places, would cause a difference in elevation of three to six feet. Beyond that, there would be a cost savings to the City because the construction could proceed more rapidly. Council discussion included concern about the number of cars that traverse the area, the inconvenience this will cause to those travelers, and whether it would be possible to have the area open during the peak hours but closed during off hours. Since this item had been added to the agenda at the meeting the City Attorney advised that it would be necessary for the Council to take a vote on whether or not action should be taken on the issue. Additionally he advised that no City Councilmember had a conflict in voting on this road closure issue. Councilman Hughes moved seconded by Councilman McTaggart and carried to take action on this item. -4- FEB. 16, 1988 Councilman Hughes moved seconded by Councilman McTaggart that staff and the City Attorney take the action necessary to notice the closing of Palos Verdes Dr. South for a period of one week during the construction of that road between Portuguese Point and Inspiration Point* A brief discussion continued on the hazard presented during the construction phase and about the required notification that will be necessary to warn residents of the closure. The Mayor requested that a letter be prepared for his signature to send to the homeowners Associations. The motion to close Palos Verdes Drive South carried on a 4-1 vote with Councilman Hinchliffe voting in opposition. CITY MANAGER REPORT. (501) Results of opinion Research Survey - Mr. Don Weddel summarized the results of the poll that had been taken in the City between January 22 - 29, which were detailed in a report from opinion Research. Some of the inquiries from the Council pertained to the responses received to the questions regarding implementation of a Utility Tax versus a Parcel Tax, the development of Marineland and the adjacent area, the effectiveness of the City Newsletter as a survey -instrument and the difference of opinion in the various regions of the City. Councilwoman Bacharach moved, seconded by Councilman Hughes and carried that staff prepare a ballot measure for the continuance of a five per cent utility tax and that the ordinance contain a sunset clause. Status of Council Directives - Council discussed the status of the Trails Network plan and it was concluded that the Trail Sub-Committee (Bacharach & Hughes) would meet to dis- cuss the issue of the Trails Committee. SB709-Low and No. Property Tax Bill - reported thaE —there would be a hearing February 24th and recommended that the resentative at that meeting. ITEMS REMOVED FROM THE CONSENT CALENDAR: City Manager McDuffie on this bill on City have a rep- AWARD OF CONSTRUCTION After clarification of the PROJE%^,..T - CREST ROAD AND medians to be installed on CRENSHAW BOULEVARD Crest and Crenshaw it was the (1404) consensus that the Director of Public Works should devise some beautification guidelines for City medians. Councilwoman Bacharach moved seconded by Councilman Hinchliffe to award the construction contract to Vernon Paving in an amount not � 5 - FEB. 16f 1988 to exceed $1,229,495.
