CC MINS 19871224 ADJ M I N U T E S RANCHO PALOS VERDES CITY COUNCIL AND RANCHO PALOS VERDES REDEVELOPMENT AGENCY ADJOURNED REGULAR MEETING December 24, 1987 The meeting was called to order at 9: 10 A.M. by Mayor Robert E. Ryan notice having been given with affidavit thereto on file. PRESENT: BACHARACH, McTAGGART, HUGHES and MAYOR RYAN ABSENT: HINCHLIFFE Also present were acting City Manager Kevin Smith, Environmental Services Director Robert Benard, Public Works Director George Wentz, City Clerk Jo Purcell, City Attorney Quinn Barrow. Councilwoman Bacharach moved, seconded by Councilman McTaggard to approve the agenda. The motion carried. Responding to Mayor Ryan's inquiry about the eligibility of his voting on this matter, the City Attorney stated that the persons voting on this coastal permit would have to be without conflict since the applicant is the Redevelopment Agency. At this point in the meeting Mayor Ryan handed over control of the meeting to Mayor Pro Tem Bacharach and left the room. COASTAL PERMIT NO, 41 APPEAL Environmental Services Director Robert Benard presented the staff memorandum of December 24, 1987 and the following recommendations: 1) Hold a hearing for the purpose of receiving public comments concerning the merits of the appeals. 2) Dismiss the appeals on the basis that the hearing officer's findings are sufficient and that no new significant information has been presented by the appeals -:that would,=af fec t the hearing :off icer's=findings. As outlined in the staff memorandum, Director Benard summarized the background on the hearing officer's decision to conditionally approve Coastal Permit No. 41 for Phase II of the Agency's landslide stabilization project, and the Planning Commission's review of the issues raised by the appellants in this matter. He then summarized the staff analysis, the Executive Director appeal, the Smolley appeal, the Clarke appeal, the Sargent letter of concern, and the alternatives that the City Council could consider in determining the merits of the appeals and/or dismissal of the appeals. - 1 - 709CP/ADJREG.1-3 December 24, 1987 in the Sargent letter of concern, the access to the beach from that area, and the grading and safety features necessary for implementation of that observation point. Mayor Pro Tem Bacharach declared the hearing open. Kay Bara, 1 Peppertree, questioned if the map mounted for audience viewing was the latest plan. Additionally, she questioned whether the street would be a two lane highway, and the effect that might have on the olive tree and wall in front of her residence. Also speaking on this matter was Richard Bara who inquired whether the observation point would be landscaped. There being no further response to the Mayor' s call for public testimony she declared the hearing closed. Councilman Hughes moved, seconded by Councilman McTaggart and carried to reaffirm the decision of the Planning Commission and dismiss the appeal. City Attorney Barrow announced that a closed session was being held to discuss potential litigation involving the City of Rancho Palos Verdes and did not involve any matters related to the Redevelopment Agency, Then City Council reconvened. Environmental Services Director Robert Benard announced that the Coastal Permit No. 41 decision of the City Council is appealable within 10 working days of the decision to the Coastal Commission. At 9:50 A.M. the City Council meeting adjourned to January 5, 1988 at 6:30 P.M, at City offices to interview committee and commission applicants. Thereafter, the Rancho Palos Verdes Redevelopment Agency meeting was called to order. PRESENT: BACHARACH, McTAGGART and HUGHES ABSENT: HINCHLIFFE and MAYOR RYAN The Agency then recessed to a closed session to discuss the matter of the Rancho Palos Verdes Redevelopment Agency vs Shahin, Los Angeles Superior Case No. C671302. 2 _ 709CP/ADJREG.1-3 December 24, 1987 At 9:58 A.M, the Agency reconvened and the Agency Attorney announced that no action had been taken during the closed session. Member Bacharach moved, seconded by Member McTaggart to approve the minutes of August 4, 1987.
