CC MINS 19871201M I N U T E S RANCHO PALOS VERDES CITY COUNCIL REGULAR MEETING December 1. 1987 The meeting was called to order at 7:30 P.M. by Mayor Melvin W. Hughes at the Hesse Park Community Center, 29 301 Hawthorne Boulevard. After the Pledge of Allegiance to the Flag, roll call was answered as follows: PRESENT: RYAN, BACHARACH, McTA.GGART, HINCHLIFFE AND MAYOR HUGHES ABSENT: NONE Also present were City Manager Dennis W. McDuf f ie , Steve Dorsey, Director of Environmental Services Robert Benard , City Clerk Jo Purcell, Public Works Director George Wentz, and Finance Director Kevin Smith, WAIVER OF FULL READING OF Councilwoman Bacharach moved , ORDINANCES & RESOLUTIONS seconded by Councilman Hinchliffe and carried to waive reading in full of all ordinances and resolution adopted at this meeting with consent to the waiver of reading deemed to be given by all Councilmembers after read- ing of the title, unless specific request was made at that time for the reading of such ordinance or resolution. CEREMONIAL MATTER Mayor Hughes presented a Ceremonial ( 304) Proclamation to Daphne Clarke for her service to the City in moni- toring the dewatering wells in the Abalone Cove landslide area. APPROVAL OF AGENDA The agenda as presented was approved on motion of Councilwoman Bacharach, seconded by Councilman Mc Taggart and carried. RESOLUTION NO. 87 -65 RESOLUTION NO. 87 -65 OF THE CITY RECITING THE FACTS COUNCIL OF THE CITY OF RANCHO PALOS OF THE GENERAL VE RDE S RECITING THE FACTS OF THE MUNICIPAL ELECTION GENERAL MUNICIPAL ELECTION HELD IN (5 01) THE CITY ON NOVEMBER 3 , 19871 DECLARING THE RESULTS, AND SUCH OTHER MATTERS AS PROVIDED BY LAW, was read by title and adopted on motion of Councilwoman Bacharach seconded by Councilman Ryan and carried, - 1 - 700CP /MIN1.1 -1.5 December 1, 1987 ADMINISTRATION OF OATH City Clerk Purcell administered the OF OFFICE Oath of Office to re- elected Councilmembers Hinchliffe, Hughes and Mc Taggart. SELECTION OF MAYOR Councilwoman Bacharach moved AND MAYOR PRO TEM seconded by Councilman Hinchliffe to ( 307) nominate Councilman Ryan for Mayor. The motion carried unanimously. Mayor Ryan moved, seconded by Councilman Hinchliffe to nominate Councilwoman Bacharach for Mayor Pro Tem. The motion carried unanimously. The City Council requested that the City Attorney report at the next meeting on the appointment of the Chairman and Vice- chairman at the next Redevelopment Agency meeting. RECESS AND RECONVENE At 8:15 P.M. the Mayor declared a recess. The meeting reconvened at 8:24 P.M. CEREMONIAL EVENT Mayor Ryan presented a ceremonial ( 304) proclamation to Mayor Hughes in appreciation of his tenure as Mayor from December 2, 1986 through December 1. 1987. The Council also presented Councilman Hughes with a memento of his term of office. CONSENT CALENDAR The Consent Calendar was approved as follows on motion of Councilwoman Bacharach, seconded by Councilman McTaggart. MINUTES Approved the minutes of October 6, and November 17, 19870 RESOLUTION N0. 87 -66 Adopted RESOLUTION. N0. 87 -66 COUNTY AID TO CITIES REQUESTING AN ALLOCATION AND (1404) PAYMENT OF FUNDS FOR THE MAINTENANCE OF SELECT SYSTEM STREETS. - 2 - 700CP /MIN1.1 - 1.5 December 1, 1987 ORDINANCE N0. 222 - RESTRICTING THE USE OF .LEAF BLOWERS (801) TRACT NO. 32322 - RELEASE ON TRUST DEPOSIT (1411) COASTAL SPECIFIC PLAN AMENDMENT N0. 4 ( 701) Waived further reading and adopted ORDINANCE NO. 222 - RESTRICTING THE USE OF LEAF BLOWERS WITHIN THE CITY BETWEEN 8:00 A.M. and 5:00 P.M. MONDAY THROUGH FRIDAY, 9:00 A.M. and 4:00 P . M . ON SATURDAY) AND PROHIBITING THEIR USE ON SUNDAY AND NATIONAL HOLIDAYS (This Ordinance was introduced at the November 17, 1987 meeting) . Accepted the drainage work on Lot 1 of this tract as complete and released the cash deposit faithful performance. Approved the request to resubmit by November 6. 1988 without requiring another initiation request. COMMITTEE & COMMISSION Set Tuesday, December 8, 1987 at APPLICANTS 6:00 P.M. as the date to interview (106) applicants. RESOLUTION N0, 87 -67 Adopted RESOLUTION N0. 87 -67 - ALLOWING CERTAIN CLAIM AND DEMANDS AND SPECIFYING FUNDS FROM WHICH THE SAME ARE TO BE PAID* The motion carried on the following roll call vote: AYES: BACHARACH, McTAGGART, HINCHLIFFE , HUGHES and MAYOR T RYAN NOES: NONE ABSENT: NONE PUBLIC HEARING: CONDITIONAL USE PERMIT #119 (1804 ) City Manager McDuffie presented the December 1st staff report and the recommendation to continue the public hearing until December 17, 1987. Environmental Services Director Benard reported on a con- versation that he had had with representatives from PacTel who requested that the matter be con- tinued until sometime in January. 3 - 700CP /MIN1.1 -1.5 December 1, 1987 Later in the meeting it was moved by Councilwoman Bacharach seconded by Councilman McTaggart to continue this matter until January 14th. The motion carried. CITY COUNCIL REPORTS: CITY STREET TREES Mayor Ryan presented the subcommit- tees (Ryan/McTaggart) proposed policy for City street trees that create a significant view impact. Explaining that this policy dealt strictly with view, he said that it would be superior to any other tree policy that currently exists, Council then inquired about the remaining time left on the current tree removal program, whether there would be an exclusion provision in the policy to accommodate areas such as Mirales to , how this would affect people who have already signed the agreement to keep their street trees, and whether meetings should be held in various areas of the City to determine if some residents want to be excluded from this policy. Later in the meeting it was the consensus to hold a meeting at Ladera Linda on January 28, 1988 at 7:30 P.M. to discuss the issue of trees blocking views. Staff was directed to notify the residents in that area of the sub- ject of the meeting, REFUND OF PLANNING FEES Mayor Ryan moved, seconded by (1203 x1804) Councilman Hinchliffe to refund $136 in planning fees to Mr. Heikes, the appellant in the General Telephone CUP matter. The motion carried on the following roll call vote: AYES: BACHARACH, MCTAGGART, HINCHLIFFE , HUGHES, and MAYOR RYAN NOES: NONE APPOINTMENT TO S . C .A.Q .M.D . Citing the fact that Tom Heinsheimer BOARD would be a nominee for appointment to this board as well as another candidate from the City of Los Angeles, Councilman McTaggart requested Council support for his nomination to this board in the event of a deadlock between these two candidates. It was the consensus of Council that in such an event that at the delegate's discretion the support would go to Councilman McTaggart, - 4 - 700CP /MIN.1 -1.5 December 1 1987 AUDIENCE QUESTIONS CITY MANAGER REPORTS: Responding to the Mayor's call for audience questions for items not on the agenda was Joseph McLaren, 3923 Palos Verdes Drive South, who requested that Council support the position of keeping open Mirales to High School. City Council Meetings for December and January - City Manager McDuffie pre- sented his recommendations to the Council for a schedule of meetings for the months of December 1987 and January 1988. After discussion, it was the consensus to hold meetings on the following dates: December 17, 1987 at 7:30 P.M. at Hesse Park. December 24, 1987 at 9:00 A.M. at Hesse Park to discuss the issue of the coastal permit, January 12, 1988 at 7:30 P.M. at Hesse Park to discuss the tax issue, January 14, 1988 at 7:30 P.M. at Hes s es Park - a Regular Meeting, and January 28, 1988 at 7:30 P.M. at Ladera Linda to discuss the issue of trees and any other item of business. RECESS TO CLOSED SESSSION At 9:44 P.M. the City Council adjourned to a closed session to discuss the status of negotiations with the Palos Verdes Unified School District for the Portuguese Bend property and to discuss personnel matters. Motion was made by Councilman Mc Taggart. At 11:15 P.M. the meeting reconvened with no action taken and immediately adjourned to 6:00 P.M. on Tuesday, December 8. 1987 at City Offices to interview candidates for Commission and Committee appointments.
