REGULAR MEETING
October 20, 1987
The meeting was called to order at 7:30 P.M, by Mayor Melvin W. Hughes at
Hesse Park Community Center, 29301 Hawthorne Blvd. After the Pledge of
Allegiance to the flag, roll call was answered as follows:
PRESENT: RYAN , BACHARACH , HINCHLIFFE , Mc TAGGART and MAYOR HUGHES
ABSENT: NONE
Also present were -City` Manager Dennis McDuf f ie , City Attorney Steve Dorsey,
Director of Environmental Services Robert Benard , City Clerk Jo Purcell,
Public Works Director George Wentz, and Finance Director Kevin Smith.
WAIVER OF FULL READINGS OF Councilwoman Bacharach moved,
ORDINANCES & RESOLUTIONS - seconded by Councilman Ryan and
carried to waive reading in full of
all ordinances and resolutions
adopted at this meeting with consent to the waiver of reading deemed to be
given by all councilmembers after reading of the title, unless specific
request was made at that time for the reading of such ordinance or resolu-
tion.
APPROVAL OF AGENDA The City Clerk announced the addition
of discussion of school closures

Manager on the renovation of the
Green Building. The agenda as
amended was approved on motion of

CONSENT CALENDAR The City Clerk announced that item

SPECIFIC PLAN NO. IV - 29019 City Manager McDuffie presented the
- 29421 WESTERN AVENUE ( 701) staff report of October and the
recommendation to approve a final
Negative Declaration, for
Environmental Assessment No 523, and introduce the Ordinance approving
Specific Plan No. IV after taking public testimony and reviewing the Plan.
Mayor Hughes opened the public hearing on this specific Plan which would
address the individual needs of the commercial area along Western Avenue,
The City Clerk announced that notice of hearing was published and that no
written comments were received by the City.
Council then discussed the proposed underground parking feature of this Plan,
the sign incentive program and if it gave unfair advantage over other
shopping centers in the City, and the mechanism for dealing with signs that
have a base within the City of Los Angeles but occupied air space in our
City.
There being no response to the Mayor's call for public testimony, Councilman
Hinchliffe moved, seconded by Councilman Councilman Mc Taggart and carried to
close the public hearing.
Councilman Hinchliffe moved, seconded by Councilman Mc Taggart to adopt the
staff recommendation and introduce Ordinance No. 219 APPROVING A FINAL
NEGATIVE DECLARATION FOR ENVIRONMENTAL ASSESSMENT NO. 523 AND APPROVING
SPECIFIC PLAN IV.

The City Manager presented the staff
memorandum and recommendation to
continue the public hearing until
November 17, 1987. Councilwoman
Bacharach moved, seconded by
Councilman Ryan and carried to
instead continue the public hearing
to December 1. 1988, because of the
crowded November 17, agenda.
TRAIL NETWORK PLAN AMENDMENT The City Manager presented the staff
N0. 1 ( 701) memorandum and the recommendation to
approve the final Negative
Declaration for Environmental
Assessment No. 534 and approve the
proposed Trails Network Plan Amendment to identify a pedestrian trail link
between Rancho Palos Verdes and Palos Verdes Estates through Lot No. 1,
Tract No. 29524 at 7061 Crest Road,
Responding to the Mayor's call for public testimony on this item were the
following residents: Loren DeGroot, 7051 Crest Road; Harry Brown, 7131

Avenida Altisima; Bill, and Lee Demucci, 7031 Crest Road; and Jacob Yriyend,
7071 Crest Road. Their concerns centered on the possible use of this ease-
ment by motorcycles, the possibility of vandalism, and loss of privacy.
Additionally, they questioned the prescriptive rights claimed for
establishing this easement.
Speaking in favor of this trail was Sunshine, 6 .Lime tree . Council then com-
mented on and inquired about whether this trail could be designed to prevent
use by motor driven vehicles; if it had handicap access; the status of this
matter with the City of Palos Verdes Estates; and, how recent Supreme Court
decisions regarding land use affected this easement which the City sought to
obtain through the prescriptive easement process. After additional
discussion of the status of this trail should Palos Verdes Estates decide
not to continue it on into that City, it was the City Attorney's opinion in
that event, the easement would be abandoned by the City. There being no
response to the Mayor's call for additional public testimony, Councilman
Hinchliffe moved, seconded by Councilwoman Bacharach and carried to close
the public hearing.
Councilwoman Bacharach moved, seconded by Councilman Ryan to approve the
staff recommendation. The motion carried on a three -two vote with
Councilmembers Mc Taggart and Hinchliffe. voting in opposition.
RECESS AND RECONVENE: At 9:00 P.M. the mayor declared a
recess. At 9:15 P.M. the meeting
reconvened.
AUDIENCE QUESTIONS: Responding to the Mayor's call for
items not on the agenda was David

GENERAL PLAN AMENDMENT N0, 16 The City Manager presented the staff
ZONE CHANGE N0. 15 (1802) memorandum and the recommendation to

on the General Plan amendment and zone change and continue the public
hearing to January 5, 1988.
The Mayor opened the public hearing on this request for a general plan
amendment and zone change process to study whether the current residential
land use designations on the site should be changed from residential to
commercial. The City Clerk reported that notice had been duly published.
There being no response to the Mayor's call for public testimony, he
declared the hearing closed.

After a brief discussion of the CL zoning designation and the agreement bet-
ween the City and the developer to accommodate that zoning, Councilman
Hinchliffe moved, seconded by Councilman Mc Taggart to adopt the staff
recommendation.

In light of the hazardous conditions existing at this location, it was the
consensus of Council that it was inappropriate to continue this item much
longer. Councilwoman Bacharach moved, seconded by Councilman Mc Taggart to
continue this matter to November 4, 1987. The motion carried on a four -one
vote with Councilman Ryan voting in opos i tion . It was the consensus that
even though this continuation was being granted, Mr. Roth was to be notified
that the hazard must be abated by November 8, 1987. The motion carried on a
four-one vote with Councilman Ryan voting in opposition.
GRADING APPLICATION NO, 896

Speaking in opposition to the appeal were: William Jackson, 7405 Via
Lorado, and Gordon Stoute, 7393 Via Larado. They felt the roof should be
lowered to bring the house into conformance with the Code.
The applicant, John Stefan, 1821 Harriman Lane, Redondo Beach, requested
that Council allow the slab to be raised instead of lowering the roof. He
cited the expense involved in such a remedy and said that with the
approaching rainy season, it would also be the fastest method. Speaking on
Mr. Stefan' s behalf was his attorney, Stan Denis, 707 Torrance Blvd., who
said that if the slab is raised, the house will be in compliance with the
Code and that actually the house is 22 feet below the code maximum. If the
roof is lowered, they will not be able to use the red tile and it will also
destroy the architectural lines of the house.
Councilman Hinchliffe's motion to deny the appeal died for lack of a second.
Council discussion continued regarding the alternatives available for
solving this matter.
Councilman Ryan moved, seconded by Bacharach to grant the appeal with the
provision that the trees and shrubs planted on the property be restricted

to the height of the ridgeline of the house and that the landscaping plan
must be submitted to the City for approval. The motion carried on a four -
one vote with Councilman Hinchliffe voting in opposition.
ENCROACHMENT PERMIT NO. 5 - APPEAL: The City Manager presented the staff

SCHOOL CLOSURES (1401) Councilman Ryan expressed his concern
regarding the proposed closure of
Miraleste High School and the impact
it would have on traffic. A discussion then followed regarding possible
alternatives to this traffic situation such as the reopening of Margate and
opening the Rollings Hills gate to accommodate school busses.
Councilwoman Bacharach moved, seconded by Councilman McTaggart and carried
to consider this item an emergency issue and to place it on the agenda for
action.
Councilwoman Bacharach moved, seconded by Councilman McTaggart to direct the
City Manager to communicate to the School Superintendent that the Council
has not taken a position on school closure but are concerned about the
resultant traffic problems and want the District to consider some options
such as opening the Rolling Hills Crest Road gates and reopening of
Margate. The motion carried.

POINT VICENTE - DOCENT After clarification of this discount
MERCHANDISE DISCOUNT (1202) program, Councilman Ryan moved,
seconded by Councilman Hinchliffe and
carried approve the staff recommendation of a discount program for docents
at the Point Vicente Gift Shop, however, the 20 percent discount would be
available immediately upon completion of the training program.
