CC MINS 19870930 ADJM I N U T E S RANCHO PALOS VE RDE S CITY COUNCIL ADJOURNED _REGULAR MEETING September 30, 1987 The meeting was called to order at 7:30 p.m. by Mayor Hughes, at Fred Hesse .Community Park, 29301 Hawthorne Boulevard, notice having been given with affidavit thereto on file. PRESENT: BACHARACH, RYAN, McTAGGART, HINCHLIFFE, AND MAYOR HUGHES Also present were City Manager Dennis McDuf f ie Public Works Director George Wentz, Finance Director Kevin N. Smith, Environmental Services Director Robert Benard, and Acting City Attorney Quinn M. Barrow, APPROVAL OF AGENDA City Manager McDuff ie requested the addition of a brief Closed Session at the beginning of the agenda for the purpose of conducting a discussion on negotiations between the Redevelopment Agency and the owners of property in the landslide area. Councilman Hinchliffe moved, seconded by Councilwoman Bacharach, and, with no objection, so ordered, to approve the order of the agenda with the addi- tion of a Closed Session, WAIVER OF FULL READINGS OF Councilman Hinchliffe moved, seconded ORDINANCES & RESOLUTIONS by Mayor Pro Tem Ryan, and , with no objection, so ordered, to waive the full reading of all ordinances and resolutions considered at tonight's meeting. CHANGE TO AGENDA Councilman Hinchliffe moved, seconded by Councilman McTaggart, and, with no objection, so ordered, to postpone to the meeting of November 4. 1987, agenda item B.2 * -- a hearing regarding the necessity for acquisition of fee simple interest in certain property located within the Redevelopment Project Area for Palos Verdes Drive South. 710CP /CCARM: - 1 ADJOURN TO REDEVELOPMENT The Council immediately adjourned to AGENCY CLOSED SESSION a Redevelopment Agency Closed Session & RECONVENE TO COUNCIL MTG, on motion of Councilman McTaggart. At 11:30 PM the City Council reconvened on motion of Councilwoman Bacharach, seconded by Councilman McTaggart and carried. ORDINANCE/ RESOLUTION ESTABLISHMENT OF RELOCATION City Manager McDuf f ie said applicable APPEALS BOARD law requires that the City establish a Relocation Appeals Board to which any persons displaced by acquisition of real property in connection with City or Redevelopment Agency projects may appeal determinations by City or Agency staff. Staff recommended introduction of the subject ordinance. Mayor Hughes said the procedure for member selection should be consistent with already established practices of the City -- the same type of terms and duration, appointment by City Council, not Mayor, etc. Councilwoman Bacharach expressed concern about the following ordinance sec- tions: Limitation on Appeals (page 4) -- specifically the 6 and 18 month time limits for filing a claim; and Hearing (page S) -- specifically the 90 day time limit for setting a hearing. She felt they were too long. With regard to the 6 and 18 month time limits for filing a claim, Acting City Attorney Barrow said there is a lot of documentation that takes place and it often takes that long for people to realize the impact of relocation. He said the 90 -day limit for setting a hearing could be shortened. Councilwoman Bacharach moved, seconded by Councilman Hinchliffe, and, with no objections, so ordered, to waive further reading and introduce by title only the ordinance entitled "AN ORDINANCE OF THE CITY OF RANCHO PALOS VERDES ESTABLISHING A RELOCATION APPEALS BOARD AND AMENDING THE RANCHO PALOS VERDES MUNICIPAL CODE" , with the following amendments : 1. That the selection of board members and chairperson be consistent with the City's current practices; 2. That the terms of board members be consistent with the City's current practices; 3. That the selection of board members be made by Council, and not just the Mayor; 710CP /CCARM:. - 2 - 4. That the hearing before the board be scheduled no later than 45 ( change from 90) days after receipt of a request for review; and 5. That the ordinance section discussing quorum be changed to make it more understandable.
