Hughes at Hesse Park Community Center, 29301 Hawthorne Blvd. After the Pledge g of Allegiance to the flag, roll call was answered as follows: PRESENT: RYAN, BACHARACH, HINCHLIFFE , and MAYOR HUGHES ABSENT: Mc TAGGART Also present were City Manager-Dennis McDuffie, City Attorney Steve e Dorsey, Director of Environmental Services Robert Benard City lerk Public Works Director George Wentz and y Jo Purcell, g , Finance Director Kevin Smith, WAIVER OF FULL READINGS OF Councilwoman Bacharach moved ORDINANCES & RESOLUTIONS ' seconded by Councilman Ryan and carried to waive reading in full of all ordinances and resolutions adopted at this meeting with consent to the waiver of reading eem given by all councilmembers after r g ed to be reading of the title, unless specific request was made at that time for the reading of such ordinance or resolu- tion. APPROVAL OF AGENDA The City Clerk announced that the City Attorney had requested a closed session held at the end of the meeting. The agenda as amended was approved on motion of Councilman Hinchliffe, seconded by Councilwoman Bacharach and carried, CONSENT CALENDAR The Mayor announced that a request had been made to remove the item regarding Hesse Park, from the Consent Calendar, and would be 709CP /MINCC9.15 -1- September 15 , 1987 discussed at the end of the meeting. The Consent Calendar was approved as follows on motion of Councilman Hinchliffe, seconded by Councilwoman Bacharach, MINUTES ORDINANCE N0. 218 - PURCHASING SYSTEM ( 602) APPOINTMENT OF MEMBERS TO THE MIRALESTE AND RIDGECREST RECREATION AND PARK DISTRICTS (106 X 1201) CLAIM AGAINST THE CITY BY SHAY PHILLIPS (303) RESOL. N0, 87 -54 REGISTER OF DEMANDS Approved the minutes of August 103 and September 1, 1987. WAIVED FURTHER READING AND ADOPTED ORDINANCE NO 218 OF THE CITY OF RANCHO PALOS VERDES ESTABLISHING A PURCHASING SYSTEM AND AMENDING THE RANCHO PALOS VERDES MUNICIPAL CODE, 1) Reappointed Thomas Stolpman, John Vilicich, and Robert Hansen to the Miraleste Recreation & Park District. 2) Reappointed Endsley H. Colette, Jr, and E. Wayne Fager to the Ridgecrest Recreation and Park District. All appointments to serve a four -year term until November 1991. Rejected the claim of Shay Phillips and directed the City Clerk to notify the claimant. ADOPTED RESOL, NO. 87 -54, ALLOWING CLAIMS AND DEMANDS AND SPECIFYING FUNDS FROM WHICH THE SAME ARE TO BE PAID, PUBLIC HEARING GTE BUILDING (1804) Councilwoman Bacharach moved, seconded by Councilman Hinchliffe and carried to continue the public hearing on this item to October 8th. 709CP /MINCC9.15 -2- September 15, 1987 LEAF BLOWERS The City Manager presented the (1801) Sept. 15th staff memorandum and the recommendation that Council take public testimony and direct staff to prepare an appropriate ordinance for the second meeting in October. Speaking against a ban on leaf blowers were the following persons: Oliver Peacock, 920 East Fallbrook St., Fallbrook, CA, who represented Golden Eagle Distributing & Echo Inc., manufacturers of leaf blowers and other gardening equipment. He related his company's efforts to reduce the noise level of leaf blowers and how they have started a campaign to educate the users of the product. Margaret Costello, 41 Rockinghorse Rd., cited the fact that she has a big lot and gardening will become more expensive if her gardener is prohibited from using these leaf blowers, Speaking in favor of the ban on leaf blowers were the following people: Elizabeth Kramer, 610 Crest Rd., who objected to the noise mostly, and secondly to the air pollution. Ann Richardson, 30823 Cartier Drive, stated her objections to leaf blowers because of the pollution factor. R.E. Morris, 29404 Seaspray, objected to them on the basis of noise. Council discussion then followed on the options that were available on the enforcement of a ban on leaf blowers, whether the use of a mister could be mandated, if enforcement would be done by the sheriff or by the staff, could a gardener's business license be revoked if he continued to use leaf blowers, and the charge that could be lodged for a violation of the ordinance. The discussion then centered on whether staff was empowered to issue violations and it was the consensus that the City Attorney should research the matter of empowering staff to issue violations. Councilman Ryan moved, seconded by Councilman Hinchliffe and carried that this item be moved to the first meeting in October and that staff should prepare an appropriate ordinance and continue to receive public input. CONDITIONAL USE PERMIT N0, 119 City Manager McDuffie presented the APPEAL PACTEL ANTENNAE (1804) staff memorandum of September 15th and the recommendation to receive public testimony and approve the appeal, thereby approving Conditional Use Permit No. 119 and final negative declaration for a commercial antenna tower for (Pactel) at City Hall. He went on to summarize the history on this matter which had been heard by the Planning Commission on August 25, and voted 2 -2 on a motion to approve the application for this mobile cellular telephone commercial antenna tower. According to the applicant, the City Hall site provides maximum coverage of the coastal area of the peninsula with the least interference to other cellular telephone antennae. Speaking against the installation of the antenna at City Hall were the following persons: Franklin Weiss, 30711 Via La Cresta, who questioned the 709CP /MINCC9.15 -3- September 15, 1987 number of people who would benefit from this installation and whether another location could be found. Ann Richardson, 30823 Cartier Drive, opposed to it being on City property. Martin Cohen who said he would be moving to La Cresta was opposed to it based on aesthetics. Colleen Danache, objected to its appearance. Representing Pactel was Bill North, Director of Engineering. He told the Council that the telephones are used by a variety of people and are used a good deal in emergency situations. He said his company has arrangements with other public agencies for placement of their antennae on publicly -owned property. He went on to described the appearance of the antenna, stating that it was self- supporting and would have the appearance of a light pole. Responding to Council's inquiry about the location of the antenna and if other sites had been considered, Mr. North explained that the proposed loca- tion had the best line of sight. I f , however, it was found that the antenna could be lowered to 85 ft., the height could be reduced. Discussion then centered on the terms of the agreement between Pactel and the City for rental of the space and concern was expressed that since the Civic Center site will be developed within the next few years, Pactel may have to move or remove the antenna. Additional discussion then took place on the location of the antenna and the suggestion that perhaps it could be moved 50 ft. and lowered. Discussion then centered on whether the appeal could be granted at this time with the direction to staff that the location, the height and some of the conditions of the Agreement be reviewed. Councilman Hinchliffe moved, seconded by Councilwoman Bacharach to continue this item to the October 20th meeting. The motion carried unanimously. It was the consensus that the staff should look at some other location keeping in mind Pactel's con- cern for line of sight and also, the issue of view obstruction. TRANSIT ADVISORY COMMITTEE REPORT - The City Manager presented the TRANSIT FARE POLICY (1505 ) memorandum of September 15, and the Committee's recommendation that Council approve a revised fare policy. Representing the Committee was Luddy Zelt who described some of the dif- ficulties the drivers of the Palos Verdes Transit vans encounter in collecting fares. The Committee at its August 26th meeting voted to recom- mend a change in the fare policy commencing January 1, 1988, and to empha- size the financial incentive to purchase tickets. The rational to encourage all riders to purchase PV Transit ticket books which will be available at City Halls or through the mail and would cost $15 for 30, 500 tickets or $60 for 40 $1.50 tickets. Transit Administrator Sandra Learman also summarized some of the discussion that took place at the Committee meeting. She suggested that there might be 709CP /MINCC9.15 -4- September 15, 1987 some compromise made with the Committee members if the matter was to be taken up and discussed at another meeting. Councilwoman Bacharach moved, seconded by Councilman Hinchliffe and carried, to recommend that the Transit Advisory Committee look into this issue again. On another transit - related issue, Councilwoman Bacharach reported on the progress made by the cities involved in the commuter transit implementation plan in putting together a commuter transit service in the South Bay area. She described the presentation of the newly -hired consultant to conduct a study of implementatiog a plan for commuter service. RECESS At 9:50 the Mayor declared a recess. At 10:00 P.M. the meeting reconvened. AUDIENCE QUESTIONS Responding to the Mayor's call for audience questions for items not on the agenda was Jeannie Smol ley , 56 Limetree Lane, who inquired about the cost of maintenance of Palos Verdes Drive South as alluded to in a recent NEWSLETTER article. Finance Director Smith responded that the cost of such main- tenance at approximately $250,000 a year. Responding to Ms. Smolley's additional questions regarding personnel working on Palos Verdes Drive South, Director Wentz said that they were surveying for the Redevelopment Agency for the proposed grading project and the relocation of Palos Verdes Drive South in Phase Two of the RDA's Plan. Also responding was Robert Gibson, 26727 Basswood who related the cir- cumstances surrounding the dumping of asphalt in the Malaga Canyon area. It was the consensus that staff should meet with Mr. Gibson and visit the site to determine how to remedy the situation. SHORELINE COMMUNITY DEVELOPMENT, INC . Pitchford regard - Park. Concern was expressed that this the project. Recycle Center - Councilman Ryan briefed the Council on his visit to the Recycle Center in EL CE RRITO. He described the efforts made by that City in recycling aluminum and glass and the revenue generated. After discussion of a pilot route for such recycling efforts, it was the consensus that the Refuse Sub- Committee should work out some kind of a pilot program and include such a specification in the forthcoming RFP for trash haulers. 709CP /MINCC9.15 -5- September 15, 1987 Fines and Forfeitures - Alluding to the reduction in revenue from fines and forfeitures, Councilman Ryan inquired if there was need for an additional sheriff's traffic enforcement car in the City and that such a car could be paid for by the increase in citations issued. The City Manager reported that he was conducting an analysis of the reduction and would report back to the Council on the matter. Also discussed was that fact that the Cities of Redondo and Manhattan Beach are also investigating their reduction in such revenue. In another police related matter, a brief discussion ensued about the possi- bility of adoption of an ordinance to police parties that are conducted to attract a large number of people and at which alcohol is available to minors. CITY MANAGER REPORTS Legislative update - This memo contained an update on SB 709 ( County Trial Court Funding Bill) - which tranfers the cost of operating courts from the County to the State. SB 407 and AB 339 (no/low-property tax legislation). From this bill, the City would receive a 2(,% tax rate and would not receive any additional property tax money until the third year after adoption. Next year an amendment will be presented that will phase out City subventions as the City reaches the amount of property tax allocation. The date of implementation is July 1, 1988 and the funding would not begin until the 1988 -89 State Fiscal Year. AB 1586 and AB 18. These bills are on the governor's desk for signing. School Closures and Consolidation - The City Manager referred to the Sept. 2 letter from Jack Price, Superintendent from the Palos Verdes Unified School District. That report presented several options that the School District is considering for closure and consolidation of schools throughout the Peninsula. Council then proceeded to discuss the traffic implications in such options and a discussion followed on the increase of traffic around the high schools, in particular, Rolling Hills High School and Palos Verdes High School. It was the consensus that staff should prepare an analysis of the traffic patterns and the traffic count at these school sites that would experiencing a change in school population. ITEMS REMOVED FROM THE CONSENT CALENDAR HESSE PARK AWARD OF CONTRACT FOR ROOF IMPROVEMENTS (1201) Councilwoman Bacharach moved, seconded by Councilman Ryan to award the contract to Raycrest Roofing for an amount not to exceed $48,442.00 709CP /MINCC9.15 -6- September 15, 1987 for improvements to the roof of the Hesse Park Building.
