ADJOURNED REGULAR MEETING
DECEMBER 22, 1989
The meeting was called to order at 6:45 A.M. by Mayor Melvin
W. Hughes at City Hall offices, 30940 Hawthorne Boulevard.
Notice having been given with affidavit thereto on file.

ABSENT: BACHARACH
Also present were City Manager Dennis McDuff ie, City Clerk Jo
Purcell, Public Works Director George Wentz, Building and
Safety Inspector David Baird, Environmental Services Director
Robert E. Benard, and City Attorney Ariel Pierre Calonne.
ORDINANCE NO. 249U- The City Manager presented the
AMENDING THE BUILDING December 22, 1989 revised staff
CODES- ADOPTION OF REVISED report which indicated that
BUILDING CODES (201) there were very few substantive
changes to the existing
package of codes being
proposed.
Building Inspector David Baird defined the changes that had
been made: regulation of construction in geological hazardous
areas; incorporation of geology and soils requirements that
permit more discretion and allows for minor yard improvements
such as spas, decks and trellis to be placed in areas subject
to geologic hazard. This proposed code also grants a greater
measure of discretion in the requirement of geology and soils
reports; mandatory erosion control measures.have been
incorporated as well as previously adopted City amendments.
Smoke detectors are now required to be placed closer to
bedroom doors; landslide moratorium provisions have been made
compatible with the landslide moratorium codes and are
specific to a certain area of the City. He explained that
specific provisions of the code always override general
provisions. He further stated that the moratorium provisions
remain largely unchanged except in two particular instances:
(1) modification to allow for greater discretion on the part
of the City's geology staff in requiring geology and soils
reports; and, ( 2 ) the requirement for a list of specific
landslide mitigation measures.
Council discussion then focused on the reason for adopting
the Uniform Building Code as is, and .the requirements of the
State Code versus the County of Los Angeles Code. In
particular the discussion focused on Section 311 (Geological
and Geotechnical Reports) and specifically the restrictive or
liberal interpretation of requirements for geological and
geoltechnical reports. It was the consensus that the section
be changed to add: that the Building Official may require a
geological or geotechnical report, or both, when there is
evidence of geologic instability on the property or "
neighboring property.
Councilman Ryan moved, seconded by Councilman Hinchliffe to
waive further reading and adopt as amended ORDINANCE NO. 249U
-AN URGENCY ORDINANCE OF THE CITY OF RANCHO PALOS VERDES
ADOPTING BY REFERENCE THE UNIFORM BUILDING CODE, UNIFORM
MECHANICAL CODE, UNIFORM PLUMBING CODE, UNIFORM HOUSING CODE,
1988 ADDITIONS, AND NATIONAL ELECTRICAL CODE, 1987 ADDITION
AND MAKING AMENDMENTS TO SAID CODES AND AMENDING THE RANCHO
PALOS VERDES MUNICIPAL CODE. The motion carried on the
following roll call vote.
