CC MINS 19891031M I N U T E S RANCHO PALOS VERDES CITY COUNCIL MEETING REGULAR MEETING OCTOBER 31, 1989 . The regular business meeting was ca-lled to order at 7. 30 P.M. by Mayor Bacharach. The Pledge of Allegiance to the flag was then recited. Roll call was answered as follows: PRESENT: McTaggart, Hughes, Hinchliffe, Mayor Bacharach Also present were City Manager Dennis McDuffie, City Attorney Ariel Pierre Calonne, Director of Environmental Services Robert Benard, and Public Works Director George Wentz. APPROVAL OF AGENDA Councilman McTaggart moved, seconded by Councilman Hinchliffe to add the leaf blower issue to the agenda as Item E-5. Motion unanimously passed. CONSENT CALENDAR MINUTES MIRALESTE & RIDGECREST RECREATION & PARK DISTRICTS REAPPOINTMENT OF BOARD MEMBERS (1201) (2) Approved the appointment Pittlekow and Gwynne L. Shaw on the Ridgecrest Recreation will expire in November 1993 Councilman Hughes moved, seconded by Councilman McTaggart, to approve the Consent Calendar. Approved the minutes of October 3, 1989 (1) Approved the appointment of Michael Lawler and Cheryl Caughlin to a four year term of office on the Mira leste Recreation and Park District. of Victor E. Hansen, Dolores P. to a four year term of office & Park District. (All terms The motion to approve pprove the Consent Calendar carried on the following roll call vote, AYES.* McTAGGART, HUGHES, HINCHLIFFE AND MAYOR BACHARACH NOES: NONE RECREATION & PARKS COMMITTEE Mayor Bacharach reported that APPLICANTS (1201 X 106) eleven applications were received, and appointments can be made to this committee after interviewing the applicants. The City Clerk will be advised to send a letter to the applicants after November 8th, advising them of what seats are available, and asking if they wish to serve on any other committees. It was agreed that interviewing will be held on November 30, 1989 beginning at 6:00 P.M. DEVELOPMENT PROJECT Director of Environmental PRESCREENING PROCEDURES Services Robert Benard pre- (1203) sented the draft prescreening procedures for the Council's review and comment. He noted that the original procedures have been reviewed by staff and several minor changes and clarifications have been incorporated. City attorney Calonne added that the principal concern was to ensure a fair hearing as required by state law, and summarized the protections outlined in the draft which assure that fair hearing rights are not interfered with. Additionally, he pointed out that participation by the applicant is voluntary. Mr. Benard stated that the Council would be kept informed through pre-application meetings with the applicants and by a weekly status report. The procedure allows for review of any type of development project. Councilman Hinchliffe recommended allowing flexibility for unique situations. Mayor Bacharach suggesting handing out an explanation pamphlet for use by the public. She also recommended placing a six month time limit on this issue in order to determine whether the goals have been achieved. Councilman Hughes was concerned about those who would come to the meetings expecting to make testimony early on in the process, and he wanted that established in the policy guidelines. Councilman McTaggart was in favor of the draft, particularly if it would help in the educational process of the community. Staff was requested to begin work on a pamphlet for the public and to prepare a resolution incorporating the changes for the November 8, 1989 Council meeting. -2- Oct. 31, 1989 Councilman Hughes moved, seconded by Councilman McTaggart, to approve the draft Development Project Prescreening Procedures as amended. Motion unanimously passed. 0 CITY COUNCIL REPORTS. COUNCIL COMMITTEE ASSIGNMENTS Mayor Bacharach reviewed the committee assignments for the Council. CITY MANAGER REPORTS. GUIDELINES FOR AUDIENCE City Manager McDuffie reviewed QUESTIONS (307) the proposed policy, which established guidelines for the Audience Questions section of the City Council Agenda. City Attorney Calonne clarified the State law interpretation of this issue, which addresses the need to take action after the agenda has been posted, and then that such a determination had to be made by two-thirds of the Council. Councilman McTaggart stated that the three minute time limit for audience questions was too restrictive, and objected to reducing the five minutes. City Attorney Calonne advised that the Council could either shorten the amount of time on subsequent appearances or request that members of the audience with lengthy questions be placed at the end of the agenda. Councilman Hughes moved, seconded by Councilman Hinchliffe, to adopt the guidelines as presented. Motion unanimously passed. COUNCIL/MANAGER RETREAT City Manager McDuffie (1101) advised the Council on the necessity for setting a date and place for a City Council/City Manager retreat, and noted that there are several issues that need the attention of the City Council and that coordination and direction be given to the City Manager. Mr. McDuffie suggested soon as possible after difference between his recommended by the Coui CITY COUNCIL/PLANNING COMMISSION WORKSHOP SCHEDULE (1203) that the Council consider a retreat as the election, and reviewed the proposal and that which was roc il. City Manager Dennis McDuffie noted the necessity to es- tablish a schedule for City Council/ and/or City Council/ -3- Oct. 31, 1989 Planning Commission workshops for early project review. Mr. McDuffie stated that at least nine workshop sessions have been identified, and reviewed the projected development projects and applications which need to be scheduled for review during the period December 1989 through March 19909 DISASTER PREPAREDNESS City Manager McDuffie pre- (401) sented a status report on the City's disaster plan and stated that, after careful review, it was noted that modifications and improvements had to be made to the plan. Councilmembers held a brief discussion regarding the availability of disaster preparedness kits, and what cities are equipped with good kits. Dennis Luppens, Risk Manager, reviewed the communication material that had been selected to educate residents about disaster preparation. Mayor Bacharach recommended the appointment of a task force, with community input, to deal with disaster preparation, but she felt the City of Rancho Palos Verdes should start with its own plan before involving the other cities. She noted that she will contact organizations such as the Red Cross, Amateur Radio Club and chamber of Commerce and solicit their input. Councilman Hinchliffe added that he is acquainted with someone who would be willing to talk to the Council regarding the geology of the area and its vulnerability to earthquakes. Mr. McDuffie informed the Council.that Rancho Palos Verdes will be participating in the county-wide disaster drill which will be held on November 2, 1989. LEAF BLOWERS (801) City Manager McDuffie presented the procedures regarding the control of leaf blowers which are utilized by the City of Pasadena, and inquired whether a similar policy could be adopted in Rancho Palos Verdes. Director of Environmental Services Benard reported that he has spoken with several members of the Pasadena Health Department, who have informed him that leaf blowers represent an ongoing problem. In the ensuing discussion, Councilman McTaggart pointed out that the Pasadena approach does not address the dust that is created by leaf blowers. Councilman Hinchliffe moved, seconded by Councilman Hughes, -4- Oct.31, 1989 to receive and file the memorandum dated October 31, 1989 from the Director of Environmental Services regarding leaf blowers. Mayor Bacharach and Councilman McTaggart dissented. The motion failed, Councilman McTaggart moved, seconded by Mayor Bacharach, to direct staff to investigate this issue further by determining the City of Palos Verdes Estates experience with leaf blowers, Councilman Hughes and Hinchliffe dissented. The motion failed. AUDIENCE QUESTIONS. Don Swartz, 2038 Daladier Dr., presented background information on his attempts at having the utilities in his area placed underground. He noted that he had received no official word on his efforts, and he is anxious to bring this issue to a conclusion. City Attorney Calonne reported that he will review the project and contact Mr. Swartz. Public Works Director George Wentz added that the bonding agency that the City of Rancho Palos Verdes works with will not market the bonds unless they are free from any potential liens. Councilman Hinchliffe explained to Mr. Swartz that the Council is not free to discuss all the merits of this issue because of the pending litigation. Mayor Bacharach announced to Mr. Swartz that she will discuss the bond issue with Mr. Calonne and with the representative from Government Financial Strategies, ADJOURNMENT. session held pursuant to Section 54956.(b) (1) to legal counsel regarding section.
