PRESENT: McTAGGART, HINCHLIFFE, RYAN AND MAYOR BACHARACH ABSENT: HUGHES Also present were City Manager Dennis McDuff ie, Finance Director Kevin Smith, Recreation and Park Director Mary Thomas and City Clerk Jo Purcell APPROVAL OF AGENDA Councilman Hinchliffe moved, seconded by Councilman McTaggart.and-carried'to approve the agenda as. presented. . APPROVAL OF CONSENT CALENDAR .. Councilman. Hinchl if fe moved, seconded by Mayor Bacharach to approve the- Consent Calendar.as follows MIRALESTE ELEMENTARY.SCHOOL Authorised the staff to begin (140 1) negotiations with the Palos Verdes Peninsula Unified School District to acquire Miraleste Elementary School, PUBLIC HEARING: RESOLUTION NO. 89 -83 - Councilman Hinchliffe..announced VACATION OF P.V. DRIVE that he had watc,hed.the.video EAST AT MIRALESTE DRIVE tape of the August 15th meeting at which the Miraleste Fire Station right-of-way easement was discussed. Mayor Bacharach moved, seconded _ by .Councilman Hinch l if f e : and carried to close the public hearing. RESOLUTION 89 -83 ORDERING VACATION OF PORTIONS OF PALOS VERDES DRIVE EAST AND MIRALESTE DRIVE ADJACENT TO THE MIRALESTE FIRE STATION was presented by Title and adopted 10 on motion of Councilman Hinchliffe, seconded by Councilman McTaggart and carried, SPEC (1401) Councilman Hinchliffe summarized the reasons why he spoke about the 'issue of the Miraleste High School before the State School Board, Stating that he was not talking as a member of the City Council apologized for the misunderstanding that he was talking as a Council member. Barry Hildebrand, 3560 Vigilance, said he had a transcript of the meeting and felt that Mr. Hinchliffe was speaking for the City Council. He further'stated that the SPEC tape regarding the condition of the road made a disclaimer at the outset that this was the present condition of the road however it was being reconstructed and. that construction was visible in the background.' Keith Reynolds, 30745 Tarapaca-Road, representing the El Prado Homeowners Ass I ociation, said ,he thought Mr 'O Hinchl.iffe was representing the*C'ity in an official capacity. He said his homeowners group would like the 'City Council to send a letter to the State Board of Education. Sally Burrage 5505 Mistridge, speaking as a member of the Palos Verdes Peninsula Unified School District, said she also attended the meeting and felt that it was very clear that Mr. Hinchliffe was speaking as a parent. She also viewed the tape of the road and felt.that it misrepresented. the condition of'the road as it presently exists. Jack Bagdasar, 5532 Scottwood Drive, speaking as a member of the Palos Verdes Peninsula Unified School District Board, stated that he attended the State Board meeting 4nd.said that Mr. Hinchliffe represented hims'elf as just one member of the City Council, and as a-. parent who had children who attended the school, Marianne Kipper, 5 Chaparral Lane, said she regretted that the City Council had not supported a sizable portion of the community on this school issue; that the terrain of the area is hilly, that the roads are narrow, and that access from the East side is limited,,' She urged the Council.to take a stand on supporting the continuation of Miraleste High School..' Steven Kuykendall, 6544 Loc'klenna,, 'requested that Council take a stand on this issue. He said that the community only needs one and not two school districts. Council discussion then focused on thefo.11.owing issues. Z_ sending a letter torthe people at EPEC 'expressing the City Council's position on this issue; whether the Council should be getting into school district business; and, if the I Council should take a stand--�on k6ep''ing Mirale-ste High Sc'hoo;l-open and request the assistance of Senator Beverly and Assemblyman Felando in getting Eastview into the PvV,*P-aU*S-,D'4P Tom Weber, 2009 Avenida .Feliciano, -said that he represents over 700 homes in the Rolling Hills Riviera Homeowners Association and that they kept in touch with EPEC when they realized that the high school may close. He said that they followed the-action taken by the group in Lomita, who were also trying to secede from the L.A. School District and realized that it is a difficult process. Kay Bara, 1 Peppertree, spoke in support of keeping Miraleste High School''ope'n,* WaIter Yea*ger, 27803 Montereina. Drive-, President of the Rolling Hills Riviera Homeowners Association said that the members of his association were heavily in favor of joining the Palos Verdes Peninsula Unified School District, Joe Sanford, 3412 Via Palomino, ' speaking as a member of the School Board, said he has had two meetings with Assemblymen Felando in the last year regarding this issue but had not had any further communication from his office. He said the agreement was that they would talk to the representatives of EPEC'and join f orces a to try and get the Eastview Area into the- schoo.l''district,* Council discuss-ion resumed and dealt with the issue of whether the school district had gone on re . cord supporting the inclusion of the Eastview Area. Jack Bagdasar, . reported that the inclusion of Eastview would add to the school district approximately 1,600 students. Mayor 'Bacharach moved*,,*, seconded by Councilman Ryan to'send a letter to the State Board reaffirming the City's neutral position in the dispute betweewthe School District and SPEC. Discussion then followed if the letter should include the fact that the tape of the road was inaccurate; and that Councilman Hinchliffe was speaking as an individual and not as a member of the City Council, The motion to send a letter to the State Board reaffirming the City's neutral position on this issue carried on a 3-1-0 vote with Councilman Hinchliffe voting in opposition (Hughes absent). AUDIENCE QUESTIONS. Responding to the Mayor's call for audience question's was a Mr. Traugh, 100 Vanderlip Lane, who reminded the Council _3- August 29, 1989 that he had appeared before them 8 months ago regarding the Vanderlip staircase and was now speaking.on his own behalf. He explained that he and his wife have leased the cottage from Mrso.Vanderlip and that the demolition and removal of the circular staircase, which the City has requested be replaced- w,ith,something that meets the City's code, would place a burden on his wife since she is in the midst of a high risk pregnancy and is totally disabled. Citing the fact that he would be willing to sign a waiver of liability, he requested that the City Council consider holding off on enforcing this removal until later. staff was directed to contact the City Attorney about this, matter, 0 AUDIENCE QUESTIONS0.- Lyle Quatrochi, 4002 Exultant, complained about the lack of response from Dimension Cable when his cable service went out on.a Friday evening. He was told by Dimension that nobody could make a service call until Tuesday* RECESS AND RECONVENE At 9:00 P.M. the Mayor declared a recess. At 9:10 P.M. the meeting reconvened.. PARKS MASTER PLAN.- Director of Recreation and REVISION (1201) Parks Mary Thomas, presented the staff report of August 29th and the recommendation that the City Council adopt the revised Parks Plan., direct the,staff to pr,epare,a financial proposal for ,implementation of,the plan and authorize the addition of one administrative analyst position to the Dept, of Recreation and Parks, Committee Chairman Eric Randall introduced and thanked all of the members of the Parks Master Plan Committee and summarized the.pr,ocess that the committee went through in accomplishing this revision to the Plan. The City Council then proceeded to review the-plan and to take public testimony. Warren Sweetnam, President of the Rockinghorsi owners Association, 7 Top Rail Lane, inquired status of.the Narbonne Right of Way. Lorna Burrell, 1 Park Place, representing the Homeowners Association, told the Council that preferred that there not be a public restroom Cerro Park but rather that the park have only play equipment.., .8-4- Road Home- about the Park Place the Association at the Del children's Karen Libit,' Parks Master Plan committee member, testified that the issue of the restroom was studied and that conaiderati 1- on-wale given to using a porta''ble toil6tf 4 1 however it ,was felt that that it wouldibe - more objo�ction- able than a permanent structure. She described the survey conducted, the results of which indicated.that a restroom was desired. The next park to be discussed was'the Abalone Cove Shoreline Park and the scope of that park. Council inquired whether this park would reach as far as the nude beach, andf if horse trails could-be put do'wn'into-the Sacred Cove area. With regard to the amphitheater suggested for the Pt. Vicente Park/Civic Center area, Council briefly discussed whether the need existed for such a facility, and if anything had been done t6'stqdy the potential noise emanating from such a facility. Council then returned to the discussion of the nude beach area and the problems related to that area. Kay Bara, 1 Peppertree, requested that Council c-onsidet the use of a lifeguard and the installation of a public_-,tel-lephone in the area. It was the consensus that these issues of this beach and its attendant problems should be referred to the Abalone Cove Task Force. WESTMONT SANITATION DISTRICT Council briefly discussed the PARK SITE type of park for this location and whether it should be an active or a passive facility. It was generally felt that this park should remain a passive facility. PRIVATELY OPERATED RECREATION With regard to policy FACILITIES statement No. 4 regarding the encouragement and support of privately operated recreation facilities it was the consensus that recommendations No. 50 and 51 under that policy be deleted. With regard to policy No. 5 it was the consensus that recommendation No. 57 be reworded. It was also recommended that recommendations No. 55 and 58 be removed from that same policy. WALLACE RANCH Council requested more specific information regarding the use of this facility. August 29, 1989 STATUS40F PARKS COMMITTEE Staff recommended the re- .establishment of a permanent, Parks and Recreation. Committee which could be made up from the members of the Parks Mast,er;Plan Committee S. It was the consensus that staff should.put this item on the October 3rd City Council meeting. Councilman Hinchliffe moved, seconded by Councilman McTaggart and carried to adopt this report in concept and wait the EIR process , and financial review. ADJOURNMENT* : At., 11900 P .
