CC MINS 19911015M I N U T E S RANCHO PALOS VERDE CITY COUNCIL REGULAR MEETING OCTOBER 15, 1991 The meeting was called to order at 7.*40 PM by Mayor Hiinchliffe at the Hesse Park Community Center, 29301 Hawthorne Boulevard. Fol- lowing the Pledge of Allegiance to the flag, roll call was answered as follows. PRESENT: BACHARACH, MC TAGGART, HUGHES AND MAYOR HINCHLIFFE* ABSENT: RYAN* Also present were City Manager Paul Bussey, Assistant to the City Manager Pamela Weaver Antil, Environmental Services Director Robert Benard, Public Works Director Catherine Reed and City At- torney Carol Lynch. APPROVAL OF AGENDA The agenda was modified to move the following 'items: Destruction of Inactive Records - Placed under City Manager Reports; Palos Verdes 2000 Presentation - Placed. after the Consent Calendar; and added Disposal of Excess Narbonne Avenue Right-of-Way; Geologic Studies Throughout the City; and Recycling of Telephone Directories - Added under City Manager Reports The amended agenda was unanimously approved by those present. I CONSENT CALENDAR Mr. Paul Jensen, 26212 So. Grayslake, came forward to address Consent Calendar Item 10, Authorization of Improvement Projects Utilizing Recycling Funds. Mr. Jensen emphasized the need to re- place fencing along Montemalaga Drive. 1 The Consent Calendar was approved as follows on motion of Coun- cilman Hughes, seconded by Councilwoman Bacharach. Adopted a motion to waive full reading of all ordinances and resolutions adopted at the meeting with consent to the waiver of reading deemed to be given by all Council members after the read- ing of the title, MINUTES Approved the minutes of September 16, 1991# ORDINANCE NO* 270 - TRANSIENT OCCUPANCY TAX (1501) Adopted ORDINANCE NO. 270 AMENDING CHAPTER 3.16.060 OF THE RANCHO PALOS VERDES MUNICIPAL CODE RELATING TO A TRANSIENT OCCUPANCY TAX* ORDINANCE NO, 271 - GRAFFITI PREVENTION AND REMOVAL (1206) Adopted ORDINANCE NO. 271 RELATING TO GRAFFITI PREVENTION AND REMOVAL AND AMENDING THE RANCHO PALOS VERDES MUNICIPAL CODE, CLAIM AGAINST THE CITY BY PRABHA NARAYAN (303) Rejected the claim and directed the City Clerk to notify the claimant of the City Council's action. (2) Authorized staff to secure bids for the Landscape Improvement Project for the crib wall on Palos Verdes Drive South and the Fencing Re- placement Project on Montemalaga Drive utilizing Recycling Funds. CITY TILE PLAQUES FOR RETIRING COUNCIL MEMBERS OF RHE (304) Authorized the staff to order engraved City the plaques for retiring City Council Members from the City of Rolling Hills Es- tates for a cost not to exceed $75 from the Non-Departmental Fund* The motion to approve the Consent Calendar carried on the follow- ing roll call vote: AYES: BACHARACH, HUGHES, MC TAGGART AND MAYOR HINCHLIFFEO NOES: HUGHES (CITY TILE PLAQUES FOR RETIRING COUNCIL MEMBERS OF RHE)t ABSENT: RYAN, PALOS VERDES 2000 PRESENTATION Mr. Ron Stankey provided a status report on the activities of Palos Verdes 20006 Distributing related information to Council members, Mr. Stankey noted an upcoming Palos Verdes 2000 meeting designed to identify the emerging issue s affecting the Peninsula in the 21st Centurye Mr. Tim Burrell, 57 Marguerite Drive, presented a pertinent let- ter to Council members* 3 OCTOBER 15, 1991 DEVELOPMENT CODE REVISIONS (1203 x 1103 x 1801) Project Planner Nancy Hutar presented the staff report with the recommendation that the public hearing be closed and, after con- sideration of the public testimony and proposed modifications, staff be given direction to prepare necessary ordinances to 10 revise the Municipal Code. Council/staff discussion included whether non-conforming uses would be created with various of the proposed changes to the Development Code; Interpretation Procedure (Section 17.90); An.-- ten.nas and Satellite Dishes (Section 17.76.020); and Signs (Section 17.76.050). Public input began with Mr. John Beringer, 3412 Seaglen Drive, of the Council of Homeowners' Associations. Reading aloud from his October 15, 1991 letter which he distributed to Council members, Mr. Beringer asked that a non-redlined version of the proposed Code revisions be made available for review and that the public hearing be continued, Mr. Tim Burrell, 57 Marguerite Drive, urged rged Council to separately adopt Planning Commission Resolution 91-46 (relating to Section 16.32 - City Council's power to amend tract maps). Reading aloud from his undated letter which he distributed to Council members, Mr. John Sharkey, 30320 Ave de Calma, strongly objected to proposed changes in Open Space Hazard areas. Mr. Robert Randall and Ms. Mardi Halet, representing Rolling Hills' Board of Realtors, 28215 Palos Verdes Drive East, offered their assistance in the development of sign pa I rameters, Ms. Laurie Jester, 21 Pomegranate Road, suggested that language relating to the visual quality /aesthetics of natural vegetation and wild life habitats be addressed in the proposed Remedial Grading section of the Code. Ms. Jester voiced her concern over seeming inconsistencies in the proposed Open Space Hazard portion of the Code. Councilwoman Bacharach moved to close the public hearing. The motion, seconded by Mayor Hiinchliffe, was passed by a 3-1 majority voice vote with Councilman MoTaggart dissenting. Ak Council then discussed the following elements of the proposed changes to the Code.* the consistency of remedial grading criteria with other grading projects; whether Open Space Hazard areas should be given fifty percent credit toward Residential Planned Development open space; the inclusion of language per- taining to t? array size's and "height" for antennas and satellites; the need to address visual quality/aesthetics of natural vegeta- tion and wild life habitats for remedial grading; if it was ap- 4 propriate for Council review of the decisions of the View Res- toration Committee; and parameters for signs, such as size and identification criteria, It was the consensus that staff would prepare a resolution and ordinances relative to these Code sections at the next City Coun- cil meeting, W At 9-:45 Mayor Hinchliffe declared a recess until 10:00 when the meeting reconvened. At this time, City Attorney Lynch announced City Council's vote after the closed session earlier this evening in favor of placing the appeal of Pan Asian Development on an upcoming Council agenda, AUDIENCE QUESTIONS Noting that discussion of this topic was postponed at a previous Council. meeting, Dr. Craig Mueller, 3559 Seaalen Drive, asked 4=5 that increased funding 'be provided for additional PV Transit vans . Council responded that this increase in service would be depen- dent upon the ridership of the new Palos Verdes Estates fixed- line transit program. Ms. Lois LaRue, 3136 Barkentine Road, voiced her appreciation of the courteous manner in which Mayor Hinch.11iffe has conducted Council meetings, She asked for clarification of various Plan- ning Department language/procedures. MARYMOUNT C.U*P, NO, 9 REVISION "C" - UPDATE (1804) Environmental Services Director Benard presented an update on Marymount College Conditional Use Permit No. 9 Revision "C." Mr. Earle Casler, Jr. 3324 Marino Drive, expressed his support of the City's review of the Conditions for the Marymount College Conditional Use Permit. 5 OCTOBER 15, 1991 TENTATIVE TRACT MAP 466519 CONDITIONAL USE PERMIT NO. 151, GRADING PERMIT NO, 13893 ENVIRONMENTAL IMPACT REPORT NO, 32 KAJIMA DEVELOPMENT CORPORATION (1411) City Manager Bussey provided background information on the sub- ject applications, the main topic being hydrology. Referring to her October 13, 1991 letter addressed to Planning Associate Silverman, City Attorney Lynch outlined proposed condi- tions of approval pertaining to hydrology and recommended incor- poration of that proposal and amendment. It was noted by the Mayor that the public hearing was closed at a previous Council meeting, Discussion ensued as follows. Mr. Charles Abbott of Charles Abbott and Associates supplied preliminary engineering information on the proposed off-site debris basin. Be commented on the desirability of same. Sunshine, 6 Limetree Lane, related her understanding in this area. Council then discussed*. the need for the debris basin to be designed to County standards; the location of trails; and the necessity that the trails be installed concurrent with the con- struction of other public easements. Because of the need for further clarification, it was agreed that discussion of this item would be delayed until later in the meet- ing. FILM PERMITS - PARAMOUNT PICTURES "PATRIOT GAMES" (202 x 1101) 41 Assistant to the City Manager Antil noted that, since the writing of the staff report, the applicant submitted a revised film per- mit application, the new location being the Marineland site. She related staff's anticipated approval of --L-.he reNlised application. Council suggested that the City be included in the credits when a motion picture is filmed in Rancho Palos Verdes. After a suggestion made by City Manager Bussey, Mayor; Hinchliffe asked that interested parties be encouraged to help restore natural vegetation in Subregion 8. 0 OCTOBER 15, 1991 RECYCLING OF TELEPHONE DIRECTORIES (1301) Councilman Hughes thanked Mr. Kevin Peterson of General Telephone Company for his efforts in recycling of old telephone direc- tories. Assistant to the City Manager Antil explained that old telephone directories are not accepted in the City's recycling program. DISCUSSION OF 1992-93 BUDGET DECISION TIMELINE (602) City Manager Bussey presented the staff report with the recommen- dation that no Council action is requested at this time and that staff would follow up with additional information requested or direction given as a result of Council discussion of this item. It was the consensus that discussion of a date for a 1992-93 Budget Workshop be placed on the November 19, 1991 meeting agenda. STATUS OF DIRECTIVES In reference to the Granvia/Hawthorne item, Council requested that staff check into the status of the installation of a left- turn pocket barrier on Granvia Altamira and Hawthorne Boulevard. With regard to the Marymount College CUP, Council suggested that the Marymount College AQMD Ride Sharing Plan be monitored. i DISPOSAL OF EXCESS NARBONNE AVENUE RIGHT-OF-WAY (1408) The staff report was presented by City Manager Bussey with the recommendation that Council accept the County's appraisal of $325,000 as the minimum acceptable bid for surplus Narbonne Avenue right -of -way o , Councilman Hughes moved, seconded by Mayor Hinchliffe, that the County's appraisal of $325,000 be accepted as the minimum accept- able bid for surplus Narbonne Avenue right-of-way. At this time, City Manager Bussey reviewed his October 15, 1991 memorandum (addressed to Mr. Peter Karl Von Hagen and distributed at the meeting) in which he commented on the Planning Commission's tie vote on any decision regarding revisions to Chap-ter 15 of the Municipal Code. 7 OCTOBER 15, 1991 GEOLOGIC STUDIES THROUGHOUT THE CITY City Manager Bussey asked Council to consider a workshop date to discuss the status of geologic studies throughout the City. The date of Saturday, October 26, 1991 was agreed upon. ITEM REMOVED FROM THE CONSENT CALENDAR.* DESTRUCTION OF INACTIVE RECORDS (301) City Manager Bussey presented the staff report with the recommen- dation that Council adopt a resolution authorizing the destruc- tion of certain City records as provided by Section 34090 of the Government Code of the State of California, Ms. Lois LaRue, 3136 Barkentine Road, asked that the destruction of City records be postponed until after the upcoming elections that she be allowed to review documents before they are destroyed; and that the City consider the utilization of "space savers" for document storage. Mayor Hinchliffe advised Ms. LaRue of City procedures pertaining to file maintenance, RESOLUTION NO, 91-71, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES, AUTHORIZING THE DESTRUCTION OF CER- TAIN CITY RECORDS AS PROVIDED BY SECTION 34090 OF THE GOVERNMENT CODE OF THE STATE OF CALIFORNIA was presented by title and adopted on motion of Councilwoman Bacharach, seconded by Council- man Hughes and carried, (1411) At this time, discussion. returned to . Tentative Tract. Map 46651, Conditional Use Permit No. 151, Grading Permit No. 1389 and En- vironmental Impact Report No. 32 - Kajima Development Corpora- tion, Planning Associate Silverman explained a diagram of pertinent trails, which was presented as Exhibit B to Tentative Tract Map No. 46651 Conditions of Approval. Conditions contained in Section K (Easements) of Exhibit A to Tentative Tract Map No. 46651, Cand i'tions of Approval, were modified to provide equestrian links along the Crest Ranch Trail from the Ida jima Trail eastward along Crest Road to Highridge Road and then southward along Highridge Road -to the tract boundary, 8 OCTOBER 15, 1991 The Kajima Trail was also modified to continue along the southern tract boundary parallel to Ocean Terrace Drive to the terminus of Ocean Terrace Drive. Various incidental changes were made throughout the tract's C.U.P. resolutions to accommodate and clarify these trail revisions.
