CC MINS 19910820M I N U T E S RANCHO PALOS VERDES CITY COUNCIL REGULAR MEETING AUGUST 20, 1991 The meeting was called to order at 7:30 P.M. by Mayor Hinchliffe at the Hesse Park Community Center, 29301 Hawthorne Boulevard. Following the Pledge of Allegiance to the flag, roll call was answered as follows: PRESENT: HUGHES, McTAGGART, RYAN, AND MAYOR HINCHLIFFE ABSENT: BACHARACH Also present were City Manager Paul D. Bussey, Deputy City Manager Mark Rohloff, Environmental Services Director Robert Benard, Public Works Director Catherine Reed, City Attorney Carol Lynch and City Clerk Jo Purcell., APPROVAL OF AGENDA After the addition of the hearing date for the Trails Plan (Councilman McTaggart), Councilman Hughes moved, seconded by Councilman Ryan to approve the agenda as presented. The motion carried unanimously. CONSENT CALENDAR After removal of the item concerning the Trails at Tract No. 33206, the consent calendar was approved as follows on motion of Councilman Ryan, seconded by Councilman Hughes. Adopted a motion to waive full reading of all ordinances and resolutions adopted at the meeting with consent to the waiver of reading deemed to be given by all Councilmembers after the reading of the title. MINUTES Approved the minutes of August 6, 1991. ORDINANCE NO. 268 SOLID WASTE COLLECTION AND DISPOSAL (1301) Adopted ORDINANCE NO. 268 OF THE CITY OF RANCHO PALOS VERDES RELATING TO THE COLLECTION AND DISPOSAL OF SOLID WASTE AND AMENDING THE RANCHO PALOS VERDES MUNICIPAL CODE. ORDINANCB NO. 269 REGARDING THE USE OF PARR FEES (1201 x 1203 x 1409) Adopted ORDINANCE NO. 269 OF THE CITY OF RANCHO PALOS VERDES, RELATING TO DEDICATIONS FOR SUBDIVISION RELATING TO PARK IMPROVEMENTS AND AMENDING THE RANCHO PALOS VERDES MUNICIPAL CODE. STORAGE CONTAINER FOR PT. VICENTE INTERPRETIVE CENTER (1201) Accepted with thanks the offer from Los Serenos De Pt. Vicente to donate an 8 ft. x 15 ft. storage container and associated installation costs for use at Pt. Vicente Interpretive Center, KLONDIKE CANYON GEOLOGIC HAZARD ABATEMENT DISTRICT AND ACLAD - APPOINTMENT OF BOARD MEMBERS (1201) (1) Appointed Tom A. Appleby, John M. McCarthy, and Ned. C. Skillman to the Klondike Canyon Geologic Hazard Abatement District, each for a four year term of office, (2) Appointed David E. Gilmore and Stephen L. King to the Abalone Cove Landslide Abatement District, each for a four year term of office. MIRALESTE R &P DISTRICT APPOINTMENT OF BOARD MEMBER (1201) Appointed Kenneth Holt, M.D. to fill out the unexpired term of Michael Lawler to November, 1993. TRACT NO. 46422 - ACCEPTANCE OF PUBLIC IMPROVEMENTS (1411) (1) Accepted on -site and off -site street improvements, storm drains, water system, sanitary sewers and grading as completed and released the Faithful Performance and Labor and Material Bonds. (2) Directed the City Clerk to notify the surety and the developer. CLAIM.AGAINST THE CITY BY SHANNON HUTCHINS (303) Rejected the claimant's application for leave to present a late claim and directed the City Clerk to advise the claimant of the City Council's action. WAIVER OF SIGN PERMIT FEE - PENINSULA SYMPHONY. (1203) Authorized the Director Environmental Services to waive the application fees related to Sign Permit No. 554 for one temporary sign. RESOL. NO. 91 -57 REGISTER OF DEMANDS Adopted RESOLUTION NO. 91 -57 ALLOWING CERTAIN CLAIMS AND DEMANDS AND SPECIFYING FUNDS FROM WHICH THE SAME ARE TO BE PAID. The motion to approve the consent calendar carried on the following roll call vote: -2- AUGUST 20, 1991 AYES: HUGHES, McTAGGART, RYAN, AND MAYOR HINCHLIFFE NOES: NONE ABSENT: BACHARACH ITEM REMOVED FROM THE CONSENT CALENDAR: TRACT NO. 33205 - ACCEPTANCE OF CAMELIA TRAIL EXTENSION AND VISTA POINT ( 710 X 12 01) Director Benard presented the August 20th staff memorandum and the recommendation to accept the Grant Deed of Easement and the Irrevocable Offers to Dedicate public trails in the common open space area of Tract No. 22306, authorize the Mayor and City Clerk to sign the Certificate of Acceptance and instruct the City Clerk to record the Grant Deeds with the County. He noted that the City Attorney had proposed a revised Irrevocable Offer, copies of which had been presented to Council. Tony Todora, 28 Avenida De Azalea, stated his opposition to horses going through his neighborhood. Director Benard clarified the fact that the horse trail existed along the southern and eastern perimeter of the property outside of the residential development in the open space lots. Trails Committee Chair Barbara Dye, 7035 Hartcrest Drive, stated that the Camelia trail would not be an equestrian trail and only that portion of it that would eventually link to the Loop Trail would be equestrian. Councilman Hughes moved, seconded by Councilman Ryan to continue this item. The motion carried. RECYCLE WINNER Mayor Hinchliffe announced that David Berkowitz was the recycling lottery winner for the month of August and would be eligible for a year's free service of trash pick -up. CITY COUNCIL REPORTS: HEARING DATE FOR TRAILS PLAN (701 x 1201) Councilman McTaggart requested that the public hear.ng on the Trails Plan be continued to the last meeting in September because he would be out of town for the September 3rd meeting. -3- AUGUST 20, 19 91 Because the public hearing had already been published, concern was expressed for the legal implications and confusion created by changing the hearing date. Councilman McTaggart moved, seconded by Councilman Ryan to change the Trails Plan public hearing date to September 16, 1991. The motion carried. CITY MANAGER REPORTS: PROPOSED ORDINANCE ON GRAFFITI CONTROL. Deputy City Manager Rohloff presented the staff memorandum of August 20, 1991 which contained several alternatives for the. City Council to consider including in a graffiti ordinance. Captain Dennis Mangan of the Lomita Sheriff's Station, responded to the Council's questions about the confiscation of spray cans from juveniles, and the fact that it is a misdemeanor to be seen in the act of defacing property. He suggested that the Council consider a restitution component which could be enforced if an act of vandalism was prosecuted. Staff was instructed to prepare an ordinance much like that enforced in the City of Los Angeles, STATUS OF DIRECTIVES No changes were made to the document presented.
