CC MINS 19900918M I N U T E S RANCHO PALMS VERDES CITY COUNCIL REGULAR MEETING - SEPTEMBER 18y 1.998 The meeting was called to order at 7:30 P.M. by Mayor Melvin W. Hughes at Hesse Park Community Center, 29301 Hawthorne Boulevard. Following the Pledge of Allegiance to the flag, roll call was answered as follows: PRESENT.* McTAGGART, RYAN, BACHARACH AND MAYOR HUGHES ABSENT. HINCHLIFFE Also present were City Manager Paul D. Bussey, Deputy City Manager Mark Rohloff, Environmental Services Director Robert Benard, Public Works Director George Wentz, City Attorney Carol Lynch, Director of Recreation and Parks Mary Thomas and City Clerk Jo Purcell. WAIVER OF FULL READINGS Councilwoman Bacharach moved, ORDINANCES AND RESOLUTIONS seconded by Councilman Ryan and carried to waive reading -in in full of all ordinances and resolutions adopted at this meeting with consent .to--the- waiver ,,of reading deemed to be given by all Councilmembers after reading to the title of such ordinance or resolution. APPROVAL OF AGENDA The agenda was approved on motion of Councilwoman Bacharach, seconded by -Councilman McTaggart and carried. CONSENT CALENDAR Lois Larue, 3-13-6 Barkentine Rd*, requested that the City-- Council consider-giving $300 to the.South Bay Chamber Society and consequently the amount of the grant to the Peninsula Senior citizens. With regard to the item regarding the Disadvantaged Business Enterprise,, Ms., Lague inquired about what contract would be let to a minority business. Staff explained that no specific contract was anticipated at this time but these goals were adopted and would be applicable to future contracts. The following items were removed from the consent calendar. speed limit resolution; resolution regarding County Lighting 0 Maintenance District 1560, and, the request to plant trees in the switchback area of Palos Verdes Drive East. The Consent Calendar as amended was adopted as follows on motion of Councilwoman Bacharach, seconded by Mayor Hughes. AWARD OF GRANT TO Awarded grant of $3,500 to PENINSULA SENIOR FY90-91 Penins'ula Seniors for Fiscal (305) Year 1990-91. Funds to be paid out of budgeted line item in Non-Departmental Budget* DISADVANTAGED BUSINESS ENTERPRISE (DBE) FY 90-91 (601) advertise these goals for for a period of 30 days* (1) Adopted the FY 90-91 goals of 14% DBE participation of federally funded projects. (2) Directed the City Clerk to comment and post them at City Hall STREET PATCHING PROJECT (1) Accepted the work as FY 90-91 (1404) completed on the FY 90-91 street patching project in the amount of $71,878.52. (2) Directed the City Clerk to file a Notice of Completion and to notify the surety to exonerate the contract bonds. (3) Directed the Finance Director to release the retention if no claims are filed against the contractor in the-allowable time period* DISASTER PREPAREDNESS (401) (1) Authorized the City Manager implement the following line of succession for Director of Emergency Services if he is unable to fulfill the duties of Director: Deputy City Manager, Director of Environmental Services, Director of Recreation and Parks, City Clerk, Assistant to the City Manager and Administrative Analyst/Emergency Services Coordinator* (2) Authorized the City Manager to appoint the Administrative Analyst/Emergency Services coordinator as Assistant Director of Emergency Services* ACCEPTANCE OF TRACT Accepted the subdivision, the AGREEMENTS AND APPROVAL OF landscape and ingress/egress FINAL MAP - TRACT NO. 46422 maintenance agreements and (1411) approved the final map. RESOLUTION NO. 90-73 Adopted RESOLUTION NO. 90-73 REGISTER OF DEMANDS ALLOWING CERTAIN CLAIMS AND DEMANDS AND SPECIFYING FUNDS FROM WHICH THE SAME ARE TO BE PAID* The motion to approve the Consent Calendar carried on the 0 following roll call vote. AYES: McTAGGART, RYAN, BACHARACH AND MAYOR HUGHES NOES. NONE ABSENT:HINCHLIFFE -2- SEPTEMBER 18, 1990 REQUEST TO PLANT TREES - The Public Works Director SWITCHBACK AREA - PALOS presented the staff memorandum VERDES DR. EAST ,(1204) of September 18th. and the recommendation to. 1. Endorse in concept the planting of frees in this area. 2. Refer to the Recreation and Parks committee and Trails committee for review. 3. Direct the applicant to revise plans to conform to committee requirements. 4. Direct staff to return the revised application to City council for confirmation. Council inquired why this item was being sent through two committees; and if in sending this to the Trails Committee this would be an opportunity to incorporate it into the trails program. Representing Marymount college was Dr. Alan Franz, 38888 Palos Verdes Dr. East, who said that he would be willing to work with the City committees and the homeowner associations on this project. He stated that it would take a certain amount of time to train the volunteers and that the planting would probably not start until after the start of the rainy season. Council inquired how members of the community could become involved in this project and informed Dr. Franz that if recycling funds are used that it would only be for the start- up of the project. Lois Larue, 3136 Barkenti.ne Rd., inquired about the danger of putting plants in this area that require watering since it is in the landslide area. Staff responded that a drip'irrigati.on system would be used and that it added no problem in that area. Councilwoman Bacharach moved, seconded by Councilman McTaggart to approve the staff recommendation. The motion carried unanimously' VACATION OF SEA RAVEN DRIVE Director Wentz presented the (1408) staff memorandum of September 18th and recommendation that the matter be continued to October 2nd. councilman Ryan so moved, seconded by Councilwoman Bacharach and carried. RESOLUTION N09 98 -74 - Planning Administrator Curtis GENERAL PLAN AMEND" NT Williams presented the staff (HOUSING ELEMENT) (701) memorandum of September 18th and the recommendation to approve the resolution adopting an updated Housing Element of the City's General Plan and a final Negative Declaration for -3- SEPTEMBER 18, 1990 the element, subject to the revisions outlined in Exhibit "A" of the resolution. Lois Larue, 3136 Barkentine Rd., stated that she wanted to go on record as opposing this housing element because it did not address the low income housing issue. RESOLUTION NO. 90 -74 APPROVING GENERAL PLAN AMENDMENT No. 18, UPDATING THE HOUSING ELEMENT OF THE CITY'S GENERAL PLAN, AND ADOPTING A NEGATIVE DECLARATION FOR ENVIRONMENTAL ASSESSMENT NO. 613 was presented by title and adopted on motion of Councilwoman Bacharach, seconded by Councilman Ryan and carried. CONDITIONAL USE PERMIT NO. 155 ( 1844) published. Environmental Se, the staff memorandum and the public hearing until October The Mayor declared the hearing open and the City Clerk report- ed that notice had been duly rvices Director Benard presented recommendation to continue the 16th. Speaking in opposition to the granting of this C.U.P. was Deanne Plemons, 268 Calle Amorosa, Camarillo, who told the Council that she had formerly lived adjacent to the Green Hills Memorial Park and that a landslide in her backyard was the result of dirt being dumped into the swale by Green Hills and consequently flooding her house. Councilwoman Bacharach moved, seconded by Councilman McTaggart and carried to continue this public hearing to October 16th. PRE - SCREENING WORKSHOP- It was the consensus to SUBREGION 1 (1411) schedule a pre- screening work- shop for 6:00 P.M. on October 16, 1990. GENERAL PLAN INITIATION Environmental Services Director REQUEST - (741) Benard presented the staff memorandum of September 18th and reported that the applicant had requested that this matter be continued to October 2nd. Lois Larue, 3136�Barkentine Rd., alluded to a letter from a resident and asked why it was directed to only one member of the Council. Council responded that each member of the City Council had received a similar letter from that resident. Councilwoman Bacharach moved, seconded by Councilman Ryan and carried to continue this matter to October 2nd. -4- SEPTEMBER 18, 1990 RECYCLING GRANT Public Works Director Wentz GUIDELINES (1301) presented the September 18th memorandum and the staff recommendation to adopt the revisions to the recycling grant guidelines as proposed by the Refuse Subcommittee and outlined in Exhibit "A" which, among other things, required the following: Funds are not intended to be used for the maintenance of public street surfaces,* the proposed project is to be cost effective* landscape projects must propose drought tolerant plant materials; all proposed projects shall be reviewed by the Director of.Public Works and, when necessary, the Department of Environmental Services for Municipal Code consistency and permits; grants may be awarded to applicants for programs which are not related to beautification or maintenance if certain evidence is presented* the grant amount awarded should be related to the number of homes in the proposed grant area; the Applicant is responsible for obtaining any necessary City permits or approvals before starting an awarded project* and Project completion and expenditures shall be monitored by the Department of Public Works and payments released through the Finance Department based on invoices* Councilwoman Bacharach moved, seconded by Councilman McTaggart and carried to adopt the recommendations* RECYCLING GRANT AWARDS Assistant to the City Manager (1301) Pam Weaver presented the September 18th memorandum and the staff recommendation to award the grant applications to the ' following: Mira Catalina Homeowners Association for $1,5309 Monte Verde Estates Homeowners Association for $3,000 and Palos Verdes Panorama Homeowners Association for $1,500, and Island View Homeowners Association for $3,000. Additionally, staff recommended that the applications from the Hill Community Association, and the Vista Grande P.T.A. be denied. Discussion then centered on various products that were recyclable but could not be deposited in the City's curbside recycling program. Staff was requested to find out whether plastic bags are recyclable and what items could be added to the City's program. Additionally, staff was requested to prepare an article for the Newsletter informing City's residents of where they could deposit old batteries. PALOS VERDES DRIVE EAST REALIGNMENT PROJECT - HAZARD ELININATIONiPROJECT (1404) The Director of Public Works presented a revised staff re- port requesting that Council reject all bids* -5- SEPTEMBER 18, 1990 Councilwoman Bacharach so moved, seconded by Councilman Ryan and carried* Sunshine , 6 Limetree, requested that this project come before the Trails Committee since the area involved included the Palos Verdes Loop Trail. It was the consensus of Council that staff should present this item to the Trails Committee* AUDIENCE QUESTIONS* Responding to the Mayor's call for audience questions for items not on the agenda was Lois Larue, 3136 Barkentine, who requested that the City Council consider preparing a letter similar to the one she submitted from the City of Long Beach regarding grants'to the National Endowment for the Arts* It was the consensus that staff would provide the City Council with the copy of the Long Beach letter. Kathy Snell, 8 Vanderlip Dr., told the Council that in 1978 her property rights had been taken because of the implementation of the moratorium, also, she complained that with her application for a 600 sq. ft. addition to her home, she was required by the City to sign a covenant which she felt would be signing away more of her property rights, also, that she would have to remove some very large old trees* Staff clarified the requirements of Proposition M in that it was not necessary to remove trees that were not blocking views* Mrs. Snell also inquired about the City's reserve for low income housing insofar as it dealt with the Redevelopment Agency* It was the consensus that Mrs. Snell should meet with the City Manager for further explanation of this matter* Barbara Dye, 7035 Hartcrest, representing the Vista Grande P.T.A. told the Council that her group lost $1,500 in income when the City started the recycling program and that the neighborhood would still like to submit a program I that would be eligible for recycling funds* 41 STATUS OF COUNCIL DIRECTIVE* Council requested that staff add an item pertaining to a five year transit plan update* A brief discussion ensued regarding the-meeting that staff held with representatives of the City of Rolling Hills Estates where it was determined that several options -6- SEPTEMBER 18, 1990 may be available to help mitigate traffic control concerns at the intersection of Hawthorne and Silver Spur* Council requested that staff investigate whether this control would be sensitive to light weight vehicles* TREE REPLACEMENT POLICY The City Manager presented (1801) the staff memorandum of September 18th regarding staff's request that an ordinance be prepared for a tree replacement policy pursuant to the purposes of Proposition M. A brief discussion followed and Council inquired whether this request was coming from the View Restoration Committee or the staff; whether the staff should work with the City Attorney on this issue* if the preparation of such an ordinance would hold up any of the cases before the View Restoration Committee; and, if this ordinance would further the goals of Proposition M. Richard Bara, 1 Peppertree, suggested that the City have a preferred tree list that would identify the height and drought tolerance of trees* Councilwoman Bacharach-moved, seconded by Councilman Ryan and carried that staff be directed to work with the View Restoration Committee in the preparation of a tree replacement ordinance pursuant to the purposes of Proposition M. RESOLUTION 90-75 Public Works Director Wentz ESTABLISHING SPEED LIMIT presented the staff memorandum ON VARIOUS STREETS WITHIN of September 18th and the THE CITY (1502) recommendation that Council adopt the proposed resolution establishing speed limits on various streets within the City* The City Attorney made a brief amendment to Section 2 of the proposed resolution* Lois Larue,,3136 Barkentine, inquired about the rationale used in determining the speed limits to be used on certain streets in light of the results of the engineering speed surveys presented* Staff responded that they would meet with Ms. Larue and explain the exact procedure used. RESOLUTION NO* 90-75 ESTABLISHING SPEED LIMITS ON VARIOUS STREETS WITHIN THE CITY OF RANCHO PALOS VERDES was presented by title and adopted on motion of Councilwoman Bacharach, -7- SEPTEMBER 18, 1990 seconded by Councilman McTaggart and carried. Motion carried unanimously. RESOLUTION NQ. COUNTY LIGHTING DISTRICT 1554 jurisdiction to County Lighting 90-76 - Staff presented the memorandum MAINTENANCE of September 18th and the (1405) recommendation to adapt a resolution granting consent and the County of Los Angeles in the matter of- District 1560. RESOLUTION NO. 90 -76 GRANTING CONSENT AND JURISDICTION TO THE COUNTY OF LOS ANGELES IN THE MATTER OF COUNTY LIGHTING MAINTENANCE DISTRICT 1560 IN THE CITY OF RANCHO PALOS VERDES was presented by title and adopted on motion of Councilwoman Bacharach, seconded by Councilman McTaggart and carried.
