CC MINS 19900904M I N U T E S RANCHO PALOS VERDES CITY COUNCIL REGULAR MEETING SEPTEMBER 4, 1990 The meeting was called to order at 7,*00 P.M. by Mayor Hughes at the Hesse Park Community Center, 29301 Hawthorne Boulevard and was immediately.recessed to a closed session. The regular meeting was called to order at 7:30 P.M. Following the Pledge of Allegiance to the flag, roll call was 10 answered as follows.. PRESENT: McTAGGART, HINCHLIFFEy RYAN, BACHARACH AND MAYOR HUGHES Also present were City Manager Paul D. Bussey, Deputy City Manager Mark Rohloff, Environmental Services Director Robert Benard, Public Works Director George Wentz, City Attorney Carol Lynch, Director of Recreation and Parks Mary Thomas and City Clerk Jo Purcell* The City Attorney announced that the City Council had held a closed session pursuant to Government Code Section 54956.9(a) and discussed Shahin vs. the City of Rancho Palos Verdes,, Segreto, vs City of Rancho Palos Verdes, and People of the State of California vs. Stefano and Gemme Finazzoe WAIVER OF FULL READINGS. ..-Councilman McTaggart moved, ORDINANCES AND RESOLUTIONS seconded by Councilman Hinchliffe and carried to waive reading in full of all ordinances and resolutions adopted at this meeting with consent to the waiver of"reading deemed to be given by all councilmembers after reading of the title of such ordinance or resolution. APPROVAL OF AGENDA The agenda was approved on motion of Councilwoman Bacharach seconded by Councilman Hinchliffe and carried* CONSENT CALENDAR The consent calendar was modified to remove the item regarding sale of property at 5672 Sunmist Drive to.the end of the agenda and was adopted as follows on motion of Councilwoman Bacharach, seconded by Councilman Hinchliffe. NO. 90 -67 - CONDITIONAL USE PERMIT 31 A REVISION "A" (1804) Adopted RESOLUTION NO. 90 -67 OF THE CITY OF RANCHO PALMS VERDES UPHOLDING CONDITIONAL USE PERMIT NO. 31 REVISION "A" APPEAL FOR THE INSTALLATION OF TRAFFIC CONTROL DEVICES AT THE ENTRANCES TO TRACT NO. 332060 RESOL. NO. 90 -68 - Adopted RESOLUTION NO. 90 -68 VACATION OF STREETS WITHIN OF THE CITY OF RANCHO PALOS TRACT.33206 (1408 K 1411) VERDES ORDERING VACATION OF STREETS WITHIN TRACT 332060 WEED CONTROL CONTRACT Awarded the Fiscal Year 1990 - RIGHT -OF -MAY (1204) 91 Weed Control contract for City rights-of-way to Jimmie's Custom Spray Service at a cost $20,137 plus provide a 10% contingency of $2,000 for a total authorized expenditure of $22,137. RESOL. NO. 90 -69 - BUDGET AMENDMENT FOR LADERA LINDA COMMUNITY CENTER. (1204 -1201) the contract for landscape Community Center to Marina plus provide a 10% contingo authorized expenditure not Adopted RESOL. NO. 90 -69 OF THE CITY OF RANCHO PALOS VERDES AMENDING RESOLUTION NO. 90 -53 THE BUDGET APPROPRIATION FOR FISCAL YEAR 1990 -91. Awarded renovations at the Ladera Linda Contractors at a cost of $44,700, ancy of $4,000 f o r a total to exceed $40,700. SIDEWALK REPAIR PROGRAM (1) Accepted as complete the FY 1989 -90 (1405) FY 1989 -90 Sidewalk Repair Program. (2) Directed the City Clerk to file a Notice of Completion and notify the Surety to release the bonds. (3) Directed the Finance Director to release the retention of $7,635.54 upon notice from the City Clerk that no claims have been filed. PUBLIC ART AD HOC ARTS Set September 18, 1990 at 6:30 COMMITTEE INTERVIEWS (1201) P.M. as the date to interview applicants. SALE OF P.V. TRANSIT VANS (1) Authorized the staff to (1505) sell P.V. Transit Van No. 967 for $1,500. (2) Authorized staff to pursue an agreement with Nationwide Company to auction off the other P.V. Transit Vans. CLAIM AGAINST THE CITY Rejected the claim and directed MYRTLE ANDERS (303) the City Clerk to notify the claimant. -2- SEPTEMBER 4, 1990 RESOLe NO. 90-70 REGISTER OF DEMANDS FROM WHICH THE SAME ARE TO BE Adopted RESOLUTION NO* 90-70 ALLOWING CERTAIN CLAIMS AND DEMANDS AND SPECIFYING FUNDS PAID. The motion to approve the consent calendar carried on the following roll call vote. AYES: McTAGGARTY HINCHLIFFEr RYAN, BACHARACH AND MAYOR HUGHES 0 NOES* NONE RECYCLING LOTTERY DRAWING Staff reported that there were no winners for the month of September. A brief discussion followed regarding the method followed by staff in determining who participates in the recycling program,, VACATION OF CUL-DE-SAC The Mayor re-opened the Public AT SEA RAVEN DRIVE (1408) Hearing on this request to vacate a portion of Sea Raven Drive from Heroic Drive to the cul-de-sac, said public hearing having been continued from August 7, 1990. The City Attorney stated that a report had been received from Title.Insurance indicating that when the street is vacated that title will go to the two underlying property owners. Representing the Trails Committee was Chairwoman Barbara Dye, who described the footpath as meandering out to the vista point and said that this vacation would be preserving that viewing area, Sam Rubino, 32507 Searaven Driver expressed her frustration with the procedure on this request and reiterated her request that the street be vacated; that they be permitted to incorporate the area.into their home setting, and, that a standard walkway be allowed. Dr. Anthony Rubino, stated that this area could be incorporated into their property and that the City would not then be responsible for its maintenance. He, too, expressed frustration with the length of time it has taken to settle this issue, Joseph Gorman, 3675 Vigilance Drive, that area every day, that this is a has not observed any unusual amount it would be difficult to get to the area is vacated by the City, -3- stated that he walks in vista point and that he of debris. He felt that vista point if this SEPTEMBER 4, 1990 Representing the Ladera Linda Homeowners Association was Paul Weisz, 32365 Phantom Drive, who reported that his organization had not taken any position on this vacation, but stated the board's preference for an easement not less than seven feet wide. He was concerned that walls on either side of the trail would create a tunnel effect. Referring to a sketch of the properties involved Council discussed designs for the footpath; inquired whether the applicants should instead be offered an easement for their driveway; questioned how the footpath could be designed to prevent the path from becoming a neglected tunnel area; a nd, expressed concern that the width of the footpath be adequate. Concern was also expressed about the possibility of motorized vehicles using this footpath. Councilwoman Bacharach moved, seconded by Councilman Hinchliffe, to approve in concept the vacation of the right- of-way and a ten foot easement* F additionally, that staff consider appropriate measures to prevent motor vehicle access to this pedestrian trail and that a resolution incorporating these concerns'be presented at the next City Council meeting* -0 AUDIENCE QUESTIONS: Responding to the Mayor's call for audience questions for items not on the agenda was Lois Larue, 3136 Barkentine, who inquired about the repair schedule for that portion of Palos Verdes Drive between Hawthorne Boulevard and the Wayfarer's Chapel and also about a home being built on Via Canada at Palos Verdes Drive East. Staff responded that upon the completion of the A&H project, that P. V. Drive South will be slurry sealed. With regard to the issue of the house on Via Canada, Council responded that since this is an item that could possibly be coming before them for consideration, no comment could be made* GENERAL PLAN AMENDMENT The Mayor opened the Public NO* 18 - ENVIRONMENTAL Hearing on this update of the ASSESSMENT NO. 513, HOUSING City's housing element* The ELEMENT (701) City Clerk reported that notice of the hearing had been duly published and that no written protests had been received by the City. Planning Administrator Curtis Williams presented the staff report of September 4, 1990 and the recommendation that Council accept the public testimony, provide comments regarding the draft, direct staff to prepare appropriate revisions, and continue the public hearing until September 18, 1990. Lois Knight Larue, 3136 Barkentine, questioned the -4- SEPTEMBER 4, 1990 compliance of the housing element with regard to state requirements for low income housing. The City Clerk announced that the Rancho Palos Verdes Council of Homeowners Association presented a letter dated September 4, 1990 requesting clarification of several tables in the update. (Said letter is on file with the City clerk's office.) Councilwoman Bacharach moved, seconded by Councilman Hinchliffe and carried to approve the staff recommendation. Council briefly discussed the fact that staff would respond to appropriate revisions and add to the list for Council consideration. RESQL. NO. 90-71-,JOINT The City Manager presented the EXERCISE OF POWERS AGREEMENT September 4, 1994 memorandum BETWEEN THE CITY AND THE and the recommendation to adopt REDEVELOPMENT AGENCY (306) the proposed resolution approving a joint exercise of powers agreement with the Rancho Palos Verdes Redevelopment Agency. Lois Larue, 3136 Barkentine, stated her objections to the formation of this Authority. RESOL. NO. 90 -71 OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES APPROVING A JOINT EXERCISE OF POWERS AGREEMENT BETWEEN THE CITY OF RANCHO PALOS VERDES AND THE RANCHO PALOS VERDES REDEVELOPMENT AGENCY was presented by title and adopted on motion of Councilwoman Bacharach, seconded by Mayor Hughes and carried on the following roll call vote: AYES; McTAGGART, BACHARACH, & MAYOR HUGHES ABSTAIN: RYAN & HINCHLIFFE NOES: NONE RESQL. NO. 90 -72 - The City Manager presented the COUNTY IMPROVEMENT September 4, 1990 memorandum NO. 2651M (ABALONE and the recommendation to COVE) (1801) adopt the proposed resolution, RESOL. NO. 90 -72 OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES APPROVING ADDITIONAL MODIFICATIONS TO A RESOLUTION OF INTENTION IN THE MATTER OF COUNTY IMPROVEMENT NO. 2651 -M (ABALONE COVE) was presented by title and adopted on motion of Councilwoman Bacharach, seconded by Councilman McTaggart. The motion carried on the following roll call vote: AYES: BACHARACH, McTAGGART & MAYOR HUGHES ABSTAIN: HINCHLIFFE & RYAN NOES: NONE -5- SEPTEMBER 41 1990 LEASING OF SPACE AT CITY Director of Recreation and HALL SITE - POLICY FOR Parks Mary Thomas, presented CONTRACTOR (1201) the memorandum of.September 4th and the recommendation that the City Council adopt a policy providing for leased space on the City Hall site e to, contractors conducting business for the City, subject to the conditions identified. It was further recommended that a rate of $500 monthly or .07 per square foot whichever is greater be established. Council discussion centered on whether there was any advantage in having contractors leasing the site for storage of their equipment and material; whether this was an appropriate place to store equipment in light of the fact that it is a viewpoint; if other locations could be used for such storage* and, the fact that P. V. Transit busses are also stored at the site. Concern was also expressed about some of the fencing and double fencing that still exists in certain areas of the city. It was the consensus that staff should prepare a revised policy for this matter. ILLEGAL DUMPING Councilman Hinchliffe reported that he requested this item be placed on the agenda to see if anybody wanted to talk about the issue. Lois Larue, 3136 Barkentine, stated that she saw the dirt in question and that it was required by the people in that area who repair their roads. She stated her objection to the amount of staff time spent on this matter. PREPARATION OF COUNCIL The City Manager presented his POLICY MANUAL (306) memorandum of August 29, 1990 and the recommendation that a two member Council committee be appointed to advise staff in preparing a Council-Policy Manual for eventual review and approval by the entire City Council. Mayor Hughes appointed Councilwoman Bacharach and himself to the subcommittee. FIFTH TUESDAY MEETING IN City Manager Bussey reported OCTOBER (307) unless the budget has been reviewed prior to that date that a budget work session could be held on October 30, 1990. -6- SEPTEMBER 4. 1990 SALE OF PROPERTY Lois Larue, 3136 Barkentine, 5672 SUNMIST DRIVE (1101) requested clarification of the arrangements between the City Manager and the City for the purchase of the City-owned property at 5672 Sunmist Drive* The Council explained that it was desirous for the City Manager to live in the City and that this was part of Mr. Bussey's employment agreement. A brief discussion ensued regarding setting a cap of $75,000 for the renovations and amending the contract to allow the rental payments of $1,600 per month to go towards the purchase price of the property. Councilwoman Bacharach moved, seconded by Councilman Hinchliffe to authorize the Mayor and City Clerk to sign the agreement as amended for the sale of the property at 5672 Sunmist Drive.
