CC MINS 19920630M I N U T E S RANCHO PALOS VERDES CITY COUNCIL REGULAR MEETING JUNE 30, 1992 The meeting was called to order at 7:00 P.M. by Mayor John McTaggart at the Hesse Park Community Center, 29301 Hawthorne Boulevard. Following the Pledge of Allegiance to the flag, roll call was answered as follows: PRESENT: BROOKS, RYAN, KUYKENDALL, BACHARACH & MAYOR McTAGGART Also present were City Manager Paul Bussey, Deputy City Manager Mark Rohloff, Environmental Services Director Dudley Onderdonk, Public Works Director Trent Pulliam, Finance Officer Brent Mattingly, City Clerk Jo Purcell and Parks & Recreation Director Mary Thomas. APPROVAL OF THE AGENDA It was the consensus to conduct the Workshop on the Citywide Landscaping & Lighting District as the first item of business. The agenda as amended was approved on motion of Councilman Kuykendall, seconded by Councilwoman Brooks and carried. APPROVAL OF CONSENT CALENDAR Councilwoman Bacharach moved, seconded by Councilman Kuykendall to waive full reading of all ordinances and resolutions adopted at this meeting with consent to the waiver of reading deemed to be given by all councilmembers after the reading of the title.. CITYWIDE LANDSCAPING & LIGHTING MAINTENANCE DISTRICT (901) Summarizing the June 30, 1992 staff memorandum was Public Works Director Trent Pulliam who recommended that Council give further direction regarding certain policy issues in the Engineer's Report prior to its finalization. Jeff Cooper of BSI, summarized the elements that make up the implementation of this district which he reported was a financing mechanism for maintenance of parks, streets, street lighting and trails maintenance. With the use of maps depicting the various zones of the district Mr. Cooper summarized the assessments per Equivalent Dwelling Units (EDU's) for the seven zones within this proposed district and described the methodology developed to calculate the EDUs for the following classification of land uses: Single Family Residential; Multiple Residential; Commercial and Industrial; Vacant Residential; Vacant Non - Residential and Vacant - Moratorium. With regard to the assessment factor for Multiple Residential, Council questioned if the rate of .2 EDU for each dwelling over 10 units was too low and what this translated to in terms of dollar. Speaking in favor of this district was Elizabeth Kelley, 6611 Vallon Drive. Speaking in opposition to the rate of 1 EDU for single family residential units and .75 for multiple units was Lois Larue, 3136 Barkentine. Speaking in favor of this district was Barbara Dye, 7035 Hartcrest Drive. PROPOSED OPERATING AND CAPITAL IMPROVEMENT BUDGET - FISCAL YEAR 1992 -93 (602) Mayor McTaggart declared the public hearing open for the adoption of the budget for the fiscal year 1992-93. The City Clerk reported that notice of the public hearing had been duly published and that no written protests had been received. Presenting the staff memorandum of June 30, 1992 was City Manager Paul Bussey who reported the the budget resolutions as presented reflected staff's original proposed budget submitted on May 28 but that it would be adjusted for corrections and amendments as directed by the City Council following the two work sessions held on June 22 and June 27, 1992. In particular, Mr. Bussey alluded to the adjustment made to the budget reflecting the City Council's direction that additional funds be dedicated for Disaster Preparedness. Concluding his presentation, he recommended implementation of the MSI fee study and waiting to see how much revenue the City will be receiving from the State and how much of a gap that may exist. Council then proceeded to discuss segments of the proposed budget: Parks & Recreation: what the projected subsidy was for the last fiscal year versus the income and how that compared with the figures for the 1992 -93 fiscal year figures; if staff had bounded the exposure on this subsidy; if it would be known at mid -year budget review whether the subsidy had gone beyond the $200,000; and, if class fees could be restructured to cover 100% of the shortfall. Additional inquiries focused on the following: feasibility of making RPV Park an unmanned facility; and, structuring all programs to recover 100% of costs; and, with regard to the Therapeutic program if some kind of exception could be made to the subsidy level. Discussion concluded with the consensus that staff should prepare a recommendation on raising fees for the therapeutic program. RECESS AND RECONVENE At 9:10 P.M. the Mayor declared a recess. The meeting reconvened at 9:15 P.M. Maryls Kinnel, Executive Director of the Community Helpline, requested that the Council consider continuing financial support for the Helpline in light of its service to the community and particularly in light of the reductions that the Helpline has experienced in its contributions from other sources. Representing the Peninsula Seniors was its President Edith Mayerson, 28825 Trailriders, who requested that the City consider making a contribution of $3000 to them to help underwrite the cost of their directory and issuance of their monthly newsletter. Theresa Mossberg, 26600 Lightfoot Place, told the Council that her daughter has participated in the REACH program for over ten years; that parents are willing to pay 100% of the costs for these programs. Director of the Peninsula Seniors, Vicki Gausepohl, 32552 Via Baron, also spoke in favor of support for the Peninsula Seniors' directory. Elizabeth Kelley, 6611 Vallon Drive, spoke to several issues: her membership in the Peninsula Seniors, formation of the Neighborhood Watch Program and second story additions. Dr. Eva Muchnick, 63.07 Rio Linda Drive, said that a lot of users of the programs were not aware of the problems with the P &R fees and suggested that some other source of funding be sought. Lois Larue, 3136 Barkentine Road, spoke relative to the amount in the Quimby Fund; the fees being proposed for records /address file and records research. Barbara Dye, 7035 Hartcrest Drive, spoke in support of the R &P program and bringing them up to self - sufficiency. 2 CITY COUNCIL JUNE 30, 1992 J. J. D. McLaren, 3923 Palos Verdes Drive South, spoke to the issue of maintenance of P. V. Drive South. Carolyn Anthony, 30172 Avenida Tranquila, spoke in favor of the REACH program. Councilman Kuykendall moved, seconded by Councilwoman Brooks to close the public hearing. The motion carried. Councilman Ryan moved, seconded by Councilman Kuykendall that all Parks & Recreation classes be at 100% of their costs for the coming fall session. Discussion ensued regarding an acceptable level of subsidization; if the programs should be 90% or 75% self supporting; and, how quickly they should become 100% self-supporting. Councilwoman Bacharach moved a substitute motion, seconded by Councilwoman Brooks to follow the recommendation of the MSI study for recovery and have staff and the P &R Committee look at privatization of the P &R classes. The substitute motion carried on the following roll call vote: AYES: BROOKS, BACHARACH, & MAYOR McTAGGART NOES: RYAN & KUYKENDALL (at 10:30 P.M. Councilman Ryan left the meeting.) Council resumed discussion of certain budget issues in particular the amount of funding dedicated to Emergency Preparedness and whether there were any grants available for this program. The consensus was that staf f should report back with a recommendation on the various sources of funding for this matter. (At 10:35 P.M. Councilman Ryan returned to the meeting.) City Grants: Peninsula Seniors - Councilman Kuykendall moved, seconded by Councilman Ryan to eliminate this direct grant for this year to the Peninsula Seniors but continue to allow them the free use of the Hesse Park facility. A brief discussion then ensued as to whether this motion should be deferred until adoption of the State budget and an assessment made of its impact on the City's budget. Councilman Ryan moved, seconded by Councilwoman Brooks to table the motion. Motion carried. ESTABLISHMENT OF BUDGET FOR FISCAL YEAR 1992 -93 (602) A brief discussion then ensued about whether or not to adopt the proposed budget in light of the unknown impact that the State budget would have on the City. Councilman Kuykendall moved, seconded by Councilwoman Bacharach to spend at no more than the level of the proposed budget. The motion carried on the following roll call vote: AYES: BROOKS, RYAN, KUYKENDALL, BACHARACH & MAYOR McTAGGART NOES: NONE FEES FOR CITY SERVICES (602) Mayor McTaggart opened the public hearing on the adoption of a fee policy. The City Clerk reported that notice of the hearing had been duly published and that no written protests had been received. 3 CITY COUNCIL JUNE 30, 1992 In light of the situation with the budget, it was the consensus of Council to continue this public hearing until July 7, 1992. Payment of Appeal Fees: Councilman Kuykendall moved, seconded by Mayor McTaggart to modify the Municipal Code to indicate that the appellant be the "fee payer" and that the fee should be paid at the outset of the appeal process. Motion carried. Council then proceeded to review certain aspects of the proposed fee structure and requested staff follow -up on several items. S004 - Fence, Wall & Hedge Permit Review - Clarification of whether a fee should be imposed even if a view was not impacted. S -003 - Height Variation Review - Clarification at what stage of the appeal, i.e., staff level or Planning Commission hearing, an appeal fee is imposed. S -040 - Minor Application Appeal Processing - Clarification of what this fee covers. S -022 - Street Tree Permit Review - Clarification of what this fee covers. S -044 - View Restoration Permit Review - Council discussed whether this cost should be subsidized; the necessity of having an attorney at the View Restoration Committee Hearings; and, concluded with the request that staff determine how this process could be made less costly. S -048 - Address Change Review - Staff to clarify if this fee applies to one or two lots. S -062 - Loud Party Noise Abatement - Clarify if charge is for first time notification by the Sheriff. 5 -081 - Abalone Cove Shoreline Park Parking - After discussion of whether to delete the senior discount for off-season parking, Council requested that staff find out what the County charges. Building Permit Fees - Council requested that additional clarification of the minimum fee statement that will appear on the public document. Elizabeth Kelley, 6611 Vallon Drive, inquired if developers were required to cover the cost of wear and tear on roads. Councilwoman Bacharach moved, Seconded by Councilwoman Brooks to continue this matter until the July 7th meeting. Motion carried. Responding to the Mayor's call for audience questions for items not on the agenda was Lois Larue, 3136 Barkentine Road, who spoke about her efforts to have the Barkentine Canyon area cleared of brush.
