ADJOURNED REGULAR MEETING
The meeting was called to order at 9:00 A . M . by Mayor McTaggart in
the City Hall Community Room, notice having been given with
affidavit thereto on file. Roll call was answered as follows:
AYES: BROOKS, RYAN, KUYKENDALL, BACHARACH, AND MAYOR
McTAGGART
Also present were City Manager Paul D. Bussey, City Clerk Jo
Purcell, and Deputy City Manager Mark Rohloff.
RESOLUTION NOS. 92 -71 82 -81 92 -9 AND 92 -10 - CALLING AND GIVING
NOTICE OF THE SPECIAL ELECTION (501)
City Manager Bussey summarized the proposed ordinance for this tax
measure and explained why it was considered an excise tax and not
an ad valorem tax.
By way of teleconference, City Attorney Lynch gave background
information on establishing this tax that would be tied to the
level of municipal services to property within the City.
Council inquiries then focused on the amount of tax on undeveloped
lots and apartments; why this tax was considered an excise tax
instead of ad valorem; what organizations would be exempt from
paying this tax; and, if the tax on apartments should be $50 or
$75.
Councilman Ryan moved, seconded by Councilwoman Brooks to impose a
$75 tax on apartments. The motion carried on a four - one vote with
Councilwoman Bacharach voting in opposition.
Councilwoman Bacharach moved, seconded by Councilman Kuykendall to
impose a $50 tax on undeveloped parcels. The motion carried
unanimously.
Ballot Measure Wording - Councilwoman Brooks moved, seconded by
Councilwoman Bacharach that the ballot measure be worded as
stated in the City Attorney's January 9th letter. The motion
carried unanimously.
Finance Committee - Councilman Kuykendall moved, seconded by
Councilwoman Bacharach, to require that the proposed ordinance
contain the requirement that the City Council appoint a Long Range
Finance Committee which shall annually review the statement of the
City's financial condition and annually advise the City Council
regarding the City's financial condition and regarding the use of
the revenues derived from the excise tax imposed by this ordinance.
The motion carried unanimously.
Discussion then turned to the number of members that should be on
this Long Range Finance Committee whereupon Councilwoman Bacharach
moved, seconded by Councilman Kuykendall that the proposed
ordinance state that the Long Range Finance Committee have seven
members.
Mayor McTaggart moved an amendment, seconded by Councilwoman Brooks
that the proposed ordinance state that the committee be comprised
of not less than seven members. The motion as amended carried on
a four - one vote with Councilwoman Bacharach voting in opposition.
RESOLUTION NO. 92 -7 CALLING AND GIVING NOTICE OF THE HOLDING OF A
SPECIAL ELECTION TO BE HELD ON TUESDAY, APRIL 14, 1992 FOR
SUBMISSION TO THE VOTERS A QUESTION RELATING TO IMPOSING AN ANNUAL
EXCISE TAX was presented by title and adopted on motion of
Councilwoman Bacharach, seconded by Councilwoman Brooks and
carried.
RESOLUTION NO. 92 -8 REQUESTING THE BOARD OF SUPERVISORS OF THE
COUNTY OF LOS ANGELES TO RENDER SPECIFIC SERVICES TO THE CITY
RELATING TO THE CONDUCT OF A SPECIAL MUNICIPAL ELECTION TO BE HELD
ON TUESDAY, APRIL 14, 1992 was presented by title and adopted on
motion of Councilwoman Bacharach, seconded by Councilwoman Brooks
and carried.
RESOLUTION NO. 92 -9 PROVIDING FOR THE FILING OF REBUTTAL ARGUMENTS
FOR A CITY MEASURE SUBMITTED AT THE APRIL 14, 1992 SPECIAL
MUNICIPAL ELECTION was presented by title and adopted on motion of
Councilwoman Bacharach, seconded by Councilwoman Brooks and
carried.
RESOLUTION NO. 92 -10 AUTHORIZING CERTAIN OF ITS MEMBERS TO FILE A
WRITTEN ARGUMENT REGARDING A CITY MEASURE AND DIRECTING THE CITY
ATTORNEY TO PREPARE AN IMPARTIAL ANALYSIS was presented by title
and adopted on motion of Councilwoman Brooks, seconded by
Councilwoman Bacharach and carried.
It was the consensus that a meeting be held on Saturday, January 25
to approve the final version of the ballot measure.
FISCAL 1991 -92 BUDGET REDUCTIONS (602)
Council resumed discussion of budget items left over from the
January 4th meeting.
Summer Aquatics Program - Councilwoman Brooks moved, seconded by
Councilman Ryan to restore the aquatics program pending
satisfactory deliberations with the Palos Verdes Unified School
District.
A brief discussion ensued and comments were made relative to the

interest that the City of Rolling Hills Estates might have in
taking over this program, and the effect that failure of the parcel
tax may have on all recreation programs.
Councilwoman Bacharach moved an amendment, seconded by Councilwoman
Brooks that staff go ahead with planning the program but that
implementation be dependent upon passage of the parcel tax. The
motion as amended carried unanimously.
RECESS At 1:53 p.m. the Council
recessed. The meeting reconvened at 2:00 p.m.
INTERVIEW OF CANDIDATES
FOR CITY COMMITTEES (106)
The Council interviewed candidates for the various City committees.
No action was taken.
ADJOURNMENT
At 5:00 P.M. the meeting adjourned on motion of Councilman
Kuykendall, seconded by Councilwoman Brooks and carried.
