CC MINS 19920818M I N U T E S RANCHO PALOS VERDES CITY COUNCIL REGULAR MEETING AUGUST 18, 1992 The meeting was called to order at 7:00 P.M. by Mayor McTaggart, at the Hesse Park Community Center, 29301 Hawthorne Boulevard. Following the Pledge of Allegiance to the flag, roll call was answered as follows: PRESENT: BROOKS, RYAN, KUYKENDALL, BACHARACH AND MAYOR McTAGGART Also present were Deputy City Manager Mark Rohloff, Environmental Services Director Dudley Onderdonk, Senior Planner Carolynn Petru, City Attorney Carol Lynch, Public Works Director Trent Pulliam, Finance Officer Brent Mattingly, and City Clerk Jo Purcell. APPROVAL OF AGENDA Two items were added under City Council Reports: Update on State Budget and Update on Coastal Commission decisions (Mayor Pro Tem Brooks). It was the consensus of Council to move certain items forward and discuss after the public hearing: Rolling Hills Estates trail, and Permits for Student Parking. The amended agenda was approved on motion of Councilwoman Brooks, seconded by Councilman Kuykendall and carried. CONSENT CALENDAR After removal of the following items: Register of Demands; Lease for Palos Verdes Peninsula Transit Authority, and Citywide Landscaping & Lighting District, the Consent Calendar was approved as follows on motion of Councilwoman Bacharach, seconded by Councilwoman Brooks. Adopted a motion to waive full reading of all ordinances and resolutions adopted at the meeting with consent to the waiver of reading deemed to be given by all councilmembers after the reading of the title. AUCTION OF CITY VEHICLES (602) Authorized the auctioning of a 1982 Dodge passenger van. LEAGUE CONFERENCE RESOLUTION (306) Approved the proposed resolution requesting itemization of property tax statements for submittal to the League of California Cities for consideration at the annual conference by League delegates. LEGISLATION (306) Joined the National League of Cities in support of HR 5518 (SURFACE TRANSPORTATION ACT). TRACT NO. 46422 (ALIDA PLACE) - VACATION OF TRAIL EASEMENT (1411 X 1408) Accepted the request and directed staff to initiate vacation proceedings in accordance with Council Policy Resolution No. 90 -93. FEE WAIVER REQUEST - ST. JOHN FISHER CHURCH (1203) Approved the request and refund of fees in the amount of $65.00 associated with Sign Permit No. 577. The motion to approve the Consent Calendar carried on the following roll call vote: AYES: BROOKS, RYAN, KUYKENDALL, BACHARACH AND MAYOR McTAGGART NOES: NONE ABSENT: NONE PUBLIC HEARING: RESOL, N09 92 -86 HOUSING ELEMENT - GENERAL PLAN AMENDMENT NO. 20 Mayor McTaggart opened the public hearing on the General Plan Amendment No. 20, proposed amendment to the Housing Element of the General Plan. The City Clerk announced that notice of this public hearing was duly published. Environmental Services Director Onderdonk presented the staff memorandum of August 18, 1992 and the recommendation to adopt a resolution adopting a negative declaration pursuant to the California Environmental Quality Act and approving an amendment to the 1990 Housing element of the General Plan of the City of Rancho Palos Verdes. Summarizing the action taken by the City on this plan to -date, Director Onderdonk stated that the Element was adopted in 1990; that in 1991 it was reviewed by the State who requested that the analysis of special housing needs be expanded; that the analysis of parking constraints for multi- family housing be expanded; that affordable housing sites be identified; that programs to mitigate governmental constraints be identified; and, that the program descriptions be expanded. Council then commented that the noise attenuation standards referred to in draft amendment did not present a constraint to the development of affordable housing due to the fact that these standards are more a factor of design rather than cost. Assistant Planner Donna Jerex responded that the City's noise attenuation standards had been erroneously identified to the State as a possible constraint to the development of affordable housing, and that one method of rectifying the error was to remove the requirement for affordable housing projects. The City Attorney responded to the Council's concerns by stating that the entire discussion on noise attenuation would be removed from the final draft Assistant Planner Donna Jerex, clarified the City's noise standard and how the State objected to that requirement. A brief discussion ensued relative to the low cost of installing such noise attenuation and the benefits derived from it. Lois Larue, 3136 Barkentine Road, spoke to the Housing Element and summarized her critique of various sections of the document. Assistant City Attorney Michael Colantuono expounded on the use of the 1990 census figures; the fact that the housing element identifies every vacant site in the city even though many of them may be unbuildable; and, clarified how the noise elimination measure had been addressed. 2 AUGUST 18, 1992 There being no response to the Mayor's call for additional public testimony, Councilman Kuykendall moved, seconded by Councilwoman Brooks to close the public hearing. Motion carried. RESOLUTION NO. 92 -86 ADOPTING A NEGATIVE DECLARATION PURSUANT TO THE CALIFORNIA ENVIRONMENTAL QUALITY ACT AND APPROVING AN AMENDMENT TO THE 1990 HOUSING ELEMENT OF THE GENERAL PLAN OF THE CITY OF RANCHO PALOS VERDES was presented by title and adopted on motion of Councilwoman Brooks, seconded by Councilman Ryan. The motion carried on a 4 - 0 -1 vote with Councilwoman Bacharach abstaining. RHE TRAIL ON CRENSHAW (701) Deputy City Manager Rohloff presented the staff memorandum of August 18th to direct the Mayor and City Manager to meet with Rolling Hills Estates City representatives to discuss possible elimination or modification of the proposed trail. Representing the City of Rolling Hills Estates was Mayor Peter Weber who explained that his city has received a grant to build this trail; that it is part of their trail system; and, that they are proposing a riding and hiking trail with a three -rail fence and a chipped wood ground cover. He said that his city council was interested in hearing the concerns of the City of Rancho Palos Verdes about this trail. The exchange of comments between the City Council and Mr. Weber centered on the percentage of equestrian use versus pedestrian usage; if this area was indeed a safe place for an equestrian trail; if installation of the trail would increase its equestrian usage; and, whether the people at the end of the trail wanted horse trails in their area. Ray Mathys, 5738 Whiteclif f Drive, representing the Mesa Palos Verdes Homeowners Association referred to the August 14, 1992 letter received from the Mesa Palos Verdes Homeowners Association which cited the pedestrian use of the trail, the risk presented if pedestrians are deprived of the use of this walkway, and questioned where the horses would go once they reached Indian Peak Road. (This letter is on file with the City Clerk's Office.) He questioned that fact that this trail was approved as a pedestrian trail only by the City Council in 1988 and why it was later was designated a multi - purpose trail. Councilman Ryan moved, seconded by Councilman Kuykendall that this trail is not a compatible conjunction with Rancho Palos Verdes, that it is not needed and that it will impede high pedestrian usage. The motion carried on a 4 - 1 vote with Councilwoman Bacharach voting in opposition. Council discussion then turned to the conditions of approval for the Marriott project vis -a -vis the trails in the area and if an adjustment to those conditions was necessary. Councilman Ryan moved, seconded by Councilwoman Brooks to place on the next agenda the Marriott trails issue. Discussion next focused on whether the situation was one of correcting a clerical error in the record or changing the Conditional Use Permit for the project. Motion carried. More discussion followed which centered on the Conceptual Trails Plan and if that Plan should be studied by the Parks & Recreation Committee for clarification and removal of potential conflicts. It was the consensus of Council that the item of charging the Parks & Recreation Committee with review of this Plan should be placed on the next agenda. STUDENT PARKING PERMITS (1401) Public Works Director Pulliam presented the staff memorandum of August 18th and the recommendation to deny the request for direct issuance of parking permits from the City to the,PTSA but instead refer the PTSA to the local neighborhood volunteer permit issuers to implement the proposed program. 3 AUGUST 18, 1992 Representing the PTSA was Marty Haddad, 26766 Basswood Avenue, who distributed a flyer she had prepared to distribute to her neighbors requesting their cooperation with a controlled parking program for students attending Palos Verdes High School. This program would seek the permission of homeowners to allow student parking on streets where it is now prohibited. Accompanying the flyer was a map showing the location of the 16 parking spaces which had already been granted by residents in the area. Ms. Haddad requested Council approval of this proposed program. Frances Keches, 26926 Fond du Lac described the problems she has encountered with student parking in and around her home. In particular, Ms. Keches was concerned about the debris left by the students and about blockage of her driveway. Robert Gibson, 26727 Basswood, described the difficulty and problems encountered with monitoring the present permit system, especially the temporary passes. Council inquiries about this parking problem centered on who would pay for the administration of this PTSA sponsored program; and, who would pay for the decals. Councilwoman Bacharach moved, seconded by Councilman Ryan to approve the staff recommendation and give approval to this plan. Motion carried. George Haddad, 26766 Basswood, explained how these permits will be distributed and reiterated that this student parking would be allowed strictly at the pleasure of the homeowner. RESOL. NO. 92 -87 EXCHANGE OF PROP "A" FUNDS (1505 X 1501) Deputy City Manager Mark Rohloff presented the staff memorandum of August 18th and the recommendation to adopt a resolution authorizing the exchange of Proposition "A" Local Return Funds for General Funds. RESOLUTION NO. 92 -87 OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES AUTHORIZING THE EXCHANGE OF PROPOSITION "A" LOCAL RETURN FUNDS FOR GENERAL FUNDS was presented by title and adopted on motion of Councilwoman Brooks, seconded by Councilman Ryan; additionally, that the Mayor and City Clerk be authorized to execute the agreement with the City of Lancaster. Motion carried. RECESS AND RECONVENE At 9:00 P.M. the Mayor declared a recess: the meeting reconvened at 9:05 P.M. RESOL. NOS. 92 -88 & 89 - VIA COLINITA VEHICULAR USE RESTRICTION PROJECT (1502) Public Works Director Pulliam presented the staff memorandum of August 18 and the recommendation (1) to adopt a resolution making certain Environmental Findings in connection with Environmental Impact Report No. 34. (2) Adopt a resolution establishing stop regulations at various intersections in the Eastview area of the City of Rancho Palos Verdes, RESOL. NO. 92 -88 MAKING CERTAIN ENVIRONMENTAL FINDINGS IN CONNECTION WITH ENVIRONMENTAL IMPACT REPORT NO. 34 was presented by title and adopted on motion of Councilwoman Bacharach, seconded by Councilman Ryan and carried. RESOL. HO. 92 -89 ESTABLISHING STOP REGULATIONS AT VARIOUS INTERSECTIONS IN THE EASTVIEW AREA OF THE CITY OF RANCHO PALOS VERDES was presented by title and adopted on motion of Councilwoman Brooks, seconded by Councilman Ryan and carried. Councilwoman Bacharach moved, seconded by Councilwoman Brooks to approve an 4 AUGUST 18, 1992 amount not to exceed $2500 for the installation of signs. The motion carried on the following roll call vote: AYES: BROOKS, RYAN, KUYKENDALL, BACHARACH, & MAYOR McTAGGART. NOES: NONE NATURAL COMMUNITIES CONSERVATION PLANNING (NCCP) PROGRAM (1203) Environmental Services Director Onderdonk presented the staff memorandum of August 18th and the recommendation to adopt a resolution declaring the City's intent to enroll properties which are owned or managed by the City in the Natural Communities Conservation Planning (NCCP) Program. Additionally, he summarized the pros and cons of this program: if successful, the program may avoid listing gnatcatchers as endangered; more will be learned about the environment; and, it provides a mechanism for comprehensive habitat planning rather than a fragmented approach. On the con side, he stated that this program would create a stay on development until November 1993,(3*-.e., no processing of development applications) impose on the City the costs involved in the preparation of an EIR and the staff time to administer the program; and, that the program relies heavily on volunteer support. Council inquired how much streamlining this program would make in the environmental review process; whether the program would become mandatory rather than remain voluntary and requested that the Public Property list in the staff report be corrected to delete the Abalone Cove Shoreline Park property. Representing the Hon - Zuckerman group was Peggy Zuckerman, 2 El Portal, Palos Verdes Estates, who reported that the Zuckerman /Hon group has been working to get a prelisting agreement and are doing the same kind of study required by this program for their private land. (At 9:25 P.M. Councilman Ryan left the meeting.) Lois Larue, 3136 Barkentine Road, stated her support for this program and inquired why other areas containing coastal sagescrub were not listed. RESOLUTION NO. 92 -90 .DECLARING THE CITY'S INTENT TO ENROLL PROPERTIES WHICH ARE OWNED OR MANAGED BY THE CITY IN THE NATURAL COMMUNITIES CONSERVATION PLANNING (NCCP) PROGRAM was presented by title. Councilwoman Bacharach moved, seconded by Councilwoman Brooks to ADOPT RESOL. NO. 92 -90 with the understanding that Abalone Cove Shoreline Park would be deleted and that staff would work with private landowners to encourage them to go to the same level of study; also, that this process will become part of the City's environmental impact report process, Council discussion then focused on the potential financial impact of this program and the fact that the State does not yet provide funding for its implementation. The motion carried on the following roll call vote: AYES: BROOKS, RYAN, BACHARACH, & MAYOR McTAGGART NOES: KUYKENDALL GREEN WASTE PROGRAM (1301) Deputy City Manager Rohlof f presented the staff memorandum of August 18th and the recommendation to authorize the implementation of a pilot yard (green) waste 5 AUGUST 18, 1992 program as proposed for single family residences. The Green Waste Pilot Program Schedule was discussed and it was the consensus that the calendar for the next phase would have to be revised and that the subcommittee (Brooks /Ryan) should consider such issues of automation and variable size containers for the implementation of this program on a citywide basis. Councilman Kuykendall moved, seconded by Councilwoman Bacharach to adopt the staff recommendation and that the schedule be revised for the next phase of the program. Motion carried. BUS STOP LOCATIONS /PVE FIXED ROUTE SYSTEM (1505) Referring to her August 18, 1992 report concerning bus stop locations for the Palos Verdes Fixed Route System, Councilwoman Bacharach expressed concern about the lack of notification to the affected homeowners along this proposed fixed route and said she would like the neighborhoods notified. The main focus of Council discussion was the fact that this was a test program and, no doubt, would be subject to change as experience was gained with the system. Council expressed concern with the portion of the proposed f ixed route traversing Basswood which would result in a significant increase in traffic through this neighborhood. Accordingly, an alternate route was suggested, along Montemalaga to Silver Spur then along Silver Spur to Hawthorne. Councilman Ryan agreed to contact the RTD to attempt to resolve any conflict with the fixed RTD route along Silver Spur with respect to the proposed rerouting of the JPA shuttle along Silver Spur. Robert Gibson, 26727 Basswood, suggested several changes that could be made to this schedule of bus stops. It was also agreed that Councilman Kuykendall would present the public notification concerns to the board of the Joint Powers Authority (JPA). JPA Administrator George Wentz, stated that this fixed route plan had been approved by the Palos Verdes Estates City Council. RESOL. NO. 92 -91 - REGISTER OF DEMANDS After a brief discussion by Council of whether it was possible to withhold certain warrants payable to the State of California Councilwoman Bacharach moved, seconded by Councilman Ryan to adopt RESOL. NO. 92 -91 ALLOWING CERTAIN CLAIMS AND DEMANDS AND SPECIFYING FUNDS FROM WHICH THE SAME ARE TO BE PAID. The motion carried on the following roll call vote: AYES: BROOKS, RYAN, KUYKENDALL, BACHARACH & MAYOR McTAGGART NOES: NONE EXCEPTION: KUYKENDALL AND MAYOR McTAGGART ON REMITTANCE OF SALES TAX TO THE STATE OF CALIFORNIA PV JOINT POWERS TRANSIT AUTHORITY - APPROVAL OF LEASE FOR FIXED ROUTE VEHICLES (1505) After amending the proposed resolution to include a statement that the City of Palos Verdes Estates commit itself to fund the lease and operation costs of the service, RESOLUTION NO. 92 -92 APPROVING A LEASE BY THE PV TRANSIT AUTHORITY FOR FOUR VEHICLES TO BE USED FOR FIXED ROUTE SHUTTLE SERVICE was adopted on motion of Councilman Kuykendall, seconded by Councilwoman Bacharach and carried. 6 AUGUST 18, 1992 CITYWIDE LANDSCAPING & LIGHTING DISTRICT (901) Councilman Ryan moved, seconded by Mayor McTaggart to reconfirm adoption of Resolution No. 92 -84 Establishing a limit on the term of the citywide landscaping and lighting maintenance district and Resol. No. 92 -85 ordering the formation of the Citywide Landscaping and Lighting District. The motion carried unanimously. CITY COUNCIL REPORTS Update on Adoption of State Budget Mayor Pro Tem Brooks reported on the various budget scenarios that were being discussed in Sacramento. She stressed the importance of lobbying on behalf of cities. Update on Coastal Commission Decisions Mayor Pro Tem Brooks summarized the action taken by the Coastal Commission in requiring more public access for the Hon /Zuckerman project in Subregion 7 and 8. �*4.11V wlil-•lM1340 *x y00* No changes were made to the document presented.
