CC RES 1984-076RESOLUTION N0. 84 -76 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES REQUESTING THE BOARD OF SUPERVISORS OF THE LOS ANGELES COUNTY FLOOD CONTROL DISTRICT OF THE STATE CALIFORNIA TO ACCEPT ON BEHALF OF SAID DISTRICT A TRANSFER AND CONVEYANCE OF STORM DRAIN IMPROVEMENTS KNOWN AS PRIVATE DRAIN NO* 1686 IN THE CITY OF RANCHO PALOS VERDES FOR FUTURE OPERATION, MAINTENANCE, REPAIR AND IMPROVEMENT, AND AUTHORIZE THE TRANSFER AND CONVEYANCE THEREOF. WHEREAS, there have been dedicated to, or the City has otherwise acquired, the storm drain improvements and drainage system known as Private Drain No. 1686, described in Exhibit A attached hereto; and WHEREAS, the City is authorized and empowered to transfer and convey to the Los Angeles County Flood Control District any storm drain improvements and drainage systems for future operation, maintenance, repair, and improvement; and WHEREAS, the City and the Los Angeles County Flood Control District entered into an agreement dated March 31, 1981, and recorded April 16, 1981 as Document Number 81-384580, of the Official Records in the office of the County Recorder for the County of Los angeles, whereby the City made certain warranties about its future transfers and conveyances of Flood Control facilities to the District; and WHEREAS, the best public interest will be served by transfer and conveyance of the storm drain improvements and drainage system described in Exhibit A attached hereto from the City to the Los Angeles County Flood Control district for future operation, maintenance, repair, and improvement. NOW, THEREFORE, BE IT RESOLVED THAT THE CITY OF RANCHO PALOS VERDES DOES HEREBY REQUEST the Los Angeles County Flood Control District to accept the transfer and conveyance of the storm drain improvements and drainage system described in said Exhibit A. BE IT FURTHER RESOLVED THAT, subject to the acceptance thereof of the Board of Supervisors of the Los Angeles County Flood Control District, the City Engineer is directed and ordered to prepare all necessary instruments and documents, including deed, to effectuate said transfer and conveyance, and that the Mayor is authorized and instructed to execute said deed and other instruments and documents. District shall have no obligation or responsibility to maintain said storm drain, improvements, and drainage until all rights of way for said drain now vested in the City and all other necessary rights of way therefore have been conveyed to and accepted by District. Reference is hereby made to District Drawings Nos. 368 -F19.1 and 368- F19.2, the plans and profile of said storm drain improvements and drainage system on f ile in the of f ice of the City Engineer and on file in the of f ice of the Chief Engineer of said District for further data as to the exact location, extent, and description of said storm drain improvements and drainage system. #701X -A29 BE IT FURTHER RESOLVED that the transfer and conveyance hereby requested are subject to each of the warranties described in the Agreement between the City and the District dated March 31, 1981, and recorded April 16, 1981, as Document Number 81-384580, of the Official Records in the Office of the County Recorder for the County of Los Angeles. Such warranties by the City are incorporated here by this reference. The City Clerk shall certify to the adoption of this Resolution. PASSED, APPROVED and ADOPTED December 18, 1984. City Clerk, (j'ity of Rancho Palos Verdes Page Two Resolution No. 84 -76 #701X -A30 EXHIBIT A Private Drain No. 1686 A reinforced concrete pipe storm drain system and appurtenant structures in Tract No. 39672, filed in Book 998, pages 94 to 97 inclusive, of Maps, Records of the County of Los Angeles, generally described as follows: Main Line: Commencing from a trapezoidal channel, Station 0 +09.50, located in a 20 -foot- wide and variable width storm drain easement, which lies within Lot 12 of said tract; thence northwesterly and northerly in said easement to a 10- foot -wide storm drain easement, which lies within Lots 1 to 5 inclusive, of said tract; thence northerly and northeasterly in last said mentioned easement to a variable width storm drain easement, which lies within Lot 12 of said tract; thence northeasterly in last said mentioned easement 0 a 10- foot -wide storm drain easement, which lies within Lots 6 to 11 inclusive, of said tract; thence northeasterly, easterly and southeasterly in last said mentioned easement to a manhole structure, Station 13 +23.28, a distance of 1,314 feet, more or less.
