A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF RANCHO PALOS VERDES AMENDING CONDITION
N0. 22 OF EXHIBIT "A" OF RESOLUTION P.C.
NO. 86 -23, APPROVING CONDITIONAL USE PERMIT
N0. 105, VARIANCE N0, 134 AND GRADING N0. 875
WHEREAS, on September 30, 1985, the Planning Commission of the City of
Rancho Palos Verdes adopted Resolution P.C. No. 86 -23 approving Conditional
Use Permit No. 105, Variance No. 134 and Grading No. 875 for a commercial
office building to be located at 976 and 978 Silver Spur Road, Rancho Palos
Verdes; and
WHEREAS, on October 14, 1986, Mr. Albert Levitt filed an appeal of Con-
dition No. 22 of Exhibit "A" of Resolution P.C. No. 86 -23 within 15 days of
the Planning commission's action; and
WHEREAS, pursuant to the Development Code of the City of Rancho Palos
Verdes, the City Council held a public hearing on Tuesday, December 2, 1986
to consider said appeal, at which time all interested parties were given an
opportunity to be heard and present evidence.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES
DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS:
Section 1: That the proposed development is located on a site which
has unique topographic and geologic features and requires special construc-
tion techniques to insure the safety of the properties above the develop-
ment.
Section 2: That Condition No. 22 is necessary to protect the health,
safety and general welfare of the adjacent property owners, in that it pro-
vides protection for loss of land and improvements to said owners.
Section 3: In order to protect the interests of said owners, Condition
No. 22 is hereby amended as follows:
The applicant shall post an insurance policy or a cash deposit, bond or
combination thereof to indemnify the owners of the approximately nine resi-
dential properties immediately above the project site against any damages
suffered as a result of land movement resulting from construction of the
project; from the commencement of construction /grading activities through
the final approval of building permits and issuance of certificates of
occupancy. The amount of said insurance or security for property damage
shall be based on the market values of the subject residential properties.
The values shall be determined by a qualified real estate appraiser select-
ed by the applicant and approved by the Director of Environmental Services.
The applicant shall pay the cost of the appraisals,

Section 4: For the foregoing reasons, the City Council of the City of
Rancho Palos Verdes hereby amends Condition No. 22 of Exhibit "A" of Reso-
lution P.C. No. 86 -23, as worded in Section 2 above, which is necessary to
protect the health, safety, property and improvements, and general welfare
of the area.
