CC RES 1986-075RESOLUTION NO. 86- 75 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALO S VE RDE S DENYING THE APPEAL OF HEIGHT VARIATION NO, 446 THEREBY APPROVING THE PROJECT AT 26138 BARKSTONE DRIVE WHEREAS,, the Director of Environmental Services approved Height Varia- tion No. 446 for a second story addition located at 26138 Barkstone Drive; and WHEREAS, on June 16, 1986, Mr. Robert Eaton file an appeal to the Plan- ning Commission within 15 days of the decision of the Director of Environ- mental Services; and WHEREAS, the Planning Commission of the City of Rancho Palos Verdes heard the appeal on August 12, 1986, at which time it denied the appeal of Height Variation No. 446, thereby approving the proposed project; and WHEREAS, on August 18, 1986, Mr. Robert Eaton file an appeal to the City Council within 15 days of the decision of the Planning Commission; and WHEREAS, on October 7. 1986 , the City Council determined that the ap- peal had merit and directed staff to schedule Height Variation No. 446 ap- peal for a hearing; and WHEREAS, on November 5, 1986, the City Council considered the appeal of Height Variation No. 446 at which time all interested parties were given an opportunity to be heard and present evidence. NOW, THEREFORE , THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS: Section 1: The proposed structure is designed and situated in such a manner as to minimize view obstruction by continuing the height and pitch of the existing roof line . Section 2: View impairment for the portion of the proposed addition over sixteen feet high does not significantly impair the primary view from the four properties immediately south of the subject parcels which were identified as having a view as set forth in the City's Development Code. Section 3: The proposed structure is not located on a ridge or promon- tory. Section 4: The structure does not significantly impair a view or vista from public property (parks, major thoroughfare, bikeways, walkways, eques- trian trails, etc . ) which has been identified in the City's general plan, coastal plan, or City - approved viewing areas. 700CP /RES9.1 Section 5: There is no significant cumulative impact caused by grant- ing the application. Section 6: that after consideration of the appeal of Height Variation No. 446 on November 5, 1986, the City Council denied the appeal and thereby approved the project at 26123 Barkstone Drive. PASSED , APPROVED , AND ADOPTED on November 18 , 1986 .
