A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF RANCHO PALOS VERDES UPHOLDING THE DECISION
OF THE PLANNING COMMISSION ON THE APPEAL OF
HEIGHT VARIATION N0, 423 THEREBY APPROVING
THE PROJECT AT 2070 MACARTHUR STREET
WHEREAS, the Director of Environmental Services approved Height Varia-
tion No. 423, for a second story addition located at 2070 MacArthur Street;
and
WHEREAS, on December 20, 1985 the decision of the Director of Environ-
mental Services was appealed to the Planning Commission; and
WHEREAS, the Planning Commission of the City of Rancho Palos Verdes
heard the appeal on March 11 and March 25, 1986, at which time it denied
the appeal of Height Variation No. 423, thereby approving the proposed pro-
ject; and
WHEREAS, Mr. William Harvey filed an appeal within 15 days of the Plan-
ning Commission decision; and
WHEREAS, on July 15, 1986, the City Council considered the appeal of
the Planning Commission decision on the appeal of Height Variation No. 423
at which time all interested parties were given an opportunity to be heard
and present evidence.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES
DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS:
Section 1: The proposed structure is designed and situated in such a
manner as to minimize view obstruction.
Section 2: View impairment for that portion of the proposed addition
over sixteen feet high does not significantly impair the primary view from
property or properties identified as having a view as set forth in the
City's Development Code.
Section 3: The proposed structure is not located on a ridge or promon-
tory.
Section 4: The structure does not significantly impair a view or vista
from public property (parks, major thoroughfare, bikeways, walkways, eques-
trian trails, etc.) which has been identified in the City's general plan,
coastal plan, or City- approved viewing areas.
Section 5: There is no significant cumulative impact caused by grant-
ing the application.

Section 6: That after consideration of the appeal on July 15, 1986,
the City Council upheld the decision of the Planning Commission on the ap-
peal of Height Variation No. 423, thereby approving the. project 2070 MacAr-
thur Street,
Section 7: This approval is conditioned upon the removal of the olive
tree in the rear yard of 2070 MacArthur Street. Furthermore, no new trees
shall be planted in the rear yard to replace said olive tree.
PASSED, APPROVED and ADOPTED on August 5, 1986.
