CC RES 1985-074RESOLUTION N0, 85 -74 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VE RDE S APPROVING SITE PLAN REVIEW APPLICATION N0. 3378 WHEREAS, Mr. Josef Kubicek has requested site plan approval for an existing storage structure within an Open Space Hazard Zone at 18 La Vista Verde, Rancho Palos Verdes, and; WHEREAS, an informal hearing was held on December 3, 1985 at which time all interested parties were given an opportunity to be heard and present evidence NOW, THEREFORE , THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY RESOLVE, DETERMINE , AND ORDAIN AS FOLLOWS: Section 1: That the existing storage structure was built without City approval during 1975 in what is now an Open Space Hazard Zone. Section 2: That the existing storage structure has had a minimal impact on the surrounding open space hazard land and that the structure is not located on an extreme slope. Section 3: That the existing structure substantially complies with the criteria set forth in Section 17.30.040 B of the Development Code governing the construction of such structures. Section 4: For the foregoing reasons, the City Council of the City of Rancho Palos Verdes hereby approves Site Plan Review No. 3328, subject to the conditions in Exhibit "A ", attached hereto, which are necessary to pro- tect the public health, safety and welfare. A lot line adjustment between #18 La Vista Verde and #19 La Vista Verde, pursuant to City regulations, must occur, before May 17, 1986 to accomplish this, (2) After the lot line has been adjusted, as discussed in Condition No. 1, the existing storage structure must be in compliance with City build- ing setback regulations. (3) Access.rights to the subject structure from #18 La Vista Verde, by way of an existing hillside driveway that traverses the lot line of the adjacent property, must be guaranteed through recordation of an ease- ment or adjustment of lot lines before May 17, 1986. (4) Building permits, with geology reports as may be required by the City .Geologist, must be obtained for the subject structure and adjacent septic tank before May 17, 1986. (5) The applicant shall prepare and record an agreement waiving any poten- tial liability the City might incur that is related to the issuance of building and zoning approval for this project. (6) The applicant shall prepare and record an agreement, prohibiting the use of the subject structure as a dwelling unit. (7 ) The maximum area of the subject structure shall not exceed 400 square feet unless .a Variance is approved by the Planning Commission before May 17, 1986. (8) The existing tennis court lights adjacent to the subject structure must either be immediately removed or a Conditional Use Permit must be approved by the Planning Commission before May 17, 1986.
