THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES HEREBY RESOLVES FINDS
AND DETERMINES AS FOLLOWS:
Section 1: That the pedestrian easement located at 5306 Valley
View Road in the City of Rancho Palos Verdes, as described in Exhibit "A"
attached hereto and made a part hereof by reference, is hereby vacated.
Such vacation is made pursuant to Chapter 4 of Part 3, Division 9 of the
Streets and Highways Code of the State of California (Secs. 8330, et seq.).
Section 2: The City Council finds and determines that the pedes-
trian easement at 5306 Valley View Road was created by deed recorded
March 27, 1980. This pedestrian easement was created for purpose of access
to La Cresta Elementary School, which was closed prior to recordation of
this easement and has remained closed thereafter. For that reason, this
vacated easement has not been used for the purpose for which it was
dedicated or acquired for five (5) consecutive years immediately preceding
the adoption of this resolution.
Section 3: In considering this vacation, the City Council has
found it to be in conformance with the General Plan.
Section 4: The City Council finds that the vacated pedestrian
easement is not useful as a non-motorized transportation facility.
Section 5: The City Council finds that there are no in-place
improvements for pedestrian access purposes in the vacated easment that are
in use and would be affected by the vacation.
