CC RES 1987-039RESOLUTION N0. 87- 39 A RESOLUTION OF THE CITY COUNCIL OF THE RANCHO PALOS VERDES APPROVING THE DRAFT NEGATIVE DECLARATION FOR ENVIRONMENTAL NO 524 AND AN AMENDMENT TO RESOLUTION FOR TENTATIVE TRACT MAP NO. 44514 CITY OF ASSESSMENT N0. 87 -10. WHEREAS, Wallace Ranch Associates, developers of Tentative Tract Map No. 44514., have requested an amendment to Conditions Nos. 38 and 39 of Resolu.tion.No...87 -10, approving said Tentative Map; and WHEREAS, said amendment would allow Wallace Ranch Associates to build a replica of Don Wallace Sr.'s former residence rather-than--moving =aiid= re= ha -b -il- tating the existing structure; and WHEREAS, after notice pursuant to the California Environmental Quality Act (CEQA), a public hearing was held on Tuesday, June 16, 1987 at which time all interested parties were given the opportunity to testify. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS: Section 1: That the proposed Amendment of Conditions No.s 38 and 39 of Resolution No. 87 -10, would not result in any significant, adverse impacts as defined in CEQA, subject mitigation measures which have been incorporated into Exhibit "A ", attached hereto and made a part hereof by reference. Section 2: That a Draft Negative Declaration has been prepared for the proposed amendment, which addresses ,.a -11 - issues , related to the said amendment,, pursuant t -o, the,. - provisions of CEQA. Section 3: That a replica of Don Wallace Sr.'s former residence is an appropriate alternative for providing a museum /meeting facility to commemorate Mr. Wallace's achievements, and that said replica will - q_ua -lify for the California Historical Landmark and-Point.- of-Historical Interest Programs. Section 4: For the foregoing reasons, the City Council M of the City of Rancho Palos Verdes hereby approves the Draft Negative Decl- aration for Environmental Assessment No. 524, and amends Conditions Nos. 38 and 39 of Resolution No. 87 -10 as follows: a.(38) The developer shall construct a replica of equal size of Don Wallace Sr.'s former residence (excluding the garage). Said replica shall incorporate distinctive features of Mr. Wallace residence, specifically, the veranda, the front window pattern and configuration and the fireplace. Further the developer shall provide, at its own expense, the shell of the building with plaster exterior, interior dry wall and roof. The City of Rancho Palos Verdes will pay to the developer the cost of the shell foundation, sewer and utility hookups, plumbing, electrical and all interior improvements. The developer shall construct the subject building designed in a mutually agreed upon style and the above outlined breakdown of expenses will be borne by the City and the developer, Construction of said replica shall commence no later than the issuance of the first building permit for a residential structure for Tract No. 44514. b.(39) The City shall have the right to finish the interior of the subject building to its specifications immediately following the completion of the shell. PASSED, APPROVED and ADOPTED on June 16, 1987.
