CC RES 1988-071RESOLUTION NO, 88 - 71 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES DENYING THE APPEAL OF HEIGHT VARIATION NO, 529 THEREBY APPROVING THE PROJECT AT 29010 MAPLEPARK DRIVE, WHEREAS, the Director of Environmental Services approved Height Variation No. 529 for a two story addition located at 29010 Maplepark Drive; and WHEREAS,, on April 1, 1988 Beatrice Rasof et. al. filed an appeal with the Planning Commission within 15 days of the decision of the Director of Environmental Services; and WHEREAS, on June 28, 1988, the Planning Commission denied the appeal, thereby upholding staff approval of the two story addition; and WHEREAS,, on July 13, 1988, the Planning Commission decision was appealed by Beatrice Rasof et. al. to the City Council within 15 days of the decision of the Planning Commission* and WHEREAS, on September 20, 1988 and October 4, 1988 the City Council heard the appeal at which time all interested parties were given an opportunity to be heard and present evidence,, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RANCHO PALOS -0 VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS. Section 1: That the proposed structure is designed and situated in such a manner as to minimize view obstruction since the addition is located on the west side of the existing structure and has been designed with a hipped roof. Section 2. That any view impairment for the portion of the proposed addition over sixteen feet high does not significantly impair the primary view from the four properties east of the subject parcel which were identified as having a view over the subject parcel as set forth in the City's Development Code, Section 3: That the proposed structure ridge or promontory. Section 4: That the structure does not a view or vista from public property (parks, bikeways, walkways, equestrian trails, etc.) identified in the City's General Plan, Coast City-approved viewing areas, is not located on a significantly impair major thoroughfare, which has been al Specific Plan, or Section 5: That there is no significant cumulative impact caused by granting the application. Section 6.* That after consideration ' of the appeal of Height Variation No. 529 on September 20, 1988 and October 4, 1988, the City Council denied the appeal and thereby approved the project at 29010 Maplepark Drive subject to the conditions of approval attached in Exhibit "A",, PASSED, APPROVED and ADOPTED on November 15, 1988* 0 ATTEST. The project design shall conform to scheme #4 as submitted by the landowner, except that the balcony shall be eliminated from the rear elevation of the addition, 2. The maximum height of the second story addition shall not exceed 19 feet 9 inches, 3, A single story addition to the rear of the residence is not precluded, 4. The landowner shall remove the large trees in the front yard, the tree in the northeast corner of the rear yard and the large bushes in the northeast corner of the rear yard, 5, The landowner shall submit a covenant running with the land limiting the height of all vegetation on the property to 16 feet prior to the issuance of building permits, Resolution No. 88 -71 Page 3
