A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF RANCHO PALOS VERDES INSTITUTING PROCEED -
INGS, ACKNOWLEDGING WAIVER OF DEBT LIMIT, IN-
VESTIGATION PROCEEDINGS AND DIRECTING PREPARA-
TION OF A RESOLUTION OF INTENTION FOR THE CON -
VERSION OF EXISTING OVERHEAD ELECTRIC AND COM-
MUNICATION FACILITIES IN THE AREA BOUND BY
NANCY ROAD, LORRAINE RD. AND MIRALESTE DR. AND
OTHER RIGHTS -OF -WAY.
WHEREAS, a petition for proceedings for conversion of exist-
ing overhead electric and communication facilities to underground
locations in the residential area bound by Nancy Road, Lorraine
Road and Miraleste Dr. and waiver of the Special Assessment In-
vestigation, Limitation and Majority Protest Act of 1931 being
Division 4, of the California Streets and Highways Code, signed
by persons representing ownership of 660 of the area of lands in
the district hereinafter proposed to be assessed for the improve-
ments, has been presented to the City Council of the City of
Rancho Palos Verdes; and
WHEREAS, said petition has been signed by more than five
owners of assessable land in the proposed assessment district, as
shown by the last equalized assessment roll used by the City,
owning lands constituting more than one -half of the area of all
assessable lands within the proposed assessment district thereby
satisfying the requirements of Section 5896.6 of the Streets and
Highways Code of the State of California; and
WHEREAS, the City Clerk of the City of Rancho Palos Verdes
has, subsequent to the checking of said petition, executed a cer-
tificate of sufficiency and has presented said petition and cer-
tificate to the City Council in compliance with the requirements
of Sections 5896.7 and 5896.8 of the Streets and Highways Code;
and
WHEREAS, it is desirable that the City of Rancho Palos
Verdes now institute proceedings and direct preparation of a
resolution of intention for the proposed improvements.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RANCHO PALOS
VERDES HEREBY FINDS, ORDERS, RESOLVES AND DETERMINES THAT:
1. The public interest and convenience require proceedings
for conversion of existing overhead electric and communication
facilities to underground locations in the residential area bound
by Nancy Road,. Lorraine Road and Miraleste Dr. within the assess-
ment district proposed therefor, substantially as indicated on
the map attached to the petition requesting the improvements.
2. That said petition filed with the City Council is ade-
quate and signed by the required number of owners to initiate
proceeding for the formation of a proposed assessment district to
pay for the cost and expenses of the conversion of existing over-
head electric and communication facilities to underground loca-
tions and to waive the debt limitations and other requirements
prescribed by Division 4 of the Streets and Highways Code and by
virtue of such petition, the provisions of said Division 4 do not
apply to these proceedings.
3. Proceedings are hereby instituted for the formation of
a proposed assessment district pursuant to the provisions of the
Municipal Improvement Act of 1913, Division 12 of the California
Streets and Highways Code, commencing with Section 10000 to pay
for the cost and expenses of the conversion of existing overhead
electric and communication facilities to underground locations in
the residential area having the boundaries of Nancy Road, Lor-
raine Road and Miraleste Dr. and other rights -of -way and ease-
ments within the assessment district proposed therefore, substan-
tially as indicated on the map attached hereto, marked Exhibit
"A" and incorporated herein.
4. The lands proposed as part of the assessment district
and which shall be specially assessed to pay the cost of said im-
provements shall include in general the area included within the
boundary line as shown on said map attached hereto as Exhibit A.
5. This project shall be known as Nancy Road Underground -
ing District,
6. The Special City Engineer is hereby appointed and
designated as Assessment Engineer in connection with such
proceedings and is hereby requested to prepare the resolution of
intention, all other necessary resolutions, reports, plans,
specifications, estimates, maps, notifications, proposal forms,
contract forms, bond forms, and any other acts, service or forms
necessary to complete this project in accordance with the provi-
sions of Division 7 of the Streets and Highways Code under which
the proceedings are to be conducted.
7e Mr. George Wentz , Director of Public Works, is hereby
appointed and designated to perform all of the duties and func-
tions of the Superintendent of Streets in connection with such
proceedings as such duties and functions are described in the
Act.
90 The Special City Engineer is hereby- directed to nego-
tiate agreements with the Southern California Edison Company,
Pacific Bell and T.M. Cablevision which shall provide among
other things for the supplying of plans and specifications, said
agreements to be in accordance with the provisions of Section
5896.9 of the Streets and Highways Code.
