A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF RANCHO PALOS VERDES DENYING AN
APPEAL OF COASTAL PERMIT NO. 45, GRADING
NO. 1098 AND VARIANCE NO. 195 FOR THE
APPROVAL OF AN ADDITION TO AN EXISTING
RESIDENCE IN THE RS -11 RPD ZONE DISTRICT
AT 31045/65 MARGUERITE DRIVE.
WHEREAS, the Planning
Commission on April 26, 1988 adopted
P.C. Resolution 88 -27 approving Coastal Permit No. 45 and Grading
Application No. 1098 and adopted-P.C. Resolution 88 -28 denying
Vari ance No. 195 for an addition to an existing single family home
on property located at 31045/65 Marguerite Drive (Lot 1, Parcel
y
Map No. 12431).
WHEREAS... Harold Levitt and Associates has requested an appeal
of a Coastal Permit No. 45, Variance No. 195 and Grading
Application No. 1098.
WHEREAS ' after notice issued pursuant to the provision of the C
it y 's Development Code, a public hearing was held July 19, 1988
at which time all interested parties were given an opportunity to
be heard and to present evidence.
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF RANCHO PALOS
VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS:
Section 1: As conditioned, the proposed development is in
conformance with the Coastal Specific Plan.
Section 2: As conditioned, the proposed development which is
located between the sea and first public road, is in conformance
with the applicable public access and recreation policies of the
Coastal Act.
Section 3: As conditioned, the grading is not excessive
beyond that necessary for the permitted primary use of the lot,
does not significantly adversely affect the visual relationship
with, nor the views from neighboring sites.
Section 4: That there are no exceptional or extraordinary
circumstances or conditions that exist relative to this property
which do not apply generally to other properties in the same
district in that the property is presently vacant and said
improvements can be reasonably accommodated on the site through a
redesign of the site plan and floor plan.
Section 5: That such Variance is not necessary for the
preservation and enjoyment of a substantial property right of the
applicant which right is possessed by others under like
circumstances in the same zoning district since other properties
would be limited to the same restrictions and square footage
limitations of the Coastal Specific Plan,
Section 6: That the granting of such a Variance would result
in adverse effects to the public welfare of the surrounding
development patterns because the addition would significantly
encroach into areas designated'` for no new permanent structures
intended to remain in natural open space.
Section 7: That the granting of such a Variance will be
contrary to the objectives of the General Plan and Coastal
Specific Plan that discourage development greater than 250 square
feet from encroaching into the bluff setback area.
Section 8. For the foregoing reasons, the City Council of
the City of Rancho Palos Verdes hereby denies the appeal of
Planning Commission Resolution 88 -27 and 88 -2$. This action has
been deemed necessary to protect the public health, safety and
general welfare and will make possible development of the City in
an orderly and efficient manner and in conformity with the intent
and purposed set forth in the Development Code and the Coastal
Specific Plan.
