A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF RANCHO PALOS VERDES DENYING THE APPEAL OF
CONDITION NO* 1 FROM CONDITIONS OF APPROVAL OF
VARIANCE NO* 193 AND ENCROACHMENT NO* 11
AT 2702 AZORES PLACE*
WHEREAS, on March 22, 1988, the Planning Commission approved
Variance No. 193 and Encroachment Permit No. 11, subject to
conditions on property located at 2702 Azores Places.
WHEREAS, "George Petrus, has submitted an Appeal of Condition
No. 1 of the above applications in conformance with Section
17,60,060 of the City's Development Code.
WHEREAS, after notice pursuant to the City's Development
Code, a public hearing was held on July 19, 1988, at which time
all interested were given an opportunity to be heard and present

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RANCHO PALOS
VERDES DOES, HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS:
Section 1: That there are exceptional or extraordinary
circumstances or conditions that exist relative to this property
which do not apply generally to other properties in the same
district in that the subject property's backyard is lower than
adjoining properties and the adjacent street grade.
Section 2** That such Variance is necessary for the
preservation and enjoyment of a substantial property right of the
applicant which right if possessed by others under like
circumstances in the same zoning district since other property
owners in the same residential district have 6 foot high
combination wall/open air fences which enclose their rear yard for
privacy and security.
Section 3#0 That the granting of such a Variance would not be
materially detrimental to the public welfare or injurious to the
property or improvements of which the property is located because
adequate off-street pedestrian access is provided and no
vehicular view obstruction would result.
Section 4--. That the granting of such a Variance will not be
contrary to the objectives of the General Plan in that said
wall/open air fence would maintain the integrity of a single-
family neighborhood and the wall/open air fence will be designed
in a safe manner*

slope or being placed well into the private rear
Section 6: For the foregoing reasons, the City Council of
the City of Rancho Palos Verdes hereby denies the appeal request
and thereby sustains -- Planning commission Resolution 88-17
subject to all conditions. This action has been deemed necessary
to p romote the public health, safety, and welfare of the area.
