CC RES 1988-046RESOLUTION NO. 88 46 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES DENYING AN APPEAL OF COASTAL PERMIT NO* 45 AND GRADING APPLICATION NO* 1102 AT 6410 SEACOVE DRIVE* Whereas, the Planning Commission on May 24, 1988 approved Coastal Permit No. 46 and Grading Application No. 1102 subject to conditions contained in P.C. Resolution No. 88-34-, Whereas, J.C.C. Enterprises has filed an appeal to the City Council of Coastal Permit No. 46 and Grading Application No. 1102 to allow a tennis court to remain in the front yard area; Whereas, after notice pursuant to the City's Development Code, a public hearing was held by the City Council on July 19, 1988 at which time all interested parties were given an opportunity to be heard and present e-vidence-, NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS* Section 1: As approved by the Planning Commission, the proposed development is in conformance with the General Plan, RS-1 Zoning Provisions and the Coastal Specific Plan. Section 2.* As approved by the Planning Commission, the proposed development, which is located between the sea and the first public road, is in conformance with the applicable public access and recreation policies of the Coastal Act. Section 3: As conditioned in Exhibit "All of P.C. Resolution No. 88-34, the Grading on the property. A. Is not accessible beyond the permitted primary use of the property, B. Does not significantly adversely affect visual relationships with, nor the views from neighboring sites. C. Minimizes disturbance to the natural contours; finished contours are reasonably natural. Section 4: For the foregoing reasons, the City Council of the City of Rancho Palos Verdes hereby denies the appeal of Coastal Permit No. 46 and Grading Application No. 1102 and requires the applicant to remove the tennis court from the front yard as listed in the conditions of approval of P.C. Resolution No. 88-34 contained in Exhibit "A". This action has been deemed necessary to protect the public health, safety and general welfare in the area and will make possible development of the City in an orderly and efficient manner and in conformity with the intent and purpose set forth in the Development Code and the Coastal Specific Plan.
