CC MINS 19971023 ADJMINUTES RANCH PALOS VERDES CITY COUNCIL ADJOURNED REGULAR MEETING OCTOBER 23, 1997 The meeting was called to order at 10:00 a.m. by Mayor John McTaggart at the Rancho Palos Verdes City Hall, Community Room, 30940 Hawthorne Boulevard, notice having been given with affidavit thereto on file. Following the Pledge of Allegiance to the flag, roll call was answered as follows: Present: Byrd, Ferraro, Hollingsworth, Lyon & Mayor McTaggart Absent: None Also present were City Manager Paul D. Bussey, City Attorney Carol Lynch, Director of Building, Planning & Code Enforcement Carolynn Petru, Administrative Services Director /City Clerk Jo Purcell, and Public Works Director Les Evans. Ordinance No. 328 & Resol. No. 97 -92 -Ocean Trails Development Agreement (11203 x 1411) City Attorney Lynch presented the revised documents prepared as a result of the discussion of this matter at the October 21, 1997 meeting: Development Agreement (Pursuant to Government Code Sections 675864 - 65869.5), Declaration of Restrictions relative to ongoing maintenance obligations of the developer, and a Declaration of Restrictions relative to public access to certain facilities. Ms. Lynch then summarized those amendments. Ken Zuckerman, one of the property owners in this matter, stated his acceptance of these documents as revised and noted that they are ready to proceed with construction of this project. Councilman Byrd moved, seconded by Councilwoman Lyon to ADOPT RESOL. NO. 97 -92 OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES ADOPTING ADDENDUM NO. 6 TO ENVIRONMENTAL IMPACT REPORT NO. 36 IN CONNECTION WITH APPROVAL OF A DEVELOPMENT AGREEMENT BETWEEN THE CITY AND THE DEVELOPERS OF THE OCEAN TRAILS PROJECT, CONSISTING OF A SEVENTY -FIVE LOT RESIDENTIAL PLANNED DEVELOPMENT (RPD), PUBLIC OPEN SPACE, AND AN 18 -HOLE PUBLIC GOLF COURSE WITH RELATED FACILITIES LOCATED IN COASTAL SUBREGIONS 7 AND 8. Discussion of the motion focused on Council's inquiry of whether there had been any substantive changes to this project since it was initially brought to the Council in 1992 or since it had been heard by the Council in September, 1996. Staff responded that no significant changes had been made to this project since September, 1996 and that the adoption of the Development Agreement would not result in any physical changes to the project. Upon completion of the discussion, the motion to Adopt Resol. No. 97 -92 carried unanimously. ORDINANCE NO. 328 OF THE CITY OF RANCHO PALOS VERDES APPROVING A DEVELOPMENT AGREEMENT WITH THE DEVELOPER OF THE OCEAN TRAILS PROJECT was INTRODUCED by title. Councilwoman Lyon moved, seconded by Councilman Byrd to waive full reading and INTRODUCE ORDINANCE NO. 328 and approve the Declarations of Restrictions and Development Agreement attached thereto. The motion carried on the following roll call vote: AYES: Ferraro, Byrd, Lyon, Hollingsworth & Mayor McTaggart NOES: None AUDIENCE COMMENTS: Lois Larue, 3136 Barkentine Road, stated that she appealed this development to the Coastal Commission because she was concerned about the marine life and the toxic waste this golf course would discharge into the ocean. She was concerned that the Development Agreement did not address the issue of preventing pollutants from entering the ocean from this site. Staff then clarified that the Development Agreement did not include the restrictions that Ms. Larue was interested in. Instead, these restrictions are part of the Mitigation Measures required by the project EIR, specifically requiring the developer to obtain an NPDES permit.
