A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF RANCHO PALOS VERDES APPROVING TENTATIVE
TRACT MAP NO. 45667 FOR A RESIDENTIAL DEVELOPMENT
CONSISTING OF 43 RESIDENTIAL LOTS AND 7 OPEN
SPACE LOTS IN A SINGLE FAMILY RESIDENTIAL DISTRICT
ALONG THE 6500 BLOCK OF PALOS VERDES DRIVE SOUTH,
WHEREAS ,. Tentative Tract Map No . 45667 has been filed for the
creation of forty-seven (47 ) single family residential lots and
seven ( 7 ) open space parcels on a 63 .85 acre parcel , pursuant to
the Residential Planned Development provisions of the City ' s
Development Code ; and
WHEREAS , the Planning Commission has held public hearings on
these applications on June 14, July 26 , August 9 , August 23 ,
September 13 and September 27 , 1988 at which time all interested
parties were given an opportunity to be heard and present
evidence ; and
WHEREAS , after notice pursuant to the provisions of the
City ' s Development 'Code , the City Council conducted public
hearings on November 1 , November 15 and December 15 , 1988 , and
January 10 , January 17 , January 31 , March 7 , April 10 and April
18 , 1989 at which time all interested parties were given an
opportunity to be heard and present evidence .
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RANCHO PALOS
VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS :
Section 1 : That the approval of, the map, as conditioned, is
consistent with the City 's Development Code for projects within
the RS-1 and RS-2 zoning districts under a Residential Planned
Development with the deletion of Lots 12 , 13 , 17 and 43 to
minimize the quantity of grading on the site and to promote safe
ingress and egress to driveways by minimizing those instances
where driveways enter upon street sections with a 15 percent
slope
Section 2 : That the proposed use of the lots shall be for
single family dwelling units, common open space and related
improvements , which is compatible with the objectives , policies ,
general land use and programs specified in the General Plan and
the Urban and Natural Overlay Control Districts which have been
established to protect existing drainage courses , natural
vegetation and extreme slopes of the City.
Section 3 : That the subject property is physically suitable
to accommodate Tentative Tract No. 45667 , as conditioned, in terms
of type and density, and will not result in substantial
environmental damage , based on compliance with the City 's
Development Code and General Plan, and consideration of
information contained in the project ' s Final Environmental Impact
Report No. 28.
Section 4: That the tentative map design provides for future
passive or natural heating or cooling opportunities in the
subdivision to the extent feasible .
Section 5 : That the tentative map does not propose to divide
land which is subject to a contract entered into pursuant to the
California Land Conservation Act of 1965 .
Section 6 : That the creation of the single-family
residential ntial dwellings, as conditioned, and associated improvements
will not be materially detrimental to property values, jeopardize ,
endanger, or otherwise constitute a menace to the surrounding
area, since physical improvements , dedications , and maintenance
agreements are required.
Section 7 : That the division and development Gf the property
will not unreasonably interfere with the free and complete
exercise of the public entity and/or public utility rights-of-way
and/or easements within the tract .
Section 8 : The discharge of waste from this land division
into the public sewer system will not violate the requirements of
the California Regional Water Quality Control Board pursuant to
Division (commencing with Section 13000 of the Water Code) .
Section 9 *0 That the design of the subdivision and the
type of improvements are not likely to cause serious public health
problems.
Section 10 -0 That the design of the subdivision and the type
of improvements will not conflict with easements acquired by the
public at large for access through or use of property within the
proposed subdivision.
Section 11 : Dedications required by local ordinance are shown
in the tentative map and/or set forth in the conditions attached
hereto in Exhibit "Alf .
Section 12 :6 That the City has considered the effect of
approval of the subdivision on the housing needs of the region in
which the City is situated and balanced these needs against the
public service needs of its residents and available fiscal and
environmental resources *
Section 13 : That the subject use , as conditioned, mitigates
or reduces significant adverse effects to adjacent properties or
the permitted uses thereof . Further, the City Council does hereby
declare that the EIR was certified per Resolution No. 89-39 in
compliance with City and State guidelines and that the City
Council has reviewed and considered the contents of the EIR in
Resolution No . 89- 40

reaching its decision. The City Council further adopts and
incorporates by reference the environmental findings and statement
of overriding considerations set forth in Resolution No . 89-39' .
Section 14: For the foregoing reasons , the City Council of
the City of Rancho Palos Verdes hereby approves Tentative Tract
Map No. 45667 , subject to the attached conditions , marked Exhibit
"A" . which are necessary to protect the public health, safety and
general welfare in the area.

TENTATIVE TRACT MAP NO, 45667
CONDITIONS OF APPROVAL
GENERAL
1 * Within thirty (30 ) days of approval of the tentative map
the developer shall submit , in writing,, a statement that
he has read and understands all conditions of approval .
2 * The City ' s fees for a final map shall be paid within six
(6) months of approval of the tentative map .
3 * The developer shall supply the City with one brownline
and one print of the recorded map,
4* This approval expires twenty-four ( 24) months from the
date of approval of this tract map by the City Council
of the City of Rancho Palos Verdes,
5 * All lots shall conform to minimum development standards
as specified in CUP No . 130 ,
6 * During the hours of grading operations , the applicant
shall pay for the cost of a traffic car along the haul
route in Rancho Palos Verdes ,
7 * The Final Map shall be drawn so as to accommodate the
deletion of lots 12, 13 , 17 and 43 as depicted on the
tentative map .
PROPERTY BOUNDARY
1 . The subdivision ' s east property line shall be adjusted
prior to recordation of the Final Map , so as not to
traverse an existing residence and any accessory
structures in this vicinity.
SUBDIVISION MAP ACT
1 '6 Prior to submitting the final map for recording pursuant
to Section 66442 of the Government Code , obtain
clearances from all affected departments and divisions ,
including a clearance from the City Engineer for the
following items :, mathematical accuracy, survey analysis,
correctness of certificates and. signatures, etc ,

COUNTY RECORDER
1 * If signatures of record or title interests appear on the
final map , submit a preliminary eliminary guarantee . A final
guarantee will be required at the time of filing of the
final map with the County Recorder, If said signatures
do not appear on the final map, a preliminary title
report/guarantee is needed that covers the area showing
all fee owners and interest holders ,
2 * The account for this preliminary title report guarantee
should remain open until the final map is filed with the
County Recorder,
ARCHEOLOGY
1 * A qualified archaeologist shall be present during all
rough grading operations to further evaluate cultural
resources on the site . If archaeological resources are
found, all work in the affected area shall be
temporarily suspended and the resources shall be removed
or preserved. All "finds" shall be reported to the
Director of Environmental Services immediately,

SEWERS
10 A bond, cash deposit, or other City approved security,
shall be posted prior to the recordation of the Final
Map or start of work whichever occurs first , to cover
costs for construction of a sanitary sewer system, in an
amount to be determined by the City Engineer,
2 * Prior to approval of the Final Map , the subdivider shall
submit to the Director of Environmental Services a
written statement from the County Sanitation District
approving the design of the tract with regard to the
existing trunk line sewer. Said approval shall state
all conditions of approval , if any.
3 . Approval of this subdivision of land is contingent upon
the installation, dedication and use of local main line
sewer and separate house laterals to serve each lot of
the land division,
4* If , because of future grading, or for other reasons, it
is found that the requirements of the Plumbing Code

cannot be met on certain lots, no building permit will
be issued for the construction of homes on such lots ,
5 . Sewer Easements are tentatively required, subject to
review by the City Engineer, to determine the final
locations and requirements.
WATER
10 Prior to recordation of the Final Map or prior to
commencement of work whichever occurs first , the
subdivider must submit a labor and materials bond in
addition to either:
A. An agreement and a faithful performance bond in the
amount estimated by the City Engineer and
guaranteeing the installation of the water system*
or
B. An agreement and other evidence satisfactory to the
City Engineer indicating that the subdivider has
entered into a contract with the servicing water
utility to construct the water system, as required,
and has deposited with such water utility security
guaranteeing payment for the installation of the
water system,
2 * There shall be filed with the City Engineer a statement
from the purveyor indicating that the proposed water
mains and any other required facilities will be operated
by the purveyor, and thatundernormal operating
conditions, the system will meet the needs of the
developed tract,
3 * At the time the final subdivision improvement plans are
submitted for checking, plans and specification for the
water systems facilities shall be submitted to the City
Engineer fox checking and approval , and 'shall comply
with the City, Engine-er' s standards , Approval for filing
of the land division is contingent upon approval of
plans and specifications mentioned above .
49 All lots shall be served by adequately sized water
system facilities which shall include fire- hydrants of
the size and type and location as determined by the Los
Angeles County Fire Department, The water mains shall
be of sufficient size to accommodate the total domestic
and fire flows required for the land division. Domestic
flow requirements shall be determined by the City
Engineer. Fire flow requirements shall be determined by
the Los Angeles County Fire Department -and evidence of
approval by the Los Angeles County Fire Chief is
required,

5 . Framing of structures shall not begin until after the
Los Angeles County Fire Department has determined that
there is adequate fire fighting water and access
available to the said structures .
DRAINAGE
1 . Prior to recordation of the Final Map or prior to
commencement of work whichever occurs first, a bond,
cash deposit , or combination thereof , shall be posted to
cover costs of construction in an amount to be
determined by the City Engineer,
2 . Prior to recordation of the Final Map or prior to
commencement of work, whichever occurs first , the
developer shall submit a hydrology study to the City
Engineer to determine any adverse impacts to existing
flood control facilities generated by this project .
Should the City Engineer determine that adverse impacts
will result , the developer will be required to post a
cash deposit or bond or combination thereof in an amount
to be determined by the Director of Public Works , which
will be based on the project ' s share of the necessary
improvements.
3 . Drainage plans and necessary support documents to comply
with the following requirements must be approved prior
to the recordation of the Final Map or commencement of
work, whichever occurs first ,
A. Provide drainage facilities to remove the flood
hazard to the satisfaction of the City Engineer and
dedicate and show easements on the Final Map ,
B. Eliminate sheet overflow and ponding or elevate the
floors of the buildings, with all openings in the
foundation walls to be at least twelve inches above
the finished pad grade ,
C . Provide drainage facilities to protect the lots from
high velocity scouring action.
D. Provide for contributory drainage from adjoining
properties ,
4. In accordance with Section 1601 and 1602 of the
California Fish and Game Code , the State Department of
Fish and Game , 350 Golden Shore, Long Beach, California
90802 , telephone 435-7741 , shall be notified prior to
commencement of work within any natural drainage courses
affected by this project ,

5 * Proposed drainage system will connect with L.A.C .D.P.W.
Drain PD699 . Developer shall obtain approval of
L.A.C .D.P.W. for the proposed drainage system connection
and shall comply with all conditions imposed by the
County. The new system shall be so designed and
constructed so that the L.A.C.D.P.W. will take over
maintenance ,
6 . All drainage swales and any other on-grade drainage
facilities, including gunitel, shall be of an earth tone
. , color and shall be reviewed and approved by the Director
of Environmental Services,
STREETS
10 Prior to recordation of the Final Map or commencement of
work, whichever occurs first , a bond, cash deposit , or
other City approved security, shall be posted to cover
costs for the full improvement of all proposed on-site
private streets and related improvements, in an amount
to be determined by the Director of Public Works .
2 * The developer shall post an additional bond, cash
deposit , letter of credit , or other City approved
security in an amount sufficient to cover the cost of
full improvements of all facilities within the right-of-
way of Palos Verdes Drive South and Hawthorne Blvd.
adjacent to the Tract . Said improvements shall include
but are not limited to A.C . paving , curb/gutter,
sidewalk, drainage improvements , bikeways, bus stop
improvements, medians and landscaping. The design of
such improvements shall be subject to the adopted street
standards and the approval of the Director of Public
Works .
3 * The City at its discretion, may permit the developer to
make said street , right-of-way and facility improvements
or use the above payments to make said improvements by
the City, as determined by the Director of Public Works .
4* The proposed streets shall be public and designed to the
satisfaction of the Director of Public Works , pursuant
to the following specifications :
A. All proposed streets shall be thirty-four (34) feet
in width, measured from flow-line to flow-line.
Parkway width shall be a minimum of eight (8) feet
on both sides. Right-of-way width shall be fifty
(50 ) feet .
B. All streets shall have a vertical type curb.
C . Sidewalks shall be concrete , a minimum of four ( 4)
feet wide and shall be constructed on at least one

side of the roadway in accordance with the City
Standards ,
D. Cul-de-sacs shall be designed to the specifications
of the Director of Public Works,
E. Street and traffic signs shall be placed at all
intersections and/or corners as specified by the
Director of Public Works , and shall meet City
Standards .
F. All proposed streets shall be designed in
substantially the same alignment as shown on the
approved Tentative Tract Map and to the above
conditions .
G. A Class II , painted bike lane along the north side
of Palos Verdes Drive South and an urban trail
sidewalk along the north side of the project' s Palos
Verdes Drive South frontage shall be provided.
5 . The developer shall construct a scenic pull-out on
Hawthorne Blvd. , southwest of Vallon. (Unless relieved
by the Director of Public Works and the City Manager) ,
6 . There shall be a median break at Seahill on Palos Verdes
Drive South. A left turn lane shall be required on the
eastbound side of Palos Verdes Drive South to "C"
Street .
7 . The most westerly entrance is to be a right turn in and
a right turn out only.
8 . Right turn pockets into each entrance are required.
9 . Traffic signal deposits , in an amount to be determined
by the Director of Public Works, may be required at
Palos Verdes Drive South and Seahill as part of this
development .
10 . The developer shall be responsible for repairs to any
neighboring streets which may be damaged during
development of the tract , including but not limited to
the designated haul truck route . Prior to issuance of
grading permits, the developer shall post a bond, cash
deposit or City approved security, in an amount
sufficient to cover the costs to repair any damage to
streets and appurtenant structures as a result of this
development. In addition to providing such security,
the developer shall pay for a pavement analysis of the
streets to be used as the designated haul truck route
prior to the start of construction and at completion of

construction. The developer shall provide compensation
for any loss of pavement life along the designated haul
truck route as a result of this development,
11. The developer shall pay traffic impact fees in an amount
determined by the Director of Public Works upon issuance
of Certificate of Occupancy.
12. The developer shall dedicate to the City vehicular
access rights to Palos Verdes Drive South and Hawthorne
Boulevard, except as provided for streets as shown on
the Tentative Map* A note to this effect shall be
, .placed on the Final Map,
GEOLOGY
1. Prior to recordation of the Final Map or commencement of
work, whichever occurs first, a bond, cash deposit, or
combination thereof, shall be posted to cover costs for
any geologic hazard abatement in an amount to be
determined by the City Engineer.
2. All geologic hazards associated with this proposed
development shall be eliminated or the City Geologist
shall designate a restricted use area in which the
erection of buildings or other structures shall be
prohibited.
3. Prior to issuance of building permits, submit a Geology
and/or Soils Engineer' s report on the expansive
properties of soils on all building sites in the proposed
subdivision. Such soils are defined by Building Code
Section 2904(b) .
4. An as-built geological report shall be submitted for
structures founded on bed rock. An as-built soils and
compaction report shall be submitted for structures
founded on fill as well as for all engineered fill areas.
EASEMENTS
1. Easements shall not be granted or recorded withinareas
proposed to be granted, dedicated, or offered for
dedication or other easements until after the final tract
map is filed with the county Recorder, unless such
easements are subordinated to the proposed grant or
dedication. If easements are granted after the date of
tentative approval , a subordination must be executed by
the easement holder prior to the filing of the Final
Tract Map.
2. A fifty ( 5 0) foot wide Landscape Easement from the rear
property line on lots 7-12 ( lot 12 deleted) and 21-43
( lot 43 deleted) shall be recorded and noted on the Final
Resolution No. 89-40

all related improvements and conditions, this easement
shall be maintained by the Homeowners Association.
3. The developer shall provide to the City of Rancho..Palos
Verdes, and record on the Final Map, public easements for
multi-purpose trail use through lots 48, 49 and 51--54.
The purpose of these trails is to provide off-street
public access from Hawthorne Boulevard and Palos Verdes
Drive South and connect with other off--street trails to
further expand the Loop Trail system. The developer
shall be responsible for the construction of these trails
and shall provide a bond or other money surety for thea
construction of such public trails.
4. The developer shall provide to the City of Rancho Palos
Verdes, and record on the Final Map, a twenty ( 20) foot
wide slope easement along Palos Verdes Drive South to
accommodate any grading that may be required to construct
street and trail improvements.
5. All easements are subject to review by the City Engineer
to determine the final locations and requirements.
SURVEY MONUMENTATION
1. Prior to recordation of the Final Map, a bond, cash
deposit, or combination thereof, shall be posted to cover
costs to establish survey monumentation, in an amount to
be determined by the City Engineer.
20 Within twenty-four ( 24) months from the date of filing
the Final Map, the developer shall set survey monuments
and tie points and furnish the tie notes to the City
Engineer.
3. All lot corners shall be referenced with permanent survey
markers in accordance with City Municipal Code.
STREET NAMES AND NUMBERING
1. Any street names and/or house numbering by the developer
must be approved by the City Engineer.
PARK DEDICATION
1. Prior to the approval of the final map a parkland
dedication fee in the amount of $90,512 shall be paid to
the City of Rancho Palos Verdes.

CONDITIONAL USE PERMIT, GRADING AND ENVIRONMENTAL IMPACT
REPORT
1 . This approval is conditioned upon compliance with all
conditions of Conditional Use Permit No . 130 , Grading
Application No . 1061 and EIR No . 28 ,
