A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF RANCHO PALOS VERDES DENYING THE APPEAL
OF HEIGHT VARIATION NO, 589 THEREBY APPROVING
THE PROJECT AT 2315 SUNNYSIDE RIDGE ROAD.
WHEREAS, on April 10, 1989, the Director of Environmental
Services approved Height Variation No. 589 for a second story
addition located at 2315 Sunnyside Ridge Road; and
WHEREAS, on April 19, 1989, Elwood and Emily Culp filed an
appeal to the Planning Commission within 15 days of the decision
of the Director of Environmental Services; and
WHEREAS, on July 11, and August 22, 1989, the Planning
Commission considered the appeal of Height Variation No. 589 at
which time all interested parties were given an opportunity to be
heard and present evidence,.and on August 22, 1989, the Planning
Commission denied the appeal, thereby upholding staff's approval
of the proposed project; and
WHEREAS, on September 1, 1989, Elwood and Emily Cup filed an
appeal with the City Council within 15 days of the decision of the
Planning Commission; and
WHEREAS, on October 17, 1989, the City Council heard the
appeal at which time all interested parties were given an
opportunity to be heard and present evidence.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RANCHO PALOS
VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS;
Section 1: The proposed structure is designed and situated
in such a manner as to minimize view obstruction, since it is
located over the southeast portion of the main residence and not
over the garage or the northeast portion of the residence and the
height of the structure was reduced to 241.
Section 2: View impairment for the portion of the proposed
addition over sixteen feet high does not significantly impair the
principal view from the family room, determined to be the
princip -al viewing area, at 2321 Sunnyside Ridge Road, since the
.addition is..below the view of the harbor. The Council determined
the master bedroom did not constitute the principal viewing area
and - additionally that there was no impact from a standing or
sitting position from the master bedroom.
Section 3. The proposed structure is not located on a ridge
or promontory,
Section 4: The structure does not significantly impair a
view or vista from public property (parks, major thoroughfare,
bikeways, walkways, equestrian trails, etc.) which has been
identified in the City's General Plan, Coastal Plan, or City
approved viewing areas.
Section 5: There is no significant cumulative impact caused
by granting the application.
Section 6: The applicant presented substantial evidence to
support each finding required under the Development Code,

Section 7., That after consideration of the appeal of Height
Variation No. '589 on October 17, 1989, the City Council denied the
appeal, thereby approving the project at 2315 Sunnyside Ridge
Road, subject to the conditions in attached Exhibit "A".
PASSED, APPROVED and ADOPTED on the 17th day of October,

HEIGHT VARIATION NO, 589
2315 SUNNYSIDE RIDGE ROAD
1. The maximum height of the addition shall be 24 feet in height
measured from the highest existing grade covered by the
structure to the ridgeline or the highest point of the
structure.
2. The owner shall record a covenant limiting the height of
vegetation to protect views prior to building permit
issuance.
3. The second story bedroom window on the southwest side of the
house shall be relocated approximately 7 feet to the south or
modified as approved by the Director of Environmental
Services to protect the privacy of 2301 Sunnyside Ridge,
