A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF RANCHO PALOS VERDES DENYING A REQUEST TO
MODIFY STAFF APPROVAL OF SITE PLAN REVIEW
NO. 4922 FOR A GROUND MOUNTED SATELLITE DISH
ANTENNA AT 2175 ROCKINGHORSE ROAD AND DENYING
A REQUEST TO WAIVE REVIEW FEES,
WHEREAS, Stefano Finazzo has requested the City Council to
review staff approval of Site Plan Review No. 4922 to consider
impairment of signal reception caused by vegetation at 2177
Rockinghorse Road and to waive processing fees for Planning
Commission and City Council review; and
WHEREAS, on August 8, 1989, the Planning Commission held a
hearing, at which time all interested parties were invited to be
present and give testimony, to consider Mr. Finazzo's request, and
determined that it was without merit; and
WHEREAS, on September 19, 1989, the City Council held a
hearing, at which time all interested parties were invited'to be
present and give testimony, to consider Mr. Finazzo's request.
NOW, THEREFORE THE CITY COUNCIL OF THE CITY OF RANCHO PALOS
VERDES DOES HEREBY DETERMINE AND RESOLVE AS FOLLOWS:
Section 1: That this project is categorically exempt from the
requirements of the California Environmental Quality Act.
Section 2: That practical difficulties may exist which might
prevent placement or installation of the satellite dish antenna in
a manner that is consistent with Section 17.41.170 of the
Development Code although the applicant's technical consultant has
reported that several locations exist in the applicant's rear yard
where signals from most satellites can be received and said
locations conform to the locations approved by staff on June 13,
1989; staff is directed to investigate and approve feasible
locations for the antenna, including within the rear yard setback.
Section 3: That the cost of relocating the existing satellite
dish antenna to one of the approved locations is reasonable in
relation to the original cost of the equipment and installation
and that the applicant's original application fee was waived to
further reduce such costs.
Section 4: That the existing, unapproved, roof - mounted
satellite dish antenna is visible from the public right -of -way, is
not substantially screened from adjacent properties, is
detrimental to the ocean, harbor, and city -light view from
2177 Rockinghorse Road, and is mounted on a structure which was
built without City approval.
Section 5* The City Council of the City of Rancho Palos
Verdes hereby denies the applicant's request to modify the staff
decision to unconditionally approve Site Plan Review No. 4922 and
directs the applicant to remove or relocate the existing satellite
dish antenna to a location approved by staff before October 1,
19890
