CC RES 1989-088RESOLUTION NO-, 89 -88 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES APPROVING THE APPEAL OF VARIANCE NO. 235 AND -COASTAL PERMIT NO, 71 AND OVERTURNING THE PLANNING COMMISSION'S DECISION TO DENY A DECK ADDITION AT 203 SEASCAPE, WHEREAS, Mr. Bill Hassoldt has requested a Variance and Coastal Permit to allow for a reduction in the side yard setback requirements to allow a 245 square foot addition and a 94 square foot.deck over an extreme slope, to -sated at 203 Seascape and within the Coastal Zone and Landslide Moratorium Area; and WHEREAS, on March 7, 1989, the City Council approved Moratorium Exemption No. 27 subject to Planning Commission approval; and WHEREAS, Planning Commission approved the 245 square foot addition and denied the 94 square foot deck in excess of the .250 square foot maximum limit established by the Coastal Specific Plan; and WHEREAS, Mr, Bill Hassoldt has appealed the Planning' Commission decision to deny the 94 square foot deck; and WHEREAS, after notice issued pursuant to the provisions of the Rancho Palos Verdes Development Code, the City Council held a public hearing on September 5, 1989, at which time all interested parties were given an opportunity to be heard and present evidence; NOW, THEREFORE,�THE CITY COUNCIL OF THE CITY-OF RANCHO PALOS VERDES DOES HEREBY FIND,, :DETERMINE AND RESOLVE AS FOLLOWS: Section 1: That there are exceptional and extraordinary circumstances and conditions applicable to the property which do not apply generally to other properties in that zoning in that the property is substandard in width and depth; and Section 2: That the Variance for the deck is necessary for the preservation and enjoyment of a substantial property right of the landowner since the rear yard is severely limited in level area, being comprised of slopes in excess of 35 %- and Section 3: That granting of Variance will not be materially detrimental to the public health, safety, and welfare in that the area surrounding the proposed deck extension shall be landscaped with drought tolerant plant materials to stabilize the slope and to screen the deck and underpinnings from view; and Section 4: That the proposed development is consistant with the General Plan and the Coastal Specific Plan; and Section 5,# For the foregoing reasons, the City Council of the City of Rancho Palos Verdes hereby approves Variance No. 235 and Coastal Permit No. 71, thereby overturning the 'Planning Commission's decision to approve the Coastal Permit and Variance to permit the 245 square foot addition to the residence and deny the deck over the extreme slope, with conditions contained in Exhibit "A". If a soils report is required, the City geotechnical staff shall specify in writing the reasons for requiring the report and the issues the report must address. The report shall be prepared in a form satisfactory to the City's geotechnical staff and the applicant shall comply with all recommendations of the City's geotechnical staff. 2. Roof runoff from all buildings and structures on the site shall be contained and directed to the street or an approved drainage course. 3. All lot drainage deficiencies, if any, identified by the director of Public Works, shall be corrected prior to final inspection. 4. Submit an irrevocable offer for sewer and storm drain easements prior to final inspection. 5. Submit an irrevocable offer to join a sewer district when one is formed prior to final. 6. All landscaping irrigation systems shall be part of a water management system approved by the Director of Public Works. 7. All other necessary permits and approvals required pursuant to the Rancho Palos Verdes Municipal Code or any other applicable statute law or ordinance shall be obtained. 8. No additional lot coverage shall be approved in the future. 9. Submit a "Hold Harmless" agreement prior to issuance of a building permit. 10. Limit the size of the addition to 245 square feet, a deck addition to extend over an extreme slope and require the owner to record a covenant, to run with the land, prohibiting further additions, habitable or non - habitable, on the subject property. Said covenant shall be recorded prior to issuance of building permits. 11. A City landscape covenant to maintain property to protect views shall be submitted to be recorded prior to issuance of building permits. Resolution No. 89 -88 Page 3 12. The 1274 square feet of existing patio corer shall remain open and uncovered, 13. The one foot three inch sideyard encroachment along the westerly sideyard shall match the existing building line and shaIal be no greater than 5' habitable space. 14.
