CC RES 1989-071RESOLUTION NO 89 -71. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES DENYING THE APPEAL OF HEIGHT VARIATION NO, 564 THEREBY APPROVING THE PROJECT AT 6536 VIA SIENA. WHEREAS, the Director of Environmental Services approved Height Variation No. 564 for a second story addition located at 6536 Via Siena; and WHEREAS, on December 5, 1988, Dennis and Lise Moore filed an appeal to the Planning Commission within 15 days of the decision of the Director of Environmental Services; and WHEREAS, on March 28, 1989, and April 25th, 1989 the Planning Commission considered the appeal of Height Variation No. 564 at which time all interested parties were given an opportunity to be heard and present evidence, and on May 9, 1989, the Planning Commission denied the appeal, thereby upholding staff's approval of the proposed project; and WHEREAS, on May 23, 1989, Dennis and Lise Moore filed an appeal with the City Council within 15 days of the decision of the Planning Commission; and WHEREAS, on July 5, 1989, the City Council heard t-he, appeal at which time all interested parties were given an opportunity to be heard and present evidence. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS: Section 1: The proposed structure is designed and situated in such a manner as to minimize view obstruction by a) placing the addition towards the front of the lot over the existing structure, b) not expanding the structure towards the rear, and c) limiting the extension of the trellis at the rear. Section 2: View impairment for the portion of the proposed addition over sixteen feet high does not significantly impair the primary view from 6532 Via Siena which was not identified as having a view as set forth in the City's Development Code, since the second story addition at 6532 Via Siena is not a protected viewing area.. Section 3: The proposed structure is not located on a ridge or promontory. Section 4* The structure does not significantly impair a view or vista from public property (parks, major thoroughfare, bikeways, walkways, equestrian trails, etc.) which has been identified in the City's General Plan, Coastal Plan, or City- approved viewJ,-n areas Section 5: There is no significant cumulative impact caused by granting the application. Section 6# That after consideration of the appeal of Height Variation No. 564 on July 5, 1989, the City Council denied the appeal, thereby approving the project at 6536 Via Siena, subject to the conditions in attached Exhibit "A"I which are necessary to protect the public health, safety and welfare., PASSED, APPROVED, ADOPTED on this 5th Day of July, 1989, yor ATTEST: �,,� Civy- C 1 e rk tat o ;C,4 . Resolution No. 89-71 Page 2 EXHIBIT "A" HEIGHT VARIATION N0. 564 - APPEAL 6536 VIA SIENA 1. The property owner shall record a landscape covenant and agreement limiting the height of Vegetation in order to protect views. 2. The rear trellis shall extend a maximum of 12 feet beyond the addition to the southwest, and the trellis shall not be extended or modified in the future. Resolution No. 89-71 Page 3
