A RESOLUTION OF THE CITY COUNCIL OF
THE CITY
OF RANCHO PALOS VERDES ORDERING VACATION OF
STREETS WITHIN TRACT 33206

WHEREAS, the Resolution of Intention
90 -35 was adopted,
in the matter of the vacation of the streets
in Tract 33206 in
the City of Rancho Palos Verdes, on May. 15, . 1990, which resolu-
tion established the -time and place for the
public hearing on
said street vacation; and
WHEREAS, due notice of said hearing
has been published
and posted as required by law; and
WHEREAS, at the hearing the City
Council heard all
evidence offered by persons interested . in said
vacation.
NOW, THEREFORE, THE CITY COUNCIL OF
THE CI'T'Y ^F R A tI r:HO
' PALOS VERDES FINDS, DETERMINES AND RESOLVES:
Section 1. That the City Council
finds from all 'the
evidence submitted:
(a) That said portion of streets
within Tract 33206
described in Resolution of Intention, namely Resolution
No. 90 -35
were originally intended to be utilized for
street and parkway
purposes.
(b) The aforesaid street rights-of-way are unnecessary
for present or prospective public use.
Section 2. The City Council has considered the
General Plan of the City of Rancho Palos Verdes and finds the
vacation to .be in conformity with said Plan, specifically;
(a) The road is a truly local road and is not needed
as a thoroughfare in the collector and arterial road network,
(b) An assessment district shall be established or the
C.C. & R's shall be amended as necessary to allow the district to
levy taxes or the Homeowners Association to impose assessments
for road maintenance,
(c) Provisions have been made to guarantee the proper
up -keep of the streets,
d) Dedication of non - vehicular easements will be
maintained.
Section 3. That for the streets in question the an-
ticipated future use and the street right of way is unnecessary
for present or prospective public use.

Section 4. Pursuant to Section 2381 of the streets
and Highways Code of the State of California the City Council
finds and determines the rights of way proposed for abandonment
are not useful as non - motorized transportation facilities.
Section 5. The City Council therefore orders va-
cated the streets within Tract 33206.
Section 6. That the City Council - reserves and ex-
empts from the vacation the easement and right at any time, or
from time to time, to construct, maintain, operate., replace,
remove, and renew sanitary sewers and storm drains and appur-
tenant structures in, upon, over, and across street rights-of-way
proposed to be vacated and, pursuant to any existing franchise or
renewals thereof, or 'otherwise, to construct, maintain, operate,
replace, remove, renew and enlarge lines of pipe, conduits,
cables, wires and other convenient structures, equipment and fix-
tures for the operation of gas, telephone, electrical, water
trails, and telegraphic lines, in, upon, and over street rights-
of-way proposed to be vacated.
Section 7. The provisions of this resolution shall
have no force and effect until or unl -ess all requirements if
Resolution 90 -68 are complied with.
Section 8. The City Clerk is hereby ordered to
cause a certified copy of this Resolution, attested by the City
Clerk under the Seal of this City, to be recorded in the office
of the County Registrar-Recorder of Los Angeles County.
