A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF RANCHO PALOS VERDES DENYING AN APPEAL OF
SITE PLAN REVIEW NO* 5338 THEREBY SUSTAINING
THE PLANNING COMMISSION'S CONDITIONAL APPROVAL
OF A GROUND MOUNTED SATELLITE DISH ANTENNA AT
6432 VIA COLINITAO
WHEREAS, on January 3, 1990, Ms. Janice Sandell-Noorthoek,
property owner at 6432 Via Colinita. submitted Site Plan Review No.
5338 to allow an existing unapproved satellite dish antenna to
remain* and
WHEREAS, on April 14, 1990, the Planning Commission after
holding a hearing, at which time all interested parties were
invited to be present and give testimony, conditionally approved
Site Plan Review No. 5338* r and
WHEREAS, on May 8, 1990, Mr. and Mrs* Roger Noorthoek
appealed the Planning Commission's decision, specifically
objecting to the relocation of the satellite dish antenna; and
WHEREAS, on June 19, 1990 and July 3, 1990, the City Council
held a hearing, at which time all interested parties were invited
to be present and give testimony, to consider Mr. and Mrs.
Noorthoek's appeal.
NOW, THEREFORE THE CITY COUNCIL OF THE CITY OF RANCHO PALOS
VERDES DOES HEREBY DETERMINE AND RESOLVE AS FOLLOWS,
Section 1: That this project is categorically exempt from
the requirements of the California Environmental Quality Act.
Section 2: That practical difficulties exist, such as a
limited rear yard area, grade differentials and existing
structures which prevent adequate reception as indicated in a-
submitted satellite dish antenna reception report and a rear yard
which is highly visible from the public right-of-way and
neighboring properties, which prevent the placement or
installation of a satellite dish antenna in the rear yard of 6432
Via Colinita in a manner that is consistent with Section 17.41.170
of the Rancho Palos Verdes Development Code.
Section 3: Thatthe cost of relocating the existing
satellite dish antenna to the general area of location "C" is
reasonable in that the cost of relocating the dish antenna is
equal to the cost of original installation at Location "C" if
appropriate permits were obtained, as required,
Section 4,# That the existing, unapproved, ground mounted
satellite dish antenna is located within the City of Rancho Palos
Verdes public right-of-way and is not substantially screened from
the public right-of-way and adjacent properties.
Section 5.* Upon the basis of two separate satellite dish
reception reports indicating satellite dish antenna reception
capabilities from the front yard of 6432 Via Colinita, that there
is a location in the front yard at Location "C", Revised Location
VICIV, or between those two locations at which placement of a
satellite dish antenna would receive reasonable reception and be
adequately screened from the public right-of-way and adjacent
properties.
Section 6,*, That for the foregoing reasons and based on
information and findings included in the staff report and evidence
presented at the public hearings, the City Council of the City of
Rancho Palos Verdes hereby denies the appeal of Mr. and Mrs.
Noorthoek and sustains the Planning Commission's approval of Site
Plan Review No. 5338 subject to the modified conditions marked in
Exhibit "A" which are necessary to protect the public health,
safety, and general welfare of the area.
PASSED, APPROVED AND ADOPTED, this 17th day of July 1990,

6432 VIA COLINITA
1. The property owner must identify to staff a location at
Location "C". Revised Location "C", or between those two
locations and, if acceptable to staff, relocate the antenna to
the identified location within 30 days of adoption of this
resolution.
2. The total height of the dish antenna structure shall not
exceed 16 feet from existing grade.
3. A building permit must be obtained for installation of the
relocated dish antenna.
