A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF RANCHO PALOS VERDES DENYING THE APPLICANT'S
APPEAL OF VARIANCE NOo 252 AT 2175 ROCKINGHORSE
THEREBY UPHOLDING THE PLANNING COMMISSION'S
ACTION*
WHEREAS, Mr. Stefano Finazzo has requested a Variance to allow
for the reduction of a side yard slope setback for an
existing room addition at 2175 Rockinghorse Drive; and
WHEREAS, on March 27, 1990, the Planning Commission approved
with conditions Variance No. 252; and
WHEREAS, on April 9, 1990, the applicant, Mr. Stefano Finazzo
appealed the Planning Commission's decision; and
WHEREAS, after notice issued pursuant to the provisions of the
Rancho Palos Verdes Development Code, a public hearing was held
before the City Council on June 6, 1990 at which time all
interested parties were given an opportunity to be heard and
present evidence,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RANCHO PALOS
VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS:
Section 1,* That there are exceptional or extraordinary
circumstances or conditions applicable to the property which do
not apply generally to other properties in the same zoning
district, in that the lot size is substandard and does not meet
the requirements of the RS-2 zoning district and the lot contains
a transitional slope which is greater than two to one which limits
buildable area but does not preclude relocation of the satellite
dish antenna.
Section 2 That the Variance is necessary for the preservation
and enjoyment of a substantial property right of the landowner,
since the property owner is further restricted to develop his
property due to the size and nature of the lot and because the
addition does not significantly increase the total lot coverage on
the property, and the conditions of approval do not infringe upon
the property-rights of the owner while they protect and preserve
adjacent property owners' rights.
Section 3: That the granting of the Variance will not be
materially detrimental to the public health, safety, and welfare
because the addition does not adversely affect the privacy or
views of adjacent properties and does not alter the
characteristics of the neighborhood and the conditions attached
will aid in maintaining that privacy and neighborhood
characteristics.
Section 4: - That the granting of the Variance will not be
contrary to the objectives of the General Plan since the
development property is consistent with the development standards
required in an RS-2 zoning district even though the lot is
substandard,
Section ' 51: Notwithstanding the limited impact of the roof
addition, the satellite dish antenna existing atop the structure
falls within the required slope setback. Permitting the antenna to
remain in its present location in conjunction with granting the
variance would confer a special privilege to the applicant in
excess of what other similarly situated owners possess, and causes
a material detriment and injury to adjacent property owners since
in its present roof-mounted position, the antenna obstructs the
views of adjacent property owners.
Section 6: For the foregoing reasons, and based on the
information and findings 'included in the Staff Re
porty minutes and
evidence presented at the public hearing the City Council of the
City of Rancho Palos Verdes hereby denies the appeal, thereby
upholding the Planning Commission's action to approve Variance
No. 252 subject to Planning Commission Resolution No. 90-17 and
the conditions attached thereto,
PASSED, APPROVED, and ADOPTED this 6th day of June, 1990.
