CC RES 1990-022RESOLUTION NO, 90- 22 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDE S , CALIFORNIA, REQUESTING THE BOARD OF SUPERVISORS OF THE LOS ANGELES COUNTY FLOOD CONTROL DISTRICT OF THE STATE OF CALIFORNIA TO ACCEPT ON BEHALF OF SAID DIS- TRICT A TRANSFER AND CONVEYANCE OF STORM DRAIN IMPROVEMENTS KNOWN AS PRIVATE DRAIN N0, 1703 IN THE CITY OF RANCHO PALOS VERDES FOR FUTURE OPERATION, MAINTENANCE, REPAIR AND IMPROVE- MENT, AND AUTHORIZE THE TRANSFER AND CON- VEYANCE THEREOF. WHEREAS, there have been dedicated to, or the City has otherwise acquired, the storm drain improvements and drainage system known as Private Drain No. 1703, described in Exhibit A attached hereto; and WHEREAS, the City is authorized and empowered to trans- fer and convey to the Los Angeles County Flood Control District any storm drain improvements and drainage systems for future operation, maintenance, repair, and improvement; and WHEREAS, the City and the Los Angeles County Flood Con- trol District entered into an agreement dated March 31, 1981, and recorded April 16, 1981, as Document Number 81-384580, of the Of- f i c i al Records in the office of the County Recorder for the County of Los Angeles, whereby the City made certain warranties about its future transfers and conveyances of Flood Control facilities to the District; and WHEREAS, the best public interest will be served by transfer and conveyance of the storm drain improvements and drainage system descr i bed in Exhibit A attached hereto from the City to the Los Angeles County Flood Control District for future operation, maintenance, repair, and improvement. NOW, THEREFORE, BE IT RESOLVED, that the City does hereby request the Los Angeles County Flood Control District to accept the transfer and conveyance of the storm drain improve- ments and drainage system described in said Exhibit A. BE IT FURTHER RESOLVED that, subject to the acceptance thereof of the Board of Supervisors of the Los Angeles County Flood Control District, the City Engineer is directed and ordered to prepare all necessary instruments and documents, including deed, to effectuate said transfer and conveyance, and that the Mayor is authorized and instructed to execute said deed and other instruments and documents. District shall have no obligation or responsibility to maintain said storm drain, improvements, and drainage until all rights of way for said drain now vested in the City and all other necessary rights of way therefore have been conveyed to and accepted by District, Reference is hereby made to District Drawings Nos. 357- F8.2 -.4, the plans and profile of said storm drain improve- ments and drainage system on file in the office of the City En- gineer and on file in the office of the Chief Engineer of said District for further data as to the exact location, extent, and description of said storm drain improvements and drainage system. City Jerk City f Rancho Palos Verdes 2 EXHIBIT "A" Private Drain No. 1703 A reinforced concrete pipe storm drain system and appurtenant structures' for Tract Map I;o. 38848, filed May 12, 1983 in book 1017, pages 8 to 14, inclusive, of maps in the office of the Regis tray- Recorder of the County of Los Angeles, generally descr i bed as follows: Line "A ": Commencing from an outlet structure, Station 1+13.09, located in a natural watercourse just north of lot 34 , in Tract 38848; thence proceeding northeasterly and immediately curving to the southeast; thence proceeding southeasterly along a 10- foot -wide easement which lies between lots 34 and 35; thence northeasterly along Santa Catalina Drive to catch basins located just past the intersection of Santa Barbara Drive, Station 7+49,28, a distance of 636 feet more or less. Laterals "A -1" and "A-211: Connector pipes from line "A", Station 6 +81.17 , to catch basins at Santa Barbara Drive. Line "B ": Commencing from a drainage easement and junction with a RCP Storm Drain, Station 0 +85.75, located on lot 95 of Tract 38848; thence proceeding northwesterly along a 10 -foot -wide easement, which lies between lots 9 and 10, to San Clemente Drive, Station 4 +26.74, a distance of 341 feet more or less. Laterals "B -1" and "B -2" Connector pipes from the end of line "B ". Station 4 +26.74, to catch basins on San Clemente Drive, EXHIBIT "A" 3 RES.
