CC RES 1990-002RESOLUTION NO* 90-02 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES DENYING THE APPEAL OF CONDITIONAL USE-PERMIT NO. 150 AND SIGHT PERMIT NO* 458, THEREBY.DENYING CONDITIONAL USE PERMIT NO,* 150, AND APPROVING SIGN PERMIT N09 4581 REQUIRING THE REMOVAL OF THE EXISTING POLE SIGN BY JANUARY 38, 1990 AND ALLOWING THE REFACING OF OTHER EXISTING SIGNS AT 29019 So WESTERN AVENUE* WHEREAS, after notice pursuant to the Development Code, a public hearing was held on October 24, 1989 and on November 14, 1989 the Planning Commission adopted the Res olution denying Conditional Use Permit No. 150 and approving Sign Permit No. 458 with conditions after all interested parties were given the Opportunity to give testimony and present evidence. WHEREAS, on November 28, 1989, Herman Architects, representing Sizzler Restaurants, filed an appeal to the City Council within 15 days of the decision of the Planning Commission. WHEREAS, on January 16, 1990, the City Council heard the appeal of Conditional Use Permit No. 150 and Sign Permit No. 458 at which time all interested parties were given an opportunity to be heard and present evidence. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS. Section 1,* The existing pole sign is not necessary for the applicant's enjoyment of substantial trade, since the existing building signs are highly visible to traffic on Western Avenue. Section 2.# The existing pole sign constitutes needless repetition, redundancy and proliferation of signage since the signage on the building adequately identifies the site. Section 3: The size and height of the existing pole sign is not compatible and harmonious with the building and site, since the excessive size and height are out of scale with the site, Section 4: The design and size of the existing pole sign detracts from the adjacent developed properties since all of the adjacent commercial establishments on the west side of Western Avenue have-removed their pole signs and the existing pole sign is not compatible with the visual characteristics of the surrounding area. Section 5: The height and size of the existing pole sign has a significant adverse effect on the character of the adjacent residential district since the residences are at a higher elevation and the sign is highly visible from.these residences. Section 6: The granting of the Conditional Use Permit for the existing pole sign would be contrary to the Specific Plan since-the additional size is not necessary to identify the site and the sign design is not compatible with the total site design. Section 7#0 The refacing of existing signage is consistent with the requirements of Section 17.52.020(C) 1-8 of the Development Code and Specific Plan IV. Section 8** For the foregoing reasons, the City Council of the City of Rancho''Palos Verdes does hereby deny the appeal of Conditional Use Permit No. 150 and Sign Permit No. 458 thereby denying the Conditional Use Permit and approving the Sign Permit subject to the conditions contained in Exhibit "A",,attached hereto and made a part hereof, which are necessary to p reserve the public health, safety and general welfare in the area, PASSER, APPROVED and ADOPTED on January 16, 1990. City Clerk city," f Rancho Palos Verdes Resolution No, 90-02 Page 2 EXHIBIT "A" CONDITIONAL USE PERMIT NO* 150 SIGN PERMIT NO* 458 10 The three existing roof parapet canister and channel letter signs which are 31 9" high by 12' wide each may be refaced with a "Delaware" blue background. 20 The existing "collage" sign, approximately 15 square feet in area may be replaced with a new sign of equal size, with the only revision being a "Delaware" blue background. 3* The two existing directional signs, 41 wide by 21 high on a 2' Est (411 total height) may be refaced with new signs of equal size with the only revision being a "Delaware" blue background. 40 The existing pole sign shall be removed by January 30, 1990. 5.
