A RESOLUTION OF TIE CITY COUNCIL OF THE CITY OF
RANCHO PALOS VERDES ORDERING THE VACATION OF A
PORTION OF PALOS VERDES DRIVE SOUTH EAST AT
YACA I HA.RB OR EZ
W'HEREAS, Resolution of Intention 90-63 was adopted in the matter of the
Vacation of a portion of Palos Verdes Drive South east of Yacht Harbor Drive on September 16,
199 i, which resolution established the time and place for the public hearing on said street vacation,
and
WHEREAS,due notice of said hearing was published and posted as required by
law; and

heard all evidence offered by persons interested in said vacation.
NOW THEREFORE,TBE CITY COUNCIL OF THE CITY OF RANCHO
PALOS VERDES FINDS,DETERMINES AND RESOLVES:
Section 1. That the City Council finds from all the evidence submitted:
(a) . That said portion of Palos Verdes Drive South described in Attachment"C"
hereto, was originally intended to be utilized for street and parkway purposes.
(b) The aforesaid portion of street right-of-way is unnecessary for present or
prospective public wehicuiar or non-vehicular use.
5ection 2. Tne Planning L omrmssion and City Council have considered the
General Plan of the.City of Rancho Palos Verdes and find the vacation to be in conformity with
said Plan.
S .n n That for the street in question, the portion of the full street right-of-
way as described in Attachment"C" is unnecessary for present or anticipated public use.
Section 4. Pursuant to Section 2381 of the Streets and Highways Code of the
State of California the City Council finds and determines the portion of right-of-way proposed for
abancionment is not useful for non-motorized transporrtatiou aci iries,
Section 5. The City Council therefore orders vacated the portion of Palos
Verdes Drive South east of Yacht Harbor Drive shown on Attachment"B" and described on
Attachment"C" subject to the conditions of approval set forth in Attachment"A"hereto.
Section 6. That the City Council reserves and exempts from the vacation the
following easements and right at any time, or from time to time, to construct,maintain,operate,
replace, remove, and renew sanitary sewers and storm drains and appurtenant structures in, upon,
over and across street right-of-way proposed to be vacated and, pursuant to any existing franchise
or gene%vals thereof, or otherwise. to construct, maintain, operate, replace, remove. renew and
enlarge lines of pipe,conduits,cables, wires and other convenient structures,equipment and
fixtures for the operation of gas, telephone, electrical, water, telegraphic lines and trails in, upon,
and over the portion of the street right-of-way proposed to be vacated.
Section 7. The owners of Lots 1 through 10 of Tract 16540 shall agree in
writing to the conditions of vacation`set forth in Attachment"A"of this Resolution within 30 days
of approval of this Resolution by the City Council.
Section$• The City Clerk is hereby ordered to cause a certified copy of this
Resolution., attested by the City Clerk under the Seal of this City, to be recorded in the office of the

1. The HomeownersAssociation shall acquire from each
property ,owner of Lots 1 through 10 of Tract 16540 a
quit claim deed transferring the subject portion of the
road easement to the Association and shall record said
needs with the County of Los Angeles prior to
recordation of the Resolution of vacation with the
Registrar Recorder of the County of Los Angeles,
2 . The Homeowners' Association shall supply the City with
an agreement subject to approval by the City Attorney
whereby the Association will assume the responsibility
for maintaining the trans f erred easements as a roadway
prior to recordation of the Resolution of Vacation with
the Registrar Recorder of the County of Los. Angeles.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF

WHEREAS,Resolution of Intention 90-63 was adopted in the matter of the

heard all evidence offered by persons interested in said vacation.
NOW THEREFORE,TIE CITY COUNCIL OF THE CITY OF RANCHO

S ection 1. That the City Council finds from all the evidence submitted:
