A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS
VERDES TAKING NO ACTION ON FINAL ENVIRONMENTAL IMPACT REPORT
NO, 31 AND DENYING ZONE CHANGE NO. 19 AND THE APPEAL OF
TENTATIVE PARCEL MAP NO, 18947 AND GRADING NO. 1460 FOR A
FOUR LOT SUBDIVISION AT THE END OF WINDPORT DRIVE.
WHEREAS, Wallace Pollock and Capellino Brothers Construction
have requested approval of a zone change and to subdivide an 8.8
acre parcel into four single family residential lots at the end of
Windport Drive; and
WHEREAS, the subject property is located within Indian Valley,
which forms the northern branch of Aqua Amarga Canyon, a large
watershed providing drainage for the west slope of the Palos Verdes
Peninsula. That portion of natural canyon between Hawthorne
Boulevard and Baycrest Drive was extensively filled with uncertified
materials from the mid- 1950's to the late 1960's to a maximum depth
of approximately 120 feet, during the construction of Hawthorne
Boulevard and the adjacent residential developments. The existing
drainage course on the subject property is currently unimproved,
i.e. is not contained in a pipe or lined channel, and is showing
signs of severe erosion, especially in the western portion of the
site at the top a large west - facing fill slope. Over time, the
uncertified fill material adjacent to Windport Drive has been
experiencing settlement under its own weight, which may be removing
lateral support from adjacent properties; and
WHEREAS, Draft and Final Environmental Impact Reports were
prepared and circulated in compliance with the California
Environmental Quality Act and State and local guidelines and the
Planning Commission considered the information, conclusions and
mitigation measures contained in these documents in their review of
the proposed project; and
WHEREAS, the Planning Commission held a public hearing on the
environmental review of the project on July 30, 1991, and held
public hearings on the project on August 19 and September 10, 1991
at which time all interested parties were given an opportunity to be
heard and present evidence, and held hearings on September 12 and
October 8, 1991 to consider the Final EIR; and
WHEREAS, on October 8, 1991, the Planning Commission adopted
resolutions recommending certification of the Final Environmental
Impact Report, recommending approval of the zone change and
approving the tentative parcel map and grading permit; and
WHEREAS, Tim Burrell, representing the applicants, filed a
"friendly" appeal of the Planning Commission's approval of the
tentative parcel map and grading permit to the City Council within
the fifteen (15) day appeal period, so that the City Council could
consider the entire project; and
WHEREAS, the City Council held a public hearing on the zone
change and appeal of the tentative parcel map and grading permit on
November 6, 1991, at which time all interested parties were given an
opportunity to be heard and present evidence.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES
DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS:
Section 1: The City Council finds that the General Plan land
use designation for the westerly portion of the subject property
proposed for a zone change and residential development is Natural
Environment /Hazard, due to the pre- existing natural canyon, the
extensive uncertified fill that has been placed on the site, which
may be subject to further settlement and high groundwater levels in
the future, and the Resource Management Districts identified on the
site in the General Plan.
Section 2: The City Council finds that the proposed zone change
from Open Space Hazard to RS -2 is not consistent with the goals of
the City, as expressed in the General Plan, which prohibits
activities in Resource Management Districts containing Hydrologic
Factors ARM 6) which increase canyon -wall erosion and the potential
for landslide on the subject property.
Section 3: The City Council finds that the proposed project
does not adequately protect the health, safety and welfare of the
public, since the environmental impacts associated with future .
potential settlement of the uncompacted fill material and ground
failures due to the potential presence of groundwater cannot be
adequately mitigated to eliminate adverse impacts.
Section 4: The City Council reviewed the Draft and Final
Environmental Impact Reports that were prepared for the project and
determined that, since the Council intended to deny the zone change
and subdivision, no action should be taken to certify Environmental
Impact Report No. 31.
Section 5: The City Council hereby denies Zone Change No. 19,
thereby maintaining the Open Space Hazard zoning designation on the
subject property, directs Staff to initiate the proper procedure to
modify the General Plan land use map to clearly designate the area
adjacent to Windport Drive as Hazard, to reflect the intent of the
General Plan and denies the appeal of Tentative Parcel Map No. 18947
and Grading No. 1460, thereby denying the proposed subdivision and
grading of the subject property into four single family residential
lots.
