CC RES 1991-077RESOLUTION NO. 91 -77 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES ADOPTING A NEGATIVE DECLARATION FOR ENVIRONMENTAL ASSESSMENT NO. 630 AND AMENDING THE CITY'S GENERAL PLAN TO INCORPORATE THE TRAIL AND BIKEWAY DEVELOPMENT POLICY AND INCLUDE THE TRAILS CATEGORY DEFINITIONS IN THE GENERAL PLAN WHEREAS, on January 22, 1990, the City Council adopted the Conceptual Trails Plan and on September 24, 1990 a joint Council sub - committee and the Trails Committee made a recommendation for an amendment to the General Plan for inclusion of the Trail Development Policy into the General Plan for implementation of the Conceptual Trails Plan; and WHEREAS, after notice issued pursuant to the provisions of the City's Development Code, the City Council of the City of Rancho Palos Verdes held a public hearing on December 6, 1990 for initiation of an amendment to the City's General Plan for incorporation of the Trail and Bikeway Development Policy into the General Plan at which time all interested parties were given the opportunity to be heard and present evidence and the City Council approved the request for initiation of an amendment to the General Plan; and WHEREAS, after notice issued pursuant to the provisions of the City's Development Code the Planning Commission of the City of Rancho Palos Verdes held a public hearing on May 14, 1991 for recommendation of incorporation of the proposed amendment to the City's General Plan to the City Council, at which time all interested parties were given the opportunity to be heard and present evidence and the Planning Commission recommended an amendment to the General Plan; WHEREAS, after reviewing the proposed amendment, Staff determined that the project was not exempt from the requirements of the California Environmental Quality Act ("CEQA ") and prepared an Environmental Assessment; and WHEREAS, on October 8, 1991 Staff completed an Initial Study of the project and determined that the proposed amendment to the General Plan will not result in any adverse significant impacts to the environment as set forth in the Initial Study; and WHEREAS, after notice issued pursuant to the City's Development Code, the City Council held a public hearing on September 16, 1991 to discuss the proposed amendment and on November 6, 1991 to discuss the Draft Negative Declaration, at which times all interested parties were given an opportunity to be heard and present evidence. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS: Section 1: The amendment to the General Plan to incorporate the Trail and Bikeway Development Policy and to include the Trails Category definitions will not cause any significant adverse environmental impacts as described in the Negative Declaration, Initial Study, and Environmental Assessment attached hereto respectively as Exhibits "A ", "B", and "C" because individual trails, when developed, will be subject to further environmental analysis during review and evaluation of development applications, the Development Code requires maintenance to prevent the accumulation of odor causing material on private property on which horses are kept, the City already provides regular maintenance of existing trails. dedicated to the City for public use, and noise levels are anticipated to be similar and no more excessive than noises associated with normal residential uses. Section 2: The amendment to the General Plan is reflective of existing goals and policies contained in the General Plan, The Conceptual Trails Plan contains categories of trails and trails standards reflective of existing trails and conceptual trails in the City. By referencing the trails categories and status as contained in the Conceptual Trails Plan, the amendment provides a means for review and evaluation of trails as development occurs throughout the City, but does not.necessarily mandate their construction. Accordingly, the amendment will not cause any significant adverse environmental impacts. Section 3: The amendment to the General Plan is deemed to be in the public interest because it will provide a means for implementation of the Conceptual Trails Plan and will allow for the creation of new trails and pathways for pedestrian, equestrian, and bicycle use as development occurs throughout the City, and will provide additional recreational opportunities in the City. Section 4: That this is the first amendment to the City's General Plan to be approved within the calendar year 1991, which is less than the four (4) amendments permitted pursuant to Section 65358 (b) of the California State Government Code per calendar year. Section 5: The amendment will not individually or cumulatively have an adverse effect on wildlife resources, as defined in Section 711.2 of the Fish and Game Code because the Trail and Bikeway Development Policy includes a requirement for trails to be constructed to have a minimal Resolution No, 91 -77 Page 2 impact on the environment. Section 6: That the language in paragraph 9 of the Path and Trails Networks discussion contained in the Urban Environment Element of the General Plan on pages 124 -136 is hereby amended as described in the attached Exhibit "D ". Section 7: That the seven (7) policies contained in the Trail and Bikeway Development Policy are hereby added to the existing twenty -one (21) Transportation Systems Policies found in the Urban Environment Element of the City's General Plan as described in the attached Exhibit "E". NO. 91 -77 EXHIBIT "A" EXHIBIT "B" INITIAL STUDY ENVIRONMENTAL ASSESSMENT NO, 630 SITE AND PROJECT DESCRIPTION This initial study has been prepared in association with Environmental Assessment No. 630 for a proposed amendment to the City's General Plan for incorporation of the Trail and Bikeway Development Policy and inclusion of the Trails Category definitions as contained in the Conceptual Trails Plan which was adopted on January 22, 1990. This study evaluates the City wide implications of the proposed amendment. Evaluation of individual trails will be conducted during review of development applications for specific projects. The City of Rancho Palos Verdes is located on the Palos Verdes Peninsula in the southwestern portions of Los Angeles County, The City includes 12.3 square miles of rolling terrain, canyon areas, and steep rocky cliffs along the 7 -1/2 miles of coastline. Approximately one -third of the total land is vacant, with three- quarters of the immediate coastline remaining vacant. ENVIRONMENTAL ISSUES Preparation of the Environmental Assessment revealed that the following environmental issues may be effected by the proposed amendment to the General Plan. Other environmental issues (as described in the California Environmental Quality Act) have been examined and have been determined to be of no concern within the parameters of this project. Y g Page 2 Initial Study: Environmental Assessment No, 630 October 8, 1991 FINDINGS /DETERMINATION The proposed amendment to the General Plan is not anticipated to have significant adverse environmental impacts. Implementation of trails in accordance with the proposed policies will be beneficial to the community by providing additional recreational opportunities, and is in conformance with existing policies contained in the General Plan. Impacts associated air, noise, and public services are not considered to be significant because of existing maintenance services provided in the City and because potential increases in noise levels are anticipated to be no more excessive than those associated with normal residential uses. In view of the foregoing information and analysis, the Environmental Assessment questionnaire, supplemental data, and other information sources, it has been determined that a Negative Declaration should be issued. This Initial Study was prepared by Terry Silverman, Associate Planner, under the direction of the Director of Environmental Services on October 8, 1991. NO. 91 -77 -10- EXHIBIT "D" GENERAL PLAN AMENDMENT The walkways, bikeways, and equestrian trail alignments contained in the City's Conceptual Trails Plan (adopted January 22, 1990 and amended September 16, 1991) should be essentially considered from an "Arterial" or "Collector" standpoint. It should be noted that the alignments are flexible, and may be subject to rerouting and perhaps even elimination. By the same token, it may become evident through time that more should be added. As such, the following trails categories have been established to indicate what would be involved in the implementation of a particular trail identified in the Conceptual Trails Plan: Category I: Existing, dedicated trails which meet trail standards. Category II: Proposed trails and trail segments which cross undeveloped privately owned land that is zoned as being developable. These trails and trail segments should be implemented when the respective parcels of land are developed. Category III: Proposed trails and trail segments which are located on existing trail easements, City property, or street rights -of -way and which require implementation or improvements. Category IV: Proposed trails and trail segments which cross privately -owned land designated as Open Space or Open Space Hazard, or on land owned by a public utility or public agency. These trails and trail segments require the acquisition of easements, and my require implementation or improvements. Category V: Proposed trails which would primarily benefit neighborhood residents, and which cross privately -owned land. Efforts to implement these trails shall only be initiated by affected property owners or community groups. The City shall provide guidance to those who wish to implement these trails, but will not initiate efforts to implement them. NO. 91 -77 EXHIBIT "E" GENERAL PLAN AMENDMENT TRAIL AND BIKEWAY DEVELOPMENT POLICY 22 - Reflect the elements of the City's Conceptual Trails Plan in appropriate City processes and procedures depending on trails categories and status as defined in the Conceptual Trails Plan. For each trail category, the City's action should include: a - Category I: No action required. b - Category II: Inclusion of these trails, or alternate approaches to provide access, should be considered in conjunction with the review and approval by the Planning Commission or City Council of all proposals for land development* or major construction, ** * Land development shall mean development proposed through a subdivision of land application and /or conditional use permit application . ** Major construction shall mean development proposed through * a conditional use permit application, major grading application, . or variance application . c — Category III: Consideration of these trails or alternate approaches to provide access, prior to bid solicitation in projects involving the Department of Public Works or the Department of Recreation and Parks d - Category IV: Efforts to implement these trails by soliciting voluntary offers to dedicate easements. In some cases, the City may seek the dedication of an easement as a mitigation measure for significant property improvements.* * Significant property improvements shall mean development proposed through a conditional use permit, grading application, or variance application. e - Category V: Implementation of these trails only upon initiation by affected property owners or community groups. The City shall not initiate efforts to implement Category V trails. f - Category VI: Individual evaluation of these trails. EXHIBIT "E" -1- RESOL. NO. 91 -77 Trail and Bikeway Development Policy Page 2 23 - Design and construct trails in accordance with U.S. Forest Service standards, wherever possible. 24 - Construct trails to have a minimal impact on the environment. 25 - Align trails to provide maximum access to scenic resources. 26 - Include those bikeways in the Conceptual Bikeways Plan, or alternate approaches to provide access, prior to approval of proposals for land development* by the Planning Commission or City Council. * Land development shall mean development proposed through a subdivision of land application and /or conditional use permit application. 27 - Consider the inclusion of bikeways in the Conceptual Bikeways Plan, or alternate approaches to provide access, prior to project bid solicitation in all Department of Public Works or Department of Recreation and Parks projects.
