CC RES 1991-038RESOLUTION NO. 91 -38 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES ORDERING THE PLACEMENT OF LIENS ON REAL PROPERTY AND THE PLACEMENT OF CHARGES ON THE PROPERTY TAX BILL FOR COLLECTION AND SETTLEMENT OF DELINQUENT REFUSE ACCOUNTS WHEREAS, the City of Rancho Palos Verdes Municipal Code, Section 8.20.270, includes provisions to place delinquent refuse accounts and fees on the property tax bill for collection, as well as place liens on real property for said amount and; WHEREAS, on the 22nd day of May, 1991, the City did give written notice to all property owners and occupants of said property by United States mail, informing them that on Wednesday, June 5, 1991, at 7:30 p.m., a public hearing shall be held to hear the above report and any objections or protests thereto; and WHEREAS, said notice was mailed more than ten (10) days prior to the hearing; and WHEREAS, the public hearing was conducted by -the City Council on June 5, 1991 and June 17, 1991; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE AND ORDER AS FOLLOWS: Section 1: That Mr. Douglas Murray, 4136 Palos Verdes Drive.South, is hereby removed from the Ivy Rubbish Disposal delinquent list and from Exhibits A and B hereto because Mr. Murray has fully paid for the curb -side service which he received. Section 2: That $50.00 of any delinquency which occurred for any parcel prior to February 1, 1990, is hereby forgiven. Section 3: That the delinquent charges and fees described in Exhibit A attached hereto, as amended and confirmed by the City Council, shall constitute special assessments against the respective parcels of land and are a lien on the property for said amount if payment is not -made by the property owners by June 19, 1991, provided that Waste Management of Gardena and Ivy Rubbish Disposal each enter into an agreement with the City indemnifying, defending and holding the City harmless from any and all claims arising from the attempt to collect delinquent charges which occurred prior to February 1990. If either rubbish company does not enter into such an agreement with the City within ten days of approval of this Resolution, only the delinquencies of that company which occurred after February 1990 shall be recorded with the County. Section 4: That the assessment shall be filed with the office of the Los Angeles County Auditor /Controller and said amount shall be collected at the same time and in the same manner as are the county property taxes and shall be subject to the same penalties and to the same procedure and sale in case of delinquency as provided for ordinary county property taxes.
