A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
RANCHO PALOS VERDES DENYING THE APPEAL OF
VARIANCE NO. 317 FOR THE EXISTING CONVERSION OF
A GARAGE TO HABITABLE SPACE AT 27841 WESTERN
AVENUE.
WHEREAS, the applicant, Mr. Robert Chagnovich
has requested a Variance to allow an existing garage
conversion to habitable space, with no provision for the
required two (2) minimum garage spaces at 27841 Western
Avenue; and
WHEREAS, after notice issued pursuant to the
provisions of the Development Code, the Planning Commission
held a public hearing on March 24, 1992, and adopted a P.C.
Resolution No. 92 - 21;
WHEREAS, Mr. Chagnovich submitted a written appeal of
the Planning Commission decision on April 13, 1992, within
the fifteen (15) day appeal period.
WHEREAS, after notice pursuant to the provisions of
the Rancho Palos Verdes Development Code, the City of Council
held a public hearing at which time all interested parties
were given an opportunity to be heard and present evidence;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF
RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE
AS FOLLOWS:
Section 1: That there are no exceptional or
extraordinary circumstances or conditions applicable to the
property, or its intended use, which do not apply generally
to other properties in the same zoning district since the
subject property is rectangular in shape and does not feature
any unusual topography.
Section 2: That the variance is not necessary for
preservation and enjoyment of a substantial property right
of the', landowner which right is possessed by other property
owners in the same zoning district since other property
owners maintain a two car garage. As an alternative to the
request, the garage could be re- converted for vehicle storage
or a new garage could potentially be constructed in the area
currently occupied by the indirect access driveway subject
to submittal of permits to the City.
Section 3: That the granting of the variance would be
materially detrimental to the public welfare since there is
no provision for an enclosed parking area, vehicles must park
in the driveway or on the street. Fewer cars parked on the
street reduces the risk of pedestrian - vehicle accidents and
visibility from curb to curb is improved. Finally, the
cumulative effect of granting similar variance requests could
lead to security, circulation and aesthetic problems within
the adjacent neighborhood.
Section 4: For the foregoing reasons, and based on
the information and findings included in the staff report,
minutes and evidence presented at the public hearing, the
City Council of the City of Rancho Palos Verdes hereby denies
Variance No. 317 thereby denying the landowner's request to
maintain the existing conversion of the garage to habitable
space at 27841 Western Avenue.

1992.
