A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF RANCHO PALOS VERDES
ESTABLISHING A LIMIT ON THE TERM OF THE CITYWIDE
LANDSCAPING AND LIGHTING MAINTENANCE DISTRICT,
ESTABLISHING A LIMIT ON THE ANNUAL INCREASES
IN THE BUDGET OF SUCH DISTRICT, AND AUTHORIZING
DEFERRAL OF PAYMENT OF ASSESSMENTS BY INDIVIDUALS
WHEREAS, the City of Rancho Palos Verdes has experienced a
significant reduction in revenues due to a declining tax base and
a reduction in State subventions; and
WHEREAS, after a series of expenditure reductions and fee
increases, City Council is still faced with a General Fund
shortfall of over $1 million for Fiscal Year 1992 -93; and
WHEREAS, City Council has determined that an equitable method
of having property owners pay for certain services which enhance
the values of their properties is through the establishment of a
Citywide Landscaping and Lighting Maintenance District; and
WHEREAS, the establishment of a Citywide Landscaping and
Lighting District would reduce the City's General Fund shortfall by
approximately $800,000; and
'VMEREAS, the City Council has established a Citywide
Landscaping and Lighting Maintenance District pursuant to the
Landscaping and Lighting Act of 1972; and
WHEREAS, residents of Rancho Palos Verdes have expressed
concern that the Citywide Landscaping and Lighting Maintenance
District's assessments will be renewed and increased automatically
without significant public input and without looking for
alternative means of reducing the budget shortfalls.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF RANCHO PALOS VERDES:
Section 1. Property in the Citywide Landscaping and Lighting
Maintenance District, as established by the City Council of the
City of Rancho Palos Verdes on August 9, 1992, shall be assessed
for a period not to exceed two years. Such assessments shall cease
to exist on June 30, 1994, except for areas which predated
formation of the Citywide district, or other areas which request
improvements or services benefitting specific properties.
Section 2. During the two year period in which the Citywide
district is in effect, the district budget shall be limited to the
original fiscal year 1992 -93 budget of $868,,4.00.
Section 3. It is the City Council's intent to establish
procedures whereby an individual who is financially unable to pay
the assessment levied against lots and parcels within the Citywide
district may enter into an agreement with the City whereby the
payment by the individual of the assessment and penalty or interest
thereon may be deferred.
