CC RES 1992-048 RESOLUTION NO. 92-48 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES ORDERING VACATION OF THE PEDESTRIAN TRAIL ALONG PASEO DE PINO AND PASEO DE CASTANA WITHIN TRACT 33206 WHEREAS, the Resolution of Intention 92-35 was adopted, in the matter of the vacation of the pedestrian trail in Tract 33206 in the City of Rancho Palos Verdes, on April 21, 1992, which resolution established the time and place for the public hearing on said trail vacation; and WHEREAS, due notice of said hearing has been published and posted as required by law; and WHEREAS, at the hearing the City Council heard all evidence offered by persons interested in said vacation; and WHEREAS, there is additional public access to the Loop Trail through Tract No. 33206 so that the vacation of this trail will not eliminate public access from this Tract to the trail network throughout the City; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES FINDS, DETERMINES AND RESOLVES: Section 1. The City Council finds from all the evidence submitted: (a) That said portion of the trail within Tract 33206 described in Resolution of Intention, namely Resolution 92-35 was originally intended to be utilized for pedestrian purposes. (b) That the aforesaid trail is unnecessary for present or prospective public use. Section 2, The City Council has considered the General Plan of the City of Rancho Palos Verdes and finds the vacation to be in conformity with said Plan. Section 3. Pursuant to Section 2381 of the Streets and Highways Code of the State of California the City Council finds and determines the trail proposed for abandonment is not useful as a non-motorized transportation facility. Section 4. The city Council of the City of Rancho Palos Verdes hereby orders that the pedestrian easement along Paseo de Pino and Paseo de Castana within the Tract 33206, also known as the S&S Development, within the City of Rancho Palos Verdes shall be and is hereby vacated. 920515 pjr 5230530 (1) Section 5, The City Council reserves and exempts from the vacation the easement and right at any time, or from time to time, to construct, maintain, operate, replace, remove, and renew sanitary sewers and storm drains and appurtenant structures in, upon, over and across street rights-of-way proposed to be vacated and, pursuant to any existing franchise or renewals thereof, or otherwise, to construct, maintain, operate, replace, remove, renew and enlarge lines of pipe, conduits, cables, wires and other convenient structures, equipment and fixtures for the operation of gas pipelines, telegraphic and telephone lines and for the transportation or distribution of electric energy and water and for incidental purposes, including access to protect such works from all hazards in, upon, and over the pedestrian trail and right of way herein vacated. Section 8. The City Clerk is hereby ordered to cause a certified copy of this Resolution, attested by the City Clerk under the Seal of this City, to be recorded in the office of the County Registrar-Recorder of Los Angeles County.
