A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF RANCHO PALOS VERDES DENYING A REQUEST TO
INITIATE AN AMENDMENT TO THE GENERAL PLAN TO
CHANGE THE LAND USE DESIGNATION FROM HAZARD
AREA TO SINGLE FAMILY RESIDENTIAL ON TWO
PROPERTIES LOCATED AT 3135 AND 3149 CROWNVIEW
DRIVE.
WHEREAS, on December 3, 1990, the applicant and property
owner, Mr. David M. Leeper filed a request to initiate an
amendment to the General Plan to change the land use
designation of property located at 3135 Crownview Drive, which
he purchased in October, 1989 and 3149 Crownview Drive, which
he purchased in May, 1990, from Hazard Area to Residential with
1 -2 dwelling units per acre; and
WHEREAS, on May 31, 1991, the City's geotechnical
consultant, after reviewing geotechnical and soils reports
submitted by the applicant, determined that the sites at 3135
and 3149 Crownview Drive are geologically stable for single
family residential development provided that extensive
engineering requirements are incorporated into the design of
the residential homes, including the clearing of all vegetation
and debris, the removal of all fill soils and the use of
caissons imbedded in bedrock for the proposed buildings and any
retaining walls; and
WHEREAS, on February 4, 1992, the City Council of the City
of Rancho Palos Verdes discussed the proposed initiation of a
General Plan. amendment at a regularly scheduled public meeting
of the City Council, at which time all interested parties were
given the opportunity to be heard and present evidence.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RANCHO
PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS
FOLLOWS:
Section 1: That the two lots which are the subject of the
General Plan Amendment initiation request are located on a
steep undeveloped canyon slope with a gradient of approximately
50% which is considered an extreme slope per the General Plan
as it exceeds a 35% gradient. The lots also contain natural
vegetation, consisting of but not limited to, wild flowers.,
chaparral and grasslands communities. Accordingly, the General
Plan identifies the following Resource Management Districts as
the basis for the Hazard Area designation of the two subject
lots: 1) extreme slope 2) high slope 3) old landslide area and
4) natural vegetation.
Section 2: That beyond the issue of geologic stability,
and in accordance with the Extreme Slope and Natural Vegetation
Resource Management Districts identified in the General Plan,
the natural characteristics of these lots, such as land form,
natural vegetation and wildlife communities, scenic qualities
and open space, should be substantially maintained wherever
possible.
Section 3: That development of the two subject lots under
a residential land use designation, including the provision of
vehicular access to the lots and the creation of usable yard
area, would necessitate a considerable amount of engineered
grading and construction work which would cause significant
disruption to the identified natural resource areas on the
subject property.
Section 4: That since adoption of the City's General Plan
on June 26, 1975, the General Plan Land Use Designation of the
two subject lots has been "Hazard Area" based on specific
physical constraints identified as Resource Management
Districts in the General Plan and discussed above.
Section 5: For the foregoing reasons and based on the
information and findings included in the Staff Report and
records of proceedings, the City Council of the City of Rancho
Palos Verdes hereby denies the request to initiate an amendment
to the General Plan to change the land use designation from
Hazard Area to Residential with 1 -2 dwelling units per acre at
3135 and 3149 Crownview Drive.
