A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF RANCHO PALOS VERDES APPROVING GENERAL PLAN
AMENDMENT NO. 21, TO ALLOW FOR THE ADDITION OF
AN AUTOMOTIVE SERVICE OVERLAY CONTROL DISTRICT
TO THE CITY'S GENERAL PLAN.
WHEREAS, eight service station sites currently exist in the
City of Rancho Palos Verdes. Four are located in Commercial zones;
three are located in Residential zones; and one is located in an
Institutional zone. Pursuant to the Development Code, service
stations within any Commercial zone require a Conditional Use
Permit, and those located within the Residential and Institutional
zones are currently legal, non - conforming uses which may not make
significant expansions or improvements; and,
WHEREAS, it is the intent of the City to encourage the eight
existing service stations to remain in business and provide
necessary services to the citizens of Rancho Palos Verdes; and
therefore the City has initiated General Plan Amendment #21, Zone
Change #22, and Code Amendment #37 to amend certain land use and
zoning designations in order to allow the service stations to
become legal and conforming uses; and,
WHEREAS, after notice issued pursuant to the provisions of the
Rancho Palos Verdes Municipal Code, and Government Code Section
65353, public hearings were held before the Planning Commission on
July 27, 1993, August 24, 1993 and October 12, 1993, at which time
all interested parties were given an opportunity to be heard and
present evidence regarding the General Plan Amendment; and,
WHEREAS, on September 14, 1993, the Planning Commission
adopted P. C. Resolution No. 93 -24 recommending approval to the
City Council of a Draft Negative Declaration associated with
Environmental Assessment No. 653, for amendments to the City's
General Plan and Municipal Code regarding land use and zoning
designations; and,
WHEREAS, on October 12, 1993, the Planning Commission adopted
P.C. Resolution Nos. 93 -37 and 93 -38 recommending approval of
General Plan Amendment No. 21, and the associated Zone Change No.
21 and Code Amendment No. 37, to the City Council; and,
WHEREAS, after notice issued pursuant to the provisions of the
Rancho Palos-Verdes Municipal Code, the City Council held public
hearings on September 21, 1993 and October 21, 1993 to consider the
Planning Commission's recommendations on the proposed General Plan
Amendment, at which time all interested parties were given an
opportunity to be heard and present evidence.
WHEREAS, on October 21, 1993, the City Council adopted
Resolution No. 93 -96 adopting a Negative Declaration associated
with Environmental Assessment No. 653 for amendments to the City's
General Plan Amendment and Municipal Code.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RANCHO PALOS
VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS:
Section 1: The City Council reviewed the Negative Declaration
prepared for this project and f Inds that this document was prepared
in compliance with the California Environmental Quality Act (CEQA)
and the City's CEQA Guidelines, The City Council considered the
information and findings contained in the Negative Declaration
prior to taking any action on the proposed General Plan Amendment.
Section 2: The City Council finds that General Plan Amendment
No. 21 is consistent with the Rancho Palos Verdes General Plan in
that it upholds, and does not hinder, the goals and policies of the
General Plan, and further serves to carefully control and direct
future growth toward making a positive contribution to all elements
of the community.
Section 3: The City Council further finds that the amendments
to Title 17 are necessary to preserve the public health, safety,
and general welfare in the area.
Section 4: For the foregoing reasons and based on the
information and findings included in the Staff Reports, minutes and
records of the proceedings, the City Council hereby approves
General Plan Amendment No. 21, making certain amendments to the
City's General Plan as set forth in the attached Exhibit "A" to
create an Automotive Service Overlay Control District for the City,
PASSED, APPROVED AND ADOPTED this 3rd day of November 1993.

110 Page 84: The paragraph entitled "Service Stations" shall be
modified as follows:
The number of service stations has decreased from ten in 1975
to r��� JB 4.982 eight in 1993, which includes two sites on
Western Avenue, which were annexed into the City in 1983.
There is no longer an oversupply of service stations along
Crest Road or Palos Verdes Drive South.
2. Page 196: The last paragraph on this page, which reads as
follows, shall be deleted:
This paragraph shall be replaced with the following language:
Over the course of the past twenty years, the community has
become accustomed to and dependent upon certain commercial
activities which are scattered throughout the City. The
locations of these commercial uses are on corner lots along
the City's most predominant arterials or. collector streets.
Due to the length of time that these businesses have been in
existence, and the community's demand for them, it is
preferable that these sites should not revert to the
surrounding land use, but rather that the sites should retain
the flexibility to either continue the existing use or revert
to the underlvnng land use as warranted by future economic and
social conditions.

Control Districts_ Applying to Automotive Service Uses
The Automotive Service Overlay Control District is established
to preserve existing automotive commercial services which are
essential to the residents of the City.

The development criteria for such projects shall
require that the design of the project reduce
adverse impacts on adjoining residential areas.
In evaluating the development criteria for such
projects, the city shall consider the
characteristics of the particular site and the
surrounding area, and shall attempt to achieve a
reasonable balance between the optimum design for
the commercial automotive use and the
environmental, social, and aesthetic impacts of the
proposed use on the existing surrounding uses.
